About this file
This is a Determination to Solicit from a Single Source document for a federal procurement under FAR 13.106-1(b)(1)(i). The U.S. Department of the Interior, Bureau of Reclamation, Interior Region 8: Lower Colorado Basin (LCB) Acquisitions and Assistance Management Office seeks to procure services and parts for diagnosis and repair of a 30KVA Model 9390 existing UPS unit at Hoover Dam. The single source identified is Eaton, located at 6225 S. Valley View Blvd, Las Vegas, NV 89115. The estimated procurement value is redacted in the document. The requirement became known on February 10, 2026, and solicitation was conducted on February 11, 2026, with responses requested by February 13, 2026.
The justification for single-source procurement is based on urgency, as the UPS unit has failed and Hoover Dam currently lacks backup power capability, creating vulnerability to operational disruptions and financial loss. Market research identified four potential vendors, but only one responded, stating inability to provide OEM-certified technicians. Eaton is the sole source capable of providing OEM-certified components and technicians required to service the equipment, as each UPS cabinet contains Eaton-manufactured parts and requires Eaton-certified technicians to modify firmware parameters for optimal performance. Fair and reasonable pricing will be determined through market research and comparison to an independent government cost estimate. The document was prepared by Bryan Williamson on February 17, 2026, and approved by Contracting Officer Luis Gallardo on February 19, 2026.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity.
U.S. Department of the Interior, Bureau of Reclamation, Interior Region 8: Lower Colorado Basin (LCB), Acquisitions and Assistance Management Office.
2. Name and Address of Single Source.
Company: Eaton 6225 S. Valley View Blvd Las Vegas, NV 89115
3. Description of Supplies/Services and Estimated Cost.
The Bureau of Reclamation, Hoover Dam, is in need of services and parts to the 30KVA Model 9390 existing UPS unit can be diagnosed and repaired. The estimated value of this procurement is .
4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because of the urgency of this requirement. The diagnosed and repair of the existing UPS unit must be completed as soon as possible, as it is an essential system that provided back up power to equipment supporting the Hoover Dam powerplant and critical loads throughout. This office became aware of the requirement on February 10, 2026. Currently, this UPS has failed leaving Hoover Dam without backup power option should they lose power. Each day that this system remains out of service leaves Hoover vulnerable to their day-to-day operation and daily financial income if they encounter issues with their power supply.
Each respective Eaton UPS cabinet at Hoover is composed of parts manufactured and supplied strictly by Eaton. The parts supplied under the SLEP contract, certified original equipment manufacturer (OEM) components, are provided by Eaton to ensure they conform to the original performance

WBR 1413.106-1 Template 1 (11/2020) capabilities and features as defined by the OEM (Eaton).
Market Research into this requirement was conducted in which four possible vendors were identified as potentially being able to fulfill this service. An email was sent on February 11, 2026, to each vendor to see if they were able to provide this service and how quickly, with a requested response by February 13, 2026. We received a response from only one vendor in which they stated they are not able to provide OEM certified technicians.
Additionally, each UPS cabinet also has a surface mounted component electronic package assembly that requires a specific firmware version, to allow control parameters to be tuned and modified for optimal performance. These parameters can only changed by Eaton certified technicians.
5. Determination of Fair and Reasonable Price.
In accordance with FAR 13.106-3(a)(2) pricing will be determined fair and reasonable using market research and comparison to the independent Government cost estimate.
6. Description of Market Research.
Market Research was conducted on M365 Copilot. This AI tool provided four national authorized OEM companies. One of the four was Eaton Las Vegas branch. This vendor provides the quickest response and the materials needed for this requirement. Since there is an urgency in this requirement having a local vendor available is essential. The other vendors can still be contact for pricing if it is determined that unreasonable and unbalanced pricing may exist.
