About this file

This is a contract modification notice from the USDA Forest Service, Contracting Division, dated April 22, 2026.

The document notifies contractors that, in accordance with Executive Order 14398, federal agencies are required to incorporate FAR clause 52.222-90 (Addressing DEI Discrimination by Federal Contractors) into all existing contracts exceeding the micro-purchase threshold. The clause prohibits contractors from engaging in racially discriminatory Diversity, Equity, and Inclusion (DEI) activities, specifically defined as disparate treatment based on race or ethnicity in recruitment, employment, contracting, program participation, or allocation of resources. Contractors are obligated to report certain subcontractor conduct related to these prohibited activities and must provide access to relevant records upon request by the Contracting Officer. The notice was issued by Michael J. Wheelock, Contract Specialist, and references Executive Order 14398 for additional information.
