About this file

This document is a Justification for Brand Name Exception to Fair Opportunity for the Department of Homeland Security, FEMA's Office of National Continuity Programs. The procurement is for VMware Cloud Foundation 5, specifically 288 Cores for a 1-processor, 1-year subscription for the Integrated Continuity Communications Transport (ICCT) system. FEMA is seeking a sole-source procurement of VMware software, justifying the brand-specific purchase by citing the unique requirements of their existing infrastructure, potential operational disruptions, and increased costs associated with switching to alternative software solutions.

The solicitation is structured as a small business set-aside with a planned posting on SAM.gov, covering a base year from 07/29/2025 to 07/28/2026 and four optional years extending through 07/28/2030. The procurement follows Simplified Acquisition Procedures under FAR Part 13, with the goal of awarding a single Delivery/Purchase Order. The government requires new, non-refurbished parts and has already secured funding equal to or exceeding the Independent Government Cost Estimate. Offerors will be expected to provide pricing valid for 30 days after their response, with FOB Destination pricing preferred.

Justification for Brand Name Exception to Fair Opportunity Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(a)(4)

JEFO No.: 24-069

Date: 4/17/2025 PR Number: WX03265Y2025T

1. Nature and/or description of the item/service being procured and anticipated cost:

The Department of Homeland Security, FEMA, Office of National Continuity Programs, Continuity Communications Division, prepared this justification for an exception to fair opportunity for the purchase of the Integrated Continuity Communications Transport (ICCT) VMware 288Cores--VMware Cloud Foundation 5 for 1 processor for 1 Year Subscription in the projected amount of

2. Statutory Exception and rationale for brand name. Only one awardee is capable of providing the software required at the level of quality required because the supplies are unique or highly specialized pursuant to FAR 16.505(b)(2)(i)(B) and is an item peculiar to one manufacturer:

Procuring an alternate software other than VMware will require all existing inventory and software currently supported by existing VMware to be replaced with other software that does not meet the requirements of the ICCT. To support a different software solution would result in an increase in total program cost. Additionally, the Government has already purchased software for the Dell server that are currently in use. More importantly and as described above, the procurement of a different software solution could cause delays in the operations and maintenance of an essential National Security System that supports ONCP’s compliance to OMB/OSTP Directive 16-1 mission whereas the procurement of 288 Cores of a Dell/VMware Cloud Foundation software would not.

3. FEMA intends to post this requirement on or SAM.gov pursuant to FAR 16.505(b)(2)(ii)(D).
