About this file

This is a Bid Bond Preparation Instructions document issued by the State of West Virginia, Department of Administration, Purchasing Section. The document provides detailed guidance for bidders submitting proposals to state agencies. It establishes the requirements and format for bid bond submission, including the mandatory inclusion of a surety bond as security for bid acceptance. The bid bond must be executed by both the principal (bidder) and an authorized surety agent, with all required signatures, seals, and notarizations properly affixed. Bidders must include a power of attorney document with surety seal as accompanying documentation.

The minimum acceptable bid bond amount is five percent of the total bid value, which can be stated either as a percentage or a specific dollar amount. The surety company executing the bond must be licensed in West Virginia and must affix its corporate seal to the document. The bid bond becomes null and void if the bid is rejected or if the principal accepts the contract and fulfills all obligations, including furnishing any additional bonds or insurance required by the bid specifications. The surety's liability is expressly limited to the penal amount of the bond, and the surety waives notice of any time extensions granted by the state. All bid bonds must be properly dated and signed by authorized officers of both the principal entity and surety company.
