About this file
This is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers, Florida, for federally funded construction projects. The form serves as a contractual requirement under the Infrastructure Investment and Jobs Act passed on November 15, 2021, and applies to all construction, alteration, maintenance, and repair projects receiving federal funding. Respondents must certify their understanding and compliance with BABA provisions, which mandate the use of iron, steel, manufactured products, and construction materials produced in the United States. The certification confirms that contractors will identify domestic sources for BABA-covered products, provide verification documentation for compliance, and submit waiver documentation when needed in accordance with current federal guidelines. The form includes signature, date, and company information fields for the contractor's authorized representative.
Contractors executing this certification acknowledge that BABA provisions apply to all project portions, including subcontracted work, and understand that false statements on the form may result in rejection or termination of contract awards. The certification is integral to the City of Fort Myers' architectural services continuing contract (RSQ 25-069), which involves a three-year initial term with two potential one-year renewal options. Firms responding to this solicitation must comply with all BABA requirements alongside other federal and state regulations, including E-Verify verification, Disadvantaged Business Enterprise reporting, and various certifications related to non-collusion and lobbying activity disclosures. The city intends to establish a continuing contract for architectural services on an as-needed basis for multiple city projects, with compensation structured on a not-to-exceed basis determined by actual hours worked and reimbursable expenses.
