About this file
This is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers, Florida, for contractors responding to federally funded construction projects. The form establishes compliance requirements mandated by the Infrastructure Investment and Jobs Act of November 15, 2021, and applies to all construction, alteration, maintenance, and repair work. Contractors submitting responses to City of Fort Myers projects must certify their understanding and commitment to BABA provisions, which require the use of iron, steel, manufactured products, and construction materials produced in the United States. The certification applies to all project portions, including subcontracted work, and respondents must identify domestic sources of BABA-covered products and provide verification documentation for compliance. Contractors are required to submit the completed form with signature, date, printed name and title, company name, email, phone number, and address. False certification statements may result in rejection or termination of any award or contract.
The BABA requirements represent a critical compliance mandate for the City of Fort Myers' federally funded projects. As demonstrated by the related Architectural Services Continuing Contract (RSQ 25-069), contractors must demonstrate awareness and adherence to these provisions when competing for city work. The certification form serves as a contractual obligation mechanism ensuring that domestic manufacturing standards are maintained throughout project delivery, with particular emphasis on materials sourcing and supplier verification. Contractors failing to comply with BABA provisions or providing false certifications face serious consequences, including contract termination and potential debarment from future opportunities. The certification requirement underscores the City of Fort Myers' commitment to federal Buy American standards and ensures accountability in the use of federal infrastructure funds.
