About this file

The document is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers Procurement Services for a post-Hurricane Ian Palm Replacement project. The form requires contractors to certify compliance with federal regulations mandating the use of iron, steel, manufactured products, and construction materials produced in the United States, as stipulated by the Infrastructure Investment and Jobs Act passed on November 15, 2021. The certification applies to all project aspects, including subcontracted portions, and requires contractors to identify domestic sources of BABA-covered products and provide necessary verification documentation.

The certification form is a legal document that obligates respondents to verify the domestic origin of materials used in the project, with potential consequences for false statements including rejection or termination of the contract award. Contractors must attest to their understanding of the Build America, Buy America provisions and commit to providing appropriate documentation demonstrating compliance with current federal guidelines. The form includes spaces for the contractor's signature, contact information, and company details, serving as a formal commitment to sourcing American-made materials for the palm replacement project along McGregor Boulevard in Fort Myers, Florida.

The City of Fort Myers requires Contractors to use iron, steel, manufactured products, and construction materials that are produced in the United States in a manner that complies with the Build America, Buy America (BABA) requirement for federally funded projects that involve construction, alteration, maintenance, or repairs (Per the Infrastructure Investment and Jobs Act passed November 15, 2021). As a respondent on the project listed above, I certify that I have read, understand, and will comply with the “Build America, Buy America” provisions as required by federal law. Furthermore, I understand that BABA provisions apply to any and all portions of this project, including subcontracted portions, and I certify to the best of my knowledge and belief that I will identify domestic sources of BABA-covered products, provide verification documentation for BABA compliance, and when needed provide waiver documentation per current federal guidelines.

I understand that a false statement on this certification may be grounds for rejection or termination of any award and/or contract.
