About this file

This is Amendment 38 to Broad Agency Announcement BAA0001-22 (Emergent IV BAA), issued by the Defense Logistics Agency (DLA) Contracting Services Office in Philadelphia on April 30, 2026. The amendment incorporates FAR 52.222-90 "Addressing DEI Discrimination by Federal Contractors" (February 2026) into the solicitation effective immediately.

The newly incorporated clause prohibits contractors and subcontractors from engaging in racially discriminatory diversity, equity, and inclusion (DEI) activities, defined as disparate treatment based on race or ethnicity in recruitment, employment, contracting, program participation, or resource allocation. Contractors must provide all information and reports required by the Contracting Officer to demonstrate compliance, report any subcontractor violations to the Contracting Officer, and inform the Contracting Officer if a subcontractor challenges the clause's validity. Noncompliance may result in contract cancellation, termination, suspension, or declaration of ineligibility for future Government contracts. The clause requirement is material to the Government's payment decisions under 31 U.S.C. 3729(b)(4). Contractors must flow down the substance of this clause to subcontractors at any tier, including those for commercial products and services, except where performance occurs outside the United States. All other terms and conditions of BAA0001-22 remain unchanged.
