SECTION 1. GENERAL INFORMATION
1.1 MISSION and BACKGROUND INFORMATION. The mission of ATC is to plan, conduct, analyze, and report the results of developmental tests, production tests, and other tests to include providing test support services for authorized customers, within the Department of Defense (DoD) and outside DoD, including United States (US) government, foreign government and non-governmental organizations. ATC is one of the DoD's premier Major Range Test Facility Bases (MRTFB) supporting both military and commercial materiel developers by testing a broad spectrum of equipment throughout the life cycle, from concept through deployment. ATC is a tenant on Aberdeen Proving Ground (APG) and encompasses land and water totaling approximately 70,000 acres with an extensive inventory of facilities. ATC is organized by Directorate mission areas with approximately 1,500 personnel that consists of government civilians, military, and contractors.
1.2 SCOPE OF WORK. The Contractor shall provide data collection, technical writing, and support services, (except as specified herein as Government furnished) needed to meet ATC mission requirements. The Contractor shall support the following ATC Directorates: Command Staff, Automotive, Firepower, Plans and Operations, Survivability and Lethality, Test Technology and Warfighter, to include the divisions within the Directorates; as well as any individual project. The Contractor shall perform the following services: data service functions to include data collection and coordination, data compilation, data collection form development and management, data collection user and software administration, transcription/processing, review and reporting, test monitoring, technical writing and editorial review, on a wide variety of automotive, combat, electronic, general equipment, and ordnance materiel undergoing extensive testing; in addition, range scheduling support, word processing, data processing, and other support services. The work described herein shall be performed primarily at ATC, APG, Maryland; however, support may be required at locations other than APG to include Continental United States (CONUS) and Outside CONUS (OCONUS).
1.3 CONTRACT TYPE. This work shall be accomplished as a single award Indefinite Delivery Indefinite Quantity (ID/IQ) type contract, and specific requirements may be identified in the individual Task orders. The ID/IQ contract will have firm-fixed-price (FFP) and cost-plus-fixed-fee (CPFF) Contract Line Item Numbers (CLINs). The contract shall have a 5 year ordering period.
The price ceiling is the maximum that may be paid to the contractor for work actually performed but is not guaranteed.
SECTION 2. CONTRACTOR MANAGEMENT AND ADMINISTRATION.
2.1 CONTRACTOR MANAGEMENT. The Contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The Contractor shall maintain continuity between the support operations at ATC and the Contractor's corporate offices. The Contractor shall provide clearly defined policies and procedures for effective and responsive project management. The Contractor shall provide a management system that incorporates continuing quality and process improvement. The Contractor shall manage its workforce to ensure that excessive turnover does not interfere with mission requirements. The Contractor shall track and analyze hiring and termination trends, as well as the number of personnel employed by labor category and ATC cost center. The Contractor hiring, training, and cross-training plans shall be designed to quickly adapt to future needs and at a reasonable cost. Unless coordinated and agreed to by the Government, the Contractor shall ensure that all vacancies are filled within 30 calendar days of notification of the requirement. A list of these designated Government personnel will be provided by the Government 30 days after the start of the transition-in period. The Contractor shall provide an onsite Program Manager (PM) who shall be physically present during normal duty hours and perform overall management of the contract. The PM shall be the Contractor’s primary point of contact and shall have the authority to act or make decisions on behalf of the Contractor.
The Contractor shall designate an alternate who is authorized to make decisions in the absence of the PM. The PM shall provide the Contracting Officer’s Representative (COR) with the name and contact information for the alternate PM. The Contractor shall staff the total number of key personnel and other supervisory, management and/or administrative personnel they deem necessary to successfully manage the proposed level of effort workforce. Key Personnel for this contract are: PM, Data Collection Manager, Data Collection Leader (Data Collector VI), Technical Writing Leader (Technical Writer III) and Computer Operator Leader (Computer Operator V).
2.1.1 QUALIFICATIONS FOR KEY PERSONNEL. All Key Personnel are required to have an active SECRET clearance at the time of proposal.
2.1.1.1 Qualifications (minimum) for the PM are as follows: Shall have a Bachelor’s Degree in a scientific engineering or technology discipline. Shall possess seven
(7) years’ data collection experience in a test and evaluation environment. Shall also possess five (5) years’ experience supervising 50 or more people in a technical environment. Supervisor is defined as individual employed by an agency or company having authority to hire, direct, assign, promote, reward, transfer, furlough, layoff, recall, suspend discipline or remove employees, to adjust their grievances, or to effectively recommend such action, if the exercise of the authority is not merely routine or clerical in nature but requires the consistent exercise of independent judgment. All labor costs associated with the PM shall be included in the indirect rates. See Attachment 1 for Job Duties.
2.1.1.2 Qualifications (minimum) for the Data Collection Manager (DCM) are as follows:
Shall have a GPA of 2.5 or higher in each individual discipline of math and science and a GPA of 3.0 or higher in High School English or a GPA of 2.5 or higher in College English from either an accredited high school or university. (The minimum high school diploma will not be waived for an equivalency degree.) Shall have a Bachelor’s Degree in a scientific, engineering or technology discipline and five (5) years’ experience in performing RAM/ILS or similar type of data collection of military/nonmilitary equipment and associated maintenance concepts; or and Associates’ Degree in a technical area and seven
(7) years’ experience in a performing data collection of military/nonmilitary equipment and associated maintenance concepts; or nine (9) years’ experience in performing RAM/ILS or similar type of data collection of military/nonmilitary equipment and associated maintenance concepts. Shall have five (5) years of supervisory experience (see definition of supervisory under PM qualifications above) in a same or similar discipline. All labor costs associated with the DCM shall be included in the indirect rates. See Attachment 1 for Job Duties.
2.1.1.3 Qualifications (minimum) for the Data Collection VI Leader are as follows: Shall have a GPA of 2.5 or higher in each individual discipline of math and science and a GPA of 3.0 or higher in High School English or a GPA of 2.5 or higher in College English from either an accredited high school or university. (The minimum high school diploma will not be waived for an equivalency degree.) Shall have a Bachelor’s Degree in a scientific, engineering, or technology discipline and three (3) years’ experience in performing RAM/ILS or similar type of data collection of military/nonmilitary equipment and associated maintenance concepts; or an Associate’s Degree in a technical area and five
(5) years’ experience in performing data collection of military/non- military equipment and associated maintenance concepts; or seven (7) years’ experience in performing RAM/ILS or similar type of data collection of military/nonmilitary equipment and associated maintenance concepts. 2.1.1.4 Qualifications (minimum) for the Technical Writer III Leader are follows: Shall have a Bachelor’s Degree in one (1) of the following: English, Journalism, Communications or other scientific discipline and six (6) years of experience with technical writing for DOD research, development, test and evaluation (RDT&E) programs. Shall have five (5) years of leadership experience. See Attachment 1 for Job Duties.
2.1.1.5 Qualifications (minimum) for the Computer Operator V Leader are as follows:
Shall have a Bachelor’s Degree in Computer Studies or related field such as Information Technology, Information Management Systems, Computer Technology and six (6) years’ experience; or an Associate’s Degree in Computer Studies or related field such as such as Information Technology, Information Management Systems, Computer Technology and eight (8) years’ experience ; or 10 years’ experience using data entry software tools in a Windows environment and using industry standard reporting tools such as IBM Cognos, MS Access or Crystal Reports. (2) Shall have (5) years of leadership experience. See Attachment 1 for Job Duties.
2.1.1.6 Substitutions for Key Personnel. No substitutions in key personnel shall be made except in accordance with this paragraph. All proposed substitutions shall be submitted in writing 30 days (180 days if security clearance is to be obtained) in advance of the proposed substitutions to the COR. A complete resume for the proposed substitute shall be provided to the COR. The COR will review the resume to ensure contract requirements found in Section 2.1.1 are met. If, at time of award, the Contractor proposed an individual that had above minimum qualifications for any Key Personnel position, and a substitution is required after award, that substitution must meet the qualifications of the proposed key personnel position.
2.1.1.7 Support staff. In addition to key personnel the contractor shall provide admin/clerical staff to assist the PM and DCM manage the contract. The Contractor’s Management/Administrative support staff shall be efficient and economical, as well as sufficient to manage a contract of this magnitude. The cost of the Contractor’s Management/Administrative support staff shall not be directly billed as labor hours. Any allowable costs shall be included in the Contractor’s indirect charge rate.
2.2 CONTRACT ADMINISTRATION. The Contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The Contractor shall have a single point of contact between the Government and Contractor personnel assigned to support the contract and associated task orders. The Contractor shall have a process to coordinate and communicate issues and concerns relating to the performance and the administration of this contract to the COR. The Contractor shall assign work effort and maintain proper and accurate time keeping records of personnel assigned to work on the requirement.
2.2.1 TRANSITION PLANS (Phase-In and Phase-Out Periods). The Contractor shall develop procedures for Phasing-In Contractor performance to the level prescribed and within the time allowed under the terms of this PWS. The Contractor shall establish and implement a plan for an orderly Phase-Out of the Contractor operations at the completion of this contract. The Contractor's Phase-Out procedures shall not disrupt or adversely impact the day-to-day conduct of Government business.
2.2.1.1 PHASE-IN PERIOD. The Phase-In period will begin upon notification of contract award and will be no longer than 45 calendar days in duration.
2.2.1.2 PHASE-OUT PERIOD. The Phase-Out period shall run concurrently with the last 45 calendar days of the end of the contract.
2.2.2 START OF PERFORMANCE. Ten (10) calendar days prior to the end of the phase- in period, the Contractor shall submit to the Government in writing, the name and address, and telephone numbers, to include home and office, of the PM to perform work under this PWS. The Contractor shall ensure all personnel prominently display their ATC contractor identification (ID) badge at all times while inside the ATC compound work area.
In addition, the Contractor shall provide nametags with the company name and the word Contractor below it and it shall be worn at all times while in any work setting unless deemed a safety hazard.
2.2.3 NON-PERSONAL SERVICES. The Government will neither supervise employees nor control the method by which the Contractor performs the required tasks.
Under no circumstances will the Government assign tasks to, or prepare work schedules for, individual Contractor employees. It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the Contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the Contractor's responsibility to notify the KO immediately.
2.2.4 BUSINESS RELATIONS. The Contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The Contractor shall ensure timeliness, completeness, and quality of test services as well as problem identification and resolution. The Contractor shall provide timely identification of issues related to the contract or contract personnel, corrective action plans for contract related deficiencies, and contract proposal submittals. The Contractor is expected to establish a history of reasonable and cooperative behavior, effectively manage subcontractors, and award timely subcontracts.
The Contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all Contractor personnel.
2.2.5 MEETINGS. The PM, designated representative, and/or contractor personnel shall attend meetings and conferences when notified by the COR. The Government will notify the contractor in advance of the date, time, and place of each meeting or conference. The contractor shall provide meetings notes to the COR.
2.2.6 RESOURCE COORDINATION. Contractor shall access the government Range Control Database Scheduling System (RCDSS) on a daily basis to obtain resource requirements. The RCDSS will provide the contractor with the location of scheduled tests, applicable work breakdown structure (WBS), and the type of test to be conducted. Resource coordination meetings will be conducted as necessary to resolve resource shortages and/or coordinate any changes in resource requirements due to workload or test project needs.
2.2.7 FILES. The Contractor shall maintain files of documentation, records, and reports required under the terms of this contract in accordance AR 25-400-2, and shall retain the files for the entire performance period. All files shall be available for Government review and shall become the property of the Government at the completion of this contract.
2.2.8 FINANCIAL SYSTEMS. The Contractor shall establish and maintain a financial tracking system that is compatible with the current Government business and financial systems (e.g., General Fund Enterprise Business System (GFEBS); US Army Test and Evaluation Command (ATEC) Army Decision Support System (ADSS); Contractor Information Management System (CIMS) and will meet the reporting requirements. In the event the Government’s financial system changes during the life of the contract the Contractor’s system shall be compatible.
Government will provide notice to the Contractor when changes are anticipated.
2.2.9 CONTRACTOR FURNISHED PROPERTY AND SERVICES
2.2.9.1 PERSONAL PROTECTIVE EQUIPMENT/DEVICES (PPE). The
Contractor shall provide all protective clothing and equipment including, but not limited to, safety shoes (spark-proof, conductive, electrical hazard, or industrial), eye protection, hearing protection, hand protection, respiratory protection, head protection, and special uniforms. The Contractor shall ensure that personal protective clothing and equipment meet applicable National Institute for Occupational Safety and Health (NIOSH), American National Standard Institute (ANSI), Maryland Occupational Safety and Health (MOSH), and Occupational Safety and Health Administration (OSHA) Standards. The Contractor shall ensure employees use safety equipment, personal protective equipment, and devices as required by OSHA, applicable Standard Operating Procedures (SOP), and ATC Regulation 385-2. Failure to wear/use protective equipment may cause removal from the job site and/or seizure of non-compliant equipment and devices.
2.2.9.2 MAIL. The Contractor shall provide arrangements for incoming and outgoing mail on APG. ATC's Mailroom will only distribute internal official Government/contractor mail required in performance of this PWS.
2.2.9.3 INTERNAL CONTROLS. The Contractor shall safeguard Government resources in accordance with AR 11-2, and shall complete all required documentation including Department of the Army (DA) and ATC checklists.
2.2.9.4 INTERFACES. The COR is the primary Government liaison with the Contractor; however, the following personnel are authorized to interact with the Contractor’s managerial, designated representative, and supervisory personnel:
2.2.9.5 TECHNICAL MONITORS (TM). TMs will provide the Contractor’s working leaders a listing of projects requiring Contractor support, job order number, ADSS project number (if applicable), with an overview of the project requirements, if necessary.
2.2.9.6 OTHER INTERFACES. TMs, the test officer, and other technical experts (civilians, contractors, or soldiers) will provide daily on-site technical guidance, to include clarification and/or changes to the test plan, Test Operating Procedure (TOP)/ Internal TOP (ITOP), and/or Standing Operating Procedure (SOP). The test officer has the authority to make changes to test procedures and/or test set-ups in order to ensure that test data are properly and safely collected.
2.2.9.7 SAFETY. All personnel shall have the authority to stop operations for safety, health, security, or environmental reasons. The individual who stops an operation shall notify Contractor management and the COR, who will contact the Contractor regarding corrective actions that shall be taken before the operation resumes.
2.2.9.8 OTHER CONTRACTORS. The Government has other test support contracts and the Contractor shall work cooperatively with these service providers. The cooperation will occasionally require sharing of Government-furnished facilities and equipment. Additional direction regarding interface with other Contractors will be provided by the COR. The Contractor shall refer unresolved disputes with other Contractors to the COR within two (2) hours from the time the dispute occurs.
2.2.9.9 HOURS OF OPERATION. The Contractor shall be required to provide support during normal working hours, and may deviate from normal hours only by providing sufficiently trained and qualified personnel to satisfy the work schedule for each particular test at designated ATC site locations. ATC is currently operating under an alternative work schedule. Unless deviations are required to support mission requirements, the Contractor shall also work the alternative work schedule. In a two (2)-week pay period, the work schedule is eight (8) workdays of nine (9) hours each, one (1) workday of eight (8) hours, and every other Friday off (referred to as Regular Day Off {RDO}) as depicted below. To ensure compliance with Section 778.105 of Interpretative Bulletin, 29 Code of Federal Regulations (CFR) Part 778, the Contractor's base pay-week shall not exceed 40 hours; therefore, the start and end time of the pay-week shall be adjusted accordingly.
Notification to work outside normal hours of operation to support government requirements may be received with as little as one (1) hour advance notice. Employees shall not work overtime or on Federal holidays unless approved in advance by the COR.

Currently, normal hours of operation are 0700 - 1630 (including a 30-minute meal period) Monday through Thursday. Hours of operation for the First (1st) Friday in the Government's bi- weekly pay period are normally 0700 - 1530 (including a 30-minute meal period). Deviations from the normal hours of operation may be required to meet the requirements of the PWS. The Government has the option to temporarily or permanently change the hours and days of operation or require additional shifts. Normally, hours of operation for the second (2nd) and third (3rd) shifts are 1600 - 0030 and 1130 - 0800, respectively (including a 30-minute meal period), five (5) days a week, eight (8) hours a day. Some tasks may require less hours per day than a full day and/or less days per week than a full week.
The Contractor shall work outside of normal duty hours as necessary to meet the requirements of this contract. The Contractor shall adhere to curtailing operations and ATC closures. Curtailments and ATC closures include any time when ATC is in a non-operational status for events including but not limited to: emergency situations, power curtailments, furlough, Reduced Operations, ATC events, or planned training days.
Contractors are expected to adhere to the ATC curtailment or closure schedule, but some Contractor employees may be required to work during those periods and may be required to report to an alternate work site. Only personnel necessary for essential work will be scheduled for duty during these periods. The COR will notify the Contractor of the dates of curtailment and closure and of any Contractor employees required to work that day.
2.2.9.10 REDUCED OPERATIONS SCHEDULE. Based on workload, ATC may continue to observe a reduced operations schedule the week that falls between Christmas and New Year’s Day and the week that contains Independence Day. During these two (2) periods, ATC would only require Contractor support in situations where testing must continue. Based on workload and the need to provide employees a scheduled break, ATC may invoke additional reduced operation periods during the year.
2.2.9.11 INSTALLATION CLOSURES. Inclement weather conditions may force a temporary shutdown of APG. The Contractor shall call the Post Operation telephone (410- 278- SNOW) to get APG operation status and report to work accordingly. In addition, the local radio stations will announce any such delays or closures. If a period of Reduced Operations is declared, the Contractor shall comply accordingly.
2.2.9.12 FEDERAL HOLIDAYS. Federal Holidays in each calendar year are identified below. When such holidays fall on Saturday, the preceding Friday will be considered a holiday; however, if the preceding Friday is ATC's RDO under the alternative work schedule, the Thursday will be considered the holiday. When such holidays fall on a Sunday, the succeeding Monday is considered a holiday.

2.2.9.13 SUBCONTRACT MANAGEMENT. The Contractor shall be
responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime Contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. (Reference OCI Section.)
Contractors may add subcontractors to their team after notification to the COR. Cross teaming may or may not be permitted.
2.2.9.14 TELEWORK. The contractor shall provide a Telework Plan to address the following requirements due to COVID-19. PWS REQUIREMENTS Potentially Eligible for Telework: The PWS has a significant number of tasks that can be executed remotely, either in full or partial. Active tasks that may be executed via telework support the following PWS sections (*Primary work focus area):
Data Collection Support Computer Operators Support Technical Writing, Editing and Word Processing Support Range Scheduling Support
Administrative Support
Telework, for purposes of this contract, is defined as a work arrangement in which approved contractor personnel perform officially assigned duties at their place of residence or at an alternative duty location (which may be a residence). There will be no diminishment of contract performance as a result of approved telework under this contract.
THE TELEWORK PLAN shall include the following:
a. Identify the contract positions eligible for telework and submit to ATC COR for review and approval;
b. Explain how the performance requirements of those positions can successfully be performed in a telework status;
c. Identify Government Furnished Property (e.g. laptops, electronic devices) that will be used or required;
d. Detail any additional costs associated with the proposed telework (labor, ODCs, materials, etc.);
e. Any classified work assignments shall not be assigned or performed while an employee is in a telework status. Contractor personnel shall not begin telework prior to approval of the Telework Plan by Contracting Officer.
SECTION 3. PERSONNEL
3.1 PERSONNEL. The Contractor shall provide trained, qualified, certified, and licensed personnel to meet variable workload demands by ATC to ensure the requirements specified in this PWS are accomplished. The Contractor shall maintain records of training, qualifications, and applicable certification and/or licenses (CDRL-0001) as required and shall ensure that the employees remain fully qualified. The Contractor shall provide the above records on a semi-annual basis (or when requested) to the COR for evaluation in compliance with this PWS.
3.2 MINIMUM QUALIFICATIONS. All Contractor personnel shall be a U.S.
citizen and possess a high school diploma. All Contractor personnel must be able to speak, read, write, and understand English proficiently and shall have the ability to clearly and concisely communicate both orally and in writing. All contractor personnel hired to support this PWS shall be proficient in the use of computers and Microsoft Office Software.
Additional qualifications for individual labor categories are defined in the Job Qualifications Matrix (Attachment 1).
3.3 PHYSICAL FITNESS. The Contractor shall ensure that all personnel meet the physical requirements to perform the function(s) and task(s) to which they are assigned.
This may include: performing work in conditions of extreme heat and cold, high humidity, blowing sand and dust, working in confined spaces and at heights, and/or walking distances over unimproved terrain while wearing personal protective equipment.
The Contractor shall be responsible for the workload of any absent contract employee. If a contract employee is unable to perform their normal job duties, due to medical leave, deployment, etc. for longer than 30 days, the Contractor shall temporarily fill that position.
3.4 REMOTE TESTING. ATC is engaged in remote testing at sites throughout the CONUS as well as OCONUS. The Contractor shall be capable of supporting remote testing at locations other than ATC without drawing from personnel supporting the mission at ATC.
The Contractor shall have the capability to support the remote testing using the personnel resources in that area. Government oversight will be provided on all remote testing.
3.5 SECRET ENVIRONMENTS. Personnel may be required to operate in a SECRET environment abiding by all required security procedures and regulations.
3.6 TRAINING. The Contractor shall develop a structured technical training program to ensure contractor personnel are properly trained to accomplish the requirements of this PWS. This training does not relieve the contractor from ensuring that contractor personnel are qualified to perform their assigned tasks when they begin employment under this contract. The Contractor shall maintain records of all scheduled and completed training, which shall be available for periodic inspections by the Government. The Government will only reimburse the contractor for training in new technologies or unique skills that are required to perform the tasks of this PWS and not for employee advancement. All travel, training, and per diem requirements that are to be reimbursed to the contractor will be approved by the respective Director or authorized designee and CORwithin five (5) workdays prior to commencement of training/travel. In addition, copies of training certificates shall be available upon request by the COR as proof of training completion prior to reimbursement, as required. The Contractor shall also be required to provide training to other personnel (Government, non-Government) on the data collection and technical writing procedures and policies for various test locations, including ATC and remote test sites, as directed by the COR.
3.6.1 ATC TRAINING REQUIREMENTS. The Contractor shall meet ATC's annual mandated training requirements which will be provided by the Government. The ATC Mandatory Training Matrix (Attachment 6).
3.7 TRAVEL. Travel beyond the boundaries of APG may be necessary during the course of the contract for training or work to be accomplished at sites other than APG. The Contractor shall have personnel available and ready to travel on the required date. Per diem associated with this temporary duty (TDY) shall be charged in accordance with the travel provisions of Volume II of the Joint Travel Regulations (JTR) and FAR 31.205-46 and will be reimbursed under the ODC CLIN as discussed in in Section 4.13.3. All travel costs shall be invoiced every two (2) weeks.
3.7.1 TRAVEL TIME COMPENSATION. Exempt and non-exempt employees covered by the Fair Labor Standards Act (FLSA) are described in 5 CFR 551. Contractor employees who travel outside of their normal duty hours shall be paid wages for travel hours under certain circumstances as described in 5 CFR 551.422.
3.8 PRIVATELY OWNED VEHICLE (POV) USAGE. The Contractor shall be reimbursed at the current POV mileage rate, plus the cost of necessary parking fees, bridge, ferry, and other highway tolls incurred while in TDY status. When a POV is used for commuting to an alternate duty point located in or around the permanent duty station, the Contractor shall be entitled to reimbursement only for the distance that exceeds the employee’s normal commuting distance to the regular place of work and return.
Government-Owned, Contractor-Operated (GO-CO) vehicles shall be utilized in lieu of POVs whenever practical. POV use will be approved by the COR and all provisions of Joint Federal Travel Regulations regarding use of POVs on TDY shall be enforced.
3.9 MISSION SUPPORT CONTRACTS TIMEKEEPING SYSTEM. The
Contractor shall enable employees with the ability of entering data into a time capturing program that is Contractor owned and compatible with the government programs to meet the requirements of this PWS. During the Phase-In period, the Contractor shall complete a Request for Access (DD Form 2875 System Authorization Access Request) and a Non- Disclosure Statement to ATC Information System Security Manager for the designated employees. Subsequent training that may be required because of personnel changes shall be the responsibility of the Contractor. The Contractor shall maintain a daily record of regular, overtime, and shift hours worked, specifying the WBS, Internal Order, Cost Center, labor category, delivery order number, and contract number which will be provided electronically and uploaded daily to the ATC Contractor time tracking system. On the next workday after the work performance, the Contractor shall enter the aforementioned data into their system by 1300. If problems develop, in which the Contractor is unable to enter time into their system, the contactor shall notify the COR immediately in order to document the problem.
The Contractor is responsible to verify timekeeping data and make corrections as necessary.
SECTION 4. GOVERNMENT FURNISHED PROPERTY, SERVICES, MATERIALS
AND SUPPLIES.
4.1 GOVERNMENT-FURNISHED PROPERTY (GFP) AND SERVICES. The
Government will provide facilities, equipment, day to day office materials, office furniture, and services listed in this PWS. The Government will provide a list of GFP upon contract award. The Contractor shall assume or reject responsibility for the GFP. Rejection of GFP by the Contractor shall not relieve the contractor of responsibility in performance of this PWS. The Contractor shall not use property provided by the Government for any purpose other than the performance of this contract Exception being, the allowable personal and/or non-job related provisions as set forth in current Acceptable Computer Use Policies and as authorized by the Contracting Officer. The Government reserves the right to furnish parts, supplies, materials, and equipment when deemed to be in the best interest of the Government.
4.1.1 FACILITIES. The Government will provide the facilities listed in the Government Furnished Facilities (GFF) for performance at ATC. Only Contractor personnel supporting this contract can occupy ATC-provided facilities. If additional facilities are required and suitable facilities are unavailable to meet mission requirements, the Contractor shall request it through the COR. If the COR is unable to accommodate within 30 days, a written request for approval to lease facilities must be submitted to the Contracting Officer.
The Contracting Officer will determine the appropriateness of the request and, if approved, the additional space will be an allowable cost to the contract. The Government will provide basic furniture for all Government facilities except for the Contractor administrative and management personnel.
4.1.2 CONTRACTOR OCCUPIED GOVERNMENT FACILITIES
RESPONSIBILITIES. The Contractor will take adequate precautions to prevent fire hazards, odors, chemical spills, and safeguard Government Furnished Equipment (GFE) in contractor occupied government facilities. Routine daily workspace housekeeping of is the responsibility of the Contractor. The Government will provide preventive maintenance and repair to Government-owned facilities. Maintenance will be provided in accordance with Government maintenance schedules. The Contractor shall notify the COR, Government Building Custodian or the ATC Planning and Facilities Division if emergency maintenance is required. The occupants of buildings are responsible for the submission of service/work requests to have maintenance performed, via the ATCNet. No alterations to the facilities shall be made without specific written permission from the COR. In the case of alterations necessary for compliance with the OSHA, such permission shall not be unreasonably withheld.
4.1.3 KEYS. The Government will provide the contractor with a set of keys to facilities and equipment to be used in the performance of this PWS. Keys shall be controlled in accordance with ATC Regulation 190-1.
4.1.4 CUSTODIANS. The Contractor shall designate a primary and alternate building custodian, a building energy monitor, and a building fire marshal in solely contractor occupied faculties in order to comply with the requirements of applicable directives.
4.1.5 EQUIPMENT. The Government will provide computers and office copiers necessary to perform the contractor's duties. The Government shall furnish any ADPE/software for the data that is required to be entered into the Mission Support Contract (MSC) Timekeeping System and interface with the ATC Local Area Network (LAN) and E-mail system. Access to the LAN or any other automated information system requires that the employees' National Agency Check be completed.
The Contractor shall not modify, disassemble end items into component parts, or comingle end items or components parts of GFP with contractor owned property without the written permission of the COR.
4.1.6 MANAGEMENT OF GOVERNMENT-FURNISHED PROPERTY. The
Contractor shall manage GFP in accordance with Parts 45 and 52 .245-1 of the FAR. The Contractor shall be liable for shortages, loss, damages, or destruction of Government property in accordance with the property clauses in Section I of the contract and the Financial Liability Investigation. Within 15 calendar days of discovering the item is missing, damaged or destroyed, the Contractor shall appoint a point of contact who is responsible for initiating the Financial Liability Investigation. Contractors shall be required to identify the Government’s unit acquisition cost for all deliverable end items to which item unique identification applies. The Contractor shall establish and maintain an acceptable property management system. Failure to maintain an acceptable property management system, as defined in FAR 52.245-1(f), may result in disapproval of the system by the Contracting Officer and/or withholding of payments.
4.1.7 INITIAL EQUIPMENT INVENTORY. The Contractor shall develop a Property Control Plan (CDRL-002) IAW FAR Part 45 and FAR 52.245-1. The Property Control Plan shall be submitted 30 days after full contract performance and shall detail Contractor activities concerning GFP control in the following areas: Property Management, Acquisition, Receiving, Identification; Records; Movement; Storage; Physical Inventories;
Reports; Consumption; Utilization, Maintenance, Subcontractor Control, Disposition, and Contract Close- out as pertinent. Pursuant to the property clauses in this contract the Contractor is required to perform a joint Government/Contractor inspection of all GFP. This inspection is intended to establish a mutual agreement as to the condition of GFP provided to the Contractor for use in performance under this contract. In addition, the Contractor is required to conduct an automated annual inspection for all GFP. The annual GFP inspection shall be completed and annually submit a property master report 90 days prior to end of POP. Items of equipment missing or not in working order shall be recorded and the COR shall be notified in writing. The contractor and the Government representatives shall jointly determine the working order and condition of all equipment and document their findings. A copy of this inventory list shall be forwarded to the ATC Property Book Officer.
4.1.7.1 PROPERTY MANAGEMENT SYSTEM.
This property must be controlled, protected, preserved, accounted for and maintained in accordance with (IAW) the terms and conditions of the contract, AR 735-5 and the Contractor’s Property Management System. When the contract is completed or when the GFP is no longer required, the government must provide disposal instructions. Generally, the leased property may be returned to the leasing firm or purchased according to the terms and conditions of the lease agreement. Property leased by the contractor and then used in the performance of a contract is not included in the definition of “government property” even if the government pays the cost of the lease. The Contractor is bound by the terms and conditions of the lease that they have with the leasing firm.
4.1.8 SEMI-ANNUAL INVENTORIES. The Contractor shall conduct semi- annual inventories and complete required documentation in accordance with DoD 4161.2M. In addition to the requirements found in FAR 52.245-1, a copy of this inventory list shall be forwarded to the ATC Property Book Officer.
4.1.9 LAPTOPS. The Government will procure laptops as Government Furnished Property (GFP) and will issue to the contractor. Laptops will be Government property and will be identified on the contractor's Fiduciary Listing.
4.1.10 VEHICLE AND EQUIPMENT MAINTENANCE AND REPAIR. The
Government will provide maintenance due to fair wear and tear for Government-owned vehicles and equipment unless otherwise specified. The Contractor shall deliver items to the designated maintenance areas.
4.1.11 FINANCIAL LIABILITY INVESTIGATION OF PROPERTY LOSS
(FLIPL). The Government reserves the right to furnish parts, supplies, materials, and equipment when deemed to be in the best interest of the Government. The contractor is required to report all property loss/damage/destroyed per FAR 52.245-1 and DFARS 252.245-7002
Reporting Loss of Government Property. If determined liable, the Contractor shall be financially responsible for replacement costs of all lost, stolen or damaged property that is furnished upon contract award or during the duration of the contract.
4.1.12 FINAL INVENTORY. At the completion of the contract, the Contractor and a Government representative shall conduct a joint inventory. The Contractor shall be liable for loss or damage to GFP beyond fair wear and tear. A copy of this inventory list shall be forwarded to the ATC Property Book Officer.
4.1.13 VEHICLES AND EQUIPMENT AVAILABLE FOR CONTRACTOR USE.
