As referred to in paragraph (b) of FAR Clause 52.216-22, “Indefinite Quantity” of this contract, the contract minimum quantity is a total of $100,000.00 worth of orders to each awardee. The maximum quantity is the total “not to exceed” amount of $199,489,747.00 for the cumulative sum of all orders to be issued under this IDIQ contracting vehicle, including all option ordering periods, including all awardees. This maximum quantity set forth herein is the total available for all orders issued under this solicitation/contract to all awardees. The maximum quantity may only be exceeded with prior written approval of the Procuring Contracting Officer. The guaranteed minimum of this contract shall be applicable to the base ordering period only. Option periods thereafter will not have a guaranteed minimum.

TITLE: M61 CANISTER SPARES ACQUISITION
C.1. SCOPE. The Joint Project Manager - Protection (JPM-P) has a requirement to procure M61 Canisters for the Joint Service General Purpose Mask (JSGPM). It requires the delivery of fully functional and operational M61 canisters. This contract is for work efforts required to produce and improve M61 canisters for the JSGPM.
C.1.1 Background. The M61 canisters are spare parts for the JSGPM chemical biological respiratory protective mask that provides above-the-neck, head, ocular and respiratory protection against known chemical and biological agents, toxic industrial materials, and radioactive particles as well as emerging chemical, biological and radiological (CBR) threats.
C.1.2 Objective. The objective of this effort is to procure M61 canisters for the JSGPM and to establish a means to obtain spare M61 canisters for the JSGPM. This contract will not produce canisters to support delivery of mask systems from the current production line.
C.2. APPLICABLE DOCUMENTS. The documents specified in this section form a part of this PWS to the extent specified herein. In the event of conflict between the applicable documents and this PWS, the PWS shall take precedence. Nothing in this document supersedes applicable laws and regulations unless a specific exemption has been obtained. For the purposes of this PWS, “Required”, as it applies to this paragraph, means that the requirements contained in the directly cited document are contractually applicable to the extent specified. C.3. REQUIREMENTS. The contractor, as an independent contractor and not as an agent of the Government, shall furnish the necessary resources (except those specifically designated as Government furnished) to perform the following work:
C.3.1 Manufacturing. The contractor shall provide M61 Canisters that meet the requirements of Performance Specification “EA-C-2251B w/ Amendment 2 (Attachment 1)”.
C.3.1.1 The contractor shall deliver the M61 Canisters in level B packaging in accordance with paragraphs 3.2.4.1 and 3.2.4.2 below.
C.3.2 Packaging, Handling, Storage and Transportation. The contractor shall:
C.3.2.1 Commercial Packaging. Commercial packaging shall be used for delivery of data.
C.3.2.2 Military Packaging. Package M61 canisters in accordance with military packaging requirements, for canisters entering the military distribution system, as defined in MIL-STD-2073-1E.
C.3.2.2.1 Government-furnished packaging data may be used or the contractor may develop, validate through test, and document military packaging requirements for new or alternative packaging. This shall include preservation (unit packing), Level A and B packing (shipping container configuration), marking and unitization for those items entering the military distribution system, to include the: (a) development of acceptable materials, containers and processes for military packaging; (b) determination of methods of military preservation in accordance with MIL- STD-2073-1E; (c) selection of materials for packaging designs; and (d) preparation of packaging. Packaging validation tests shall be required for newly developed packaging requirements.
C.3.2.2.2 Mark in accordance with MIL-STD-129R Change 2.
C.3.2.3 The Special Packaging Instruction (SPI) P5-1-4172 Rev A is provided as Attachment 8 to Section J this contract. The contractor may package M61 canisters for the JSGPM in accordance with this SPI or provide packaging data describing the packaging requirements in accordance with the requirements of paragraph 3.2.4 below.
C.3.2.4 Packaging Design. If the contractor prefers not to use the Government-furnished SPI, the contractor shall:
C.3.2.4.1 Develop and document Level A and B packaging for the M61canisters as defined in MIL-STD-2073- 1E.
C.3.2.4.2 Determine the methods of preservation (unit packing), packing (shipping container configuration), unitization and marking procedures. (Definitions are provided in MIL-STD-2073-1E). Mark packaging in accordance with MIL-STD-129P.
C.3.2.4.3 Document packaging requirements as a SPI in accordance with (Contracting Data Reporting List) CDRL B001. Use packaging that protects the M61 canisters against direct exposure to extremes of climate, operational, transportation, and storage environments, without protection other than that provided by the packaging. (The Government shall have unlimited rights to packaging data.)
C.3.2.4.4 Fabricate packaging prototypes and test in accordance with MIL-STD-2073-1E and PRF EA-C-2251B w/ Amendment 2 for: (a) multiple handling during transportation and in-transit storage from point of origin to final user; (b) the transportability requirements of the system, including transport via any mode; (c) shock, vibration and static loading during shipment; (d) maintenance of the cleanliness of critical system components during shipment and storage, without causing any system performance degradation; (e) environmental exposure during shipment or during in transit operations where port and warehouse facilities are limited or nonexistent; (f) storage environmental requirements of the system, for a period of ten (10) years in climatic conditions ranging from -50 degrees F to +160 degrees F; (g) outdoor storage in all climatic conditions as defined in MIL-STD-810H, for a minimum of one (1) year.
C.3.2.4.5 Provide packaging capable of providing environmental protection to its contents for a period of twelve
(12) continuous weeks under the following conditions:

C.3.2.5 Wood Packaging. The contractor shall:
C.3.2.5.1 Heat Treatment Process. In accordance with ISPM 15, ensure that all wood used in packaging, including pallets, boxes, crates, load boards and pallet collars, produced entirely or in part of non-manufactured wood species, shall be constructed of wood heat treated to a minimum core temperature of 56 degrees Centigrade for at least 30 minutes.
C.3.2.5.2 Accreditation. Ensure that wood packaging materials are bark-free; certified and marked accordingly by an accredited agency recognized by American Lumber Standard Committee (ALSC) in accordance with their Non-manufactured Wood Packaging Policy and Non-manufactured Wood Packing Enforcement Regulations.
C.3.2.5.3 Identification of Materials. Ensure the wood displays an official International Standards for Phytosanitary Measures certification marking in an unobstructed area that will be readily visible to inspectors.
Box/pallet manufacturers and the manufacturer of wood used as inner packaging shall ensure traceability to the original source of heat treatment. Pallets shall have contrasting and clearly visible markings, applied to the stringer or block on diagonally opposite sides and ends of the pallet. Container markings shall be contrasting and clearly visible on two sides other than the top or bottom.
C.3.2.5.4 Dunnage. Comply with ISPM 15 in the use of all dunnage utilized for configuring and securing the load.
Dunnage shall be marked with an ALSC-approved dunnage stamp in a location that is readily visible.
C.3.2.5.5 Procurement of Materials from Non-U.S. Locations. Wood packaging materials procured outside of the U.S. shall meet the United Nations International Plant Protection Convention guidelines. The country’s designated national authority shall inspect and approve the wood packaging materials. That country’s authorized certifier’s certification markings shall be applied to the packaging materials in accordance with ISPM 15.
C.3.2.5.6 Palletization and Unitization. Palletize and unitize in accordance with ASME MH1 and MIL-STD-147E and as follows:
C.3.2.5.7 When shipments of identical items are packed in four or more shipping containers exceeding a total of 48 cubic feet per destination, except when the shipping containers are required to be skidded, or a quantity of four shipping containers per pallet exceeds the size or weight limitations for palletized loads.
C.3.2.5.8 When the total number of containers going to the same destination is 250 pounds or greater (excluding pallet), or a volume of 20 cubic feet or greater, palletize in accordance with guidance provided in MIL-STD-147E.
C.3.2.5.9 Export shipment loads shall be stable and shall not exceed the size and overseas limitations of Section 5 of MIL-STD-147E.
C.3.2.6 Regulated Hazardous Materials. The PRF EA-C-2251B w/ Amendment 2 specification requires that the new, unused, packaged M61 canisters to not contain hazardous materials. If however, under extraordinary circumstances, this requirement is waived by the Government, the contractor shall:
C.3.2.6.1 Identification. Ensure that the shipping configuration or container, as applicable, complies with Performance Oriented Packaging (POP), in accordance with Annex 1 Part 7 of the International Maritime Organization– International Maritime Dangerous Goods Code (IMO – IMDGC); Chapter 7 of the ICAO-TDGA; and 49 CFR, Transportation, Parts 107-178 if the end item is or contains a regulated hazardous material.
C.3.2.6.2 Environmental Safety and Occupational Health. The contractor shall comply with all U.S. federal safety, occupational health, and environmental laws and regulations and all local laws and regulations in the state, territory, or country where the M61 canisters will be manufactured.
C.3.3 Configuration Management. The contractor shall:
C.3.3.1 Configuration Control. Implement configuration control methods and procedures that maintain the integrity and history of the established baseline of the M61 canister using MIL-HDBK-61A or EIA 649. The contractor's configuration management (CM) process shall, as a minimum, consist of configuration identification, configuration control, configuration status accounting, and configuration audits. The contractor shall designate a CM representative to serve as a primary point of contact to the Government for all CM matters. The contractor shall notify the Government of all changes that affect the contractor's established CM process and the approved production baseline configuration.
C.3.3.1.1 Provide configuration status accounting in accordance with (IAW) CDRLB002.
C.3.3.2 Baseline Configuration and Changes. Request and obtain Government approval prior to implementing any change to the Government-approved Production Baseline configuration of the M61 canister, filters, packaging, components, or Performance Specification PRF EA-C-2251B w/ Amendment 2. Upon Government approval of changes to the Performance Specification the contractor shall incorporate changes and submit the revised Performance Specification IAW CDRL B003. The contractor shall submit change proposals as follows:
C.3.3.2.1 Engineering Change Proposals (ECP). Submit ECPs IAW CDRL B004 for all proposed changes to Performance Specification PRF EA-C-2251B w/ Amendment 2 or SPI P5-1-4172 Rev A that affect form, fit and function.
C.3.3.2.1.1 Notices of Revision (NORs). Submit NORs IAW CDRL B005.
C.3.3.2.2 Request for Deviation (RFD). Submit an RFD for temporary departure from the PRF EA-C-2251B w/ Amendment 2 Performance Specification requirements or the Government-approved production baseline IAW CDRL B006.
C.3.4 Logistics Management Information. When delivering canisters, nomenclature shall be applied to the unit pack, intermediate containers and the shipping containers. The lot number shall be bar coded on the unit pack, intermediate containers, and the shipping container. The contract number on the intermediate containers and the shipping container shall be the base contract number and delivery order (DO) number from which the parts were ordered.
C.3.5 Quality Assurance. The M61 canisters are critical life support items and hence require implementation of higher level contract quality requirements. The contractor shall:
C.3.5.1 Implement and maintain a quality system that achieves defect prevention, provides process control, and ensures quality control throughout all areas of contract performance IAW ISO 9001:2015. The contractor may use an existing quality system provided that it is acceptable to the Government. The contractor shall include applicable requirements of the higher-level quality standard(s) and the requirement to flow down such standards, as applicable, to lower-tier subcontracts.
C.3.5.2 Perform quality assurance for packaging in accordance with Appendix G of MIL-STD-2073-1E and the Quality Assurance section of the Government-furnished SPIs.
C.3.6 Testing.
C.3.6.1 First Article Testing (FAT). The contractor shall conduct FAT in accordance with Section I, FAR Clause 52.209-3 and Alternate II. The Government reserves the right to witness any contractor testing, and conduct independent testing of the contractor product. Under certain circumstances, FAT may be waived IAW 3.6.1.5 below.
C.3.6.1.1 The contractor shall submit a first article test report in accordance with CDRL A001, if required.
C.3.6.1.2 Testing that cannot be performed by a commercial testing laboratory because it involves actual chemical agents or simulants and/or unique equipment may be contracted with the Combat Capabilities Development Command
(CCDC) Chemical Biological Center test laboratories, Aberdeen Proving Ground, Maryland. It is the responsibility of the contractor to determine whether testing will be done by an independent Government laboratory or by the Contractor in its own facility. If by a Government laboratory, the contractor shall contact CCDC or another government facility to arrange for use of testing laboratories.
C.3.6.1.3 The first article shall be inspected and tested by the contractor for all requirements of PRF EA-C-2251B w/ Amendment 2 (Attachment 1).
C.3.6.1.4 The Contractor shall test 300 canister pairs as specified in this contract. At least 15 calendar days before the beginning of first article tests, the Contractor shall notify the Contracting Officer, in writing, of the time and location of the testing so that the Government may witness the tests.
C.3.6.1.5 At any time, during any ordering period of the base contract, the Contractor may request a FAT waiver from the Contracting Officer. A FAT waiver may only be granted by the Contracting Officer to a contractor in the event that the M61 canister has attained a Manufacturing Readiness Level (MRL) of 9 or higher per the MRL Deskbook, May 2015, Version 2.3 (ref. C.2.5.4).
C.3.6.2 In-Process Inspection. Government representatives will conduct in-process inspections during fabrication and assembly of the canister. The in-process inspections will ensure conformance of materials and workmanship to performance specification. All components will be available for inspections at the Contractor's and/or subcontractor's facility. Manufacturing and assembly procedures, quality system, inspection records, calibration procedures and certifications will be reviewed and evaluated if required during in-process inspections, and will be applicable to all mask systems and components. The Contractor will have available to the Government (upon request) all quality assurance testing/inspection reports and/or documentation.
C.3.6.3 Production Lot Conformance Testing (PLT). PLT shall be conducted IAW PRF EA-C-2251B w/ Amendment 2 (Attachment 1). Ten (10) canister pairs shall be selected by Government representatives for transport to an approved Government laboratory for testing.
C.3.6.4 Surveillance Testing. Ten (10) canister pairs from each production lot shall be selected by a Government representative, packaged, marked for shelf-life testing and shipped as specified in the contract.
C.3.6.5 Packaging Testing. The Government may conduct packaging testing in accordance with section 3.2 and Section I, if the packaging design changes.
C.3.7 Continuous Technology Insertion and Refreshment. The contractor shall:
C.3.7.1 Provide rapid and affordable technology insertion and refreshment of the M61 canisters. The contractor shall plan for and perform system improvement through upgrades of individual hardware with newer components only when specified via an individual Task Order Request (TOR). The contractor shall ensure the currency of technology is maintained (e.g., through Commercial Off-the-Shelf (COTS) or reusable Non-Developmental Item (NDI) insertion and other technology refresh strategies).
C.3.7.2 Conduct market research and perform analyses to identify candidate COTS and other reusable NDI, capable of meeting the M61 Canisters performance requirements. The COTS and NDI selection criteria shall, as a minimum, address the following: supportability requirements; safety; reliability; maintainability; fit factor requirements; compatibility; cost; quality assurance; market acceptability; obsolescence; and adequacy of available technical and intellectual property data and re-procurement data rights on the product.
C.3.7.2.1 Provide a report in accordance with CDRL A002 documenting the strategy for technology insertion and refreshment of the proposed component or components, results of research and analysis, the cost impact, and a schedule for implementation.
C.3.7.2.1.1 Include a justification for the use of proprietary or vendor-unique components and obtain written
Government approval prior to insertion or use of a component.
C.3.7.2.2 Process proposed technology insertions as Class I ECPs (IAW CDRL B004) in accordance with the criteria provided in Table 6-2, page 6-16 of MIL-HDBK-61A.
C.3.8 Program Management.
C.3.8.1 Meetings and Reviews. The contractor shall participate in quarterly, or as needed, meetings with the Government and its designees to advise of technical progress, any problems (or potential problems), and/or issues requiring immediate action. The contractor shall prepare meeting minutes and distribute IAW CDRL A003.
C.3.8.1.1 Start of Work Meeting. The contractor shall conduct a Start of Work Meeting within thirty (30) calendar days after contract award at the contractor’s production facility.
C.3.8.1.2 The contractor shall conduct semi-annual Program Reviews (PR) at the contractor’s facility for a duration of one (1) day. The contractor shall discuss progress towards meeting the requirements of this contract.
C.3.8.2 Status Reporting.
C.3.8.2.1 The contractor shall provide production status reports IAW CDRL A004.
C.4. TRAVEL. The contractor is expected to travel within the continental United States, as necessary, to successfully complete the requirements discussed in Section 3 above. This includes travel to Government installations to attend progress meetings and conduct program reviews. The Contractor shall be authorized travel expenses consistent with the substantive provisions of the Joint Travel Regulation and the limitation of funds specified in the DO. All travel requires Government approval/authorization and notification to the Contracting Officer’s Representative (COR).
C.5. ITEMS AND DATA TO BE DELIVERED.
C.5.1 Items to be Delivered.
C.5.1.1 M61 Canister Pairs. The contractor shall provide all necessary materials, supplies and manufacturing services to produce and deliver fully functional M61 canister pairs IAW paragraph 3.0 of this PWS and PRF EA-C- 2251B w/ AMENDMENT 2 (Attachment 1 to Section J).
C.5.1.2 Continuing Technology Refreshment. The contractor shall provide rapid and affordable technology insertion and refreshment of the M61 canister IAW paragraph C.3 and the sample task.
C.5.2 Data to be Delivered. The Contractor shall deliver all data IAW the attached CDRL, DD Form(s) 1423.
C.6. GOVERNMENT FURNISHED PROPERTY AND INFORMATION.
C.6.1 Government Furnished Property (GFP). The planned GFP, for this requirement, will be the items specified in paragraph 3.7 of the performance specification. The M50 face piece contains the unique attachment mechanism (filter mount) allowing the contractor to conduct a 100% interface test using the manufactured canister to ensure the proper fit. Since there are currently two (2) generations of the filter mount in circulation, the Government plans on providing M50 face pieces with each version of the mount. DCMA will administer the GFP. GFP will be monitored in accordance with procedures listed in (Federal Acquisition Regulation (FAR) 52.245-1 and Defense Federal Acquisition Regulation Supplement (DFARS) 252.245-7001/7002/7003/7004). A Property Management Plan (PMP) will be created for the GFP under this effort.
C.6.2 Government Furnished Information (GFI). The performance specification and the SPI for the M61 canister are planned to be provided to contractors awarded a contract for this effort. Additionally, the performance specification for the M61 canister may be updated as part of the performance of a CTR TOR.
C.7. SAFETY AND HEALTH INFORMATION. The award shall comply with the safety and health requirements. Refer to Section H of the base contract.
C.8. SECURITY REQUIREMENTS.
C.8.1 This contract is unclassified and does not contain security requirements or a Contract Security Classification Specification, DD Form 254. However, the Government may require Operational Security (OPSEC) measures (when applicable) to protect sensitive unclassified contract information. If access to unclassified sensitive information (For Official Use Only - FOUO) is authorized, the contractor may access only the information related to the subject matter of this contract.
C.8.2 The contractor shall not use foreign nationals on this contract unless approved by the contracting officer.
When requesting approval, the contractor shall furnish the full name, date of birth, place of birth, citizenship, registration number, type of visa, port of entry, and type of position in which employee will be utilized. Previously approved foreign nationals must be re-approved if the nature of their work under this contract differs from that performed under the prior year’s contract. The contractor shall submit a copy of the work visa or green card with an abbreviated Curriculum Vitae and a justification to the Contract Specialist for review by the Security Office and subsequent approval by the Contracting Officer.
C.8.2.1 Should the Government determine that the technology has developed to a point where the information warrants protection, a DD Form 254 and an approved classification guide will be issued.
C.8.2.2 This contract references or contains documentation which contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751 et seq.) or the Export Administration Act of 1979, as amended (Title 50, U.S.C., App 2401 et seq.). Violations of these export laws are subject to severe criminal penalties.
The contractor shall disseminate in accordance with the provisions of Department of Defense Directive (DoDD)
5230.25. The Department of Defense has authorized limited distribution to U.S. Government agencies and private individuals or enterprises eligible to obtain export-controlled technical data in accordance with DoDD 5230.25, determination made 7 Oct 2007.
C.8.2.3 Safeguarding Covered Defense Information and Cyber Incident Reporting.
C.8.2.3.1 The contractor shall comply with the security requirements of the National Institute of Standards and Technology (NIST) SP 800-171 Rev.1, “Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations” and the DFARS 252.204-7012, “Safeguarding Covered Defense Information and Cyber Reporting”.
C.8.2.3.2 Cyber Reporting. Upon the detection or discovery of any unauthorized access, denial of service, or compromise of a contractor's classified or unclassified network, information system or data contained thereon, the contractor shall report in writing within 24 hours to the Chemical, Biological, Radiological, Nuclear (CBRN) Information Resource Center (24 hour hotline): Commercial (309) 782-7349, Toll Free: 1 (800) 831-4408, Email:

C.8.2.4 Contractors Not Requiring a Common Access Card (CAC), but Requiring Access to a DoD Facility or Installation. The Contractor and all associated Sub-Contractor employees shall comply with adjudication standards and processes using the National Crime Information Center Interstate Identification Index (NCICIII) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, Outside Continental United States (OCONUS) locations, IAW status of forces agreements and other theater regulations.

PACKAGING
D.1 PACKAGING OF DATA
D.1.1 All data to be delivered by the Contractor under this contract, except for data transmitted by electronic media, shall be packaged for shipment IAW standard commercial practices that will afford protection against deterioration and physical damage for safe delivery to destination.
D.2 PACKAGING OF HARDWARE
D.2.1 Packaging shall be IAW paragraphs C.3.2 of the Performance Work Statement, Section C, as applicable.
D.2.2 Commercial Packaging shall not be used for hardware.
