(End of provision)

52.212-2 Evaluation-Commercial Items (November 2021) – Addendum

(a) The Government will award a contract resulting from this solicitation to the responsible vendor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. A Best value – Tradeoff evaluation approach allows for the consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror. The following factors shall be used to evaluate offers:

1. Technical Approach

2. Past Performance

3. Price/Cost

*Technical Approach is more important than Past Performance. Past Performance is more important than Price/Cost. Technical Approach and Past Performance, when combined, are more important than Price/Cost. Offerors are cautioned that any award may not necessarily be made to the lowest price offered and that to receive consideration for award, a rating of no less than “Acceptable” must be achieved for the technical approach evaluation factor. The Government intends to award without discussions.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Evaluation criteria are provided below:

(a) This requirement, when awarded, will follow and incorporate the applicable FAR and other applicable Federal, State, and Local Statutes, Codes, or Regulations.

mailto:harrison@udall.gov mailto:janes@udall.gov mailto:janes@udall.gov

(b) The Government intends to evaluate and award without discussions; however, if deemed necessary, notification will be provided electronically.

(c) The Government will award a Time & Materials contract. The price/cost quote will be evaluated for fair and reasonableness, and balance.

(d) The quote shall be subject to evaluation by a team of Government personnel.

1. Technical Evaluation Approach. The evaluation process will consider the following.

a. Understanding of the Task. The quote will be evaluated to determine the extent to which the Offeror’s methods and approach in meeting the requirements provide the Government with a high level of confidence of successful completion, and if the approach proposed is feasible and will result in the RFP requirements being fully met or exceeded. The quote will be evaluated on the extent to which the quote indicates that the Offeror clearly understands the collaborative nature of the project and the extent that personnel assigned possess enough substantive knowledge about the endangered and threatened species and their Missouri River habitat needs to follow highly technical discussions, ask effective questions. In addition, the quote will be evaluated on the extent to which the approach demonstrates a clear understanding of the importance of communicating information in a manner that reinforces trust in the offeror’s ability to be a science neutral in a particular topic.

Finally, the quote will be evaluated on the extent to which the approach demonstrates how and whether the offeror will meet the required Contractor expertise outlined in Section 12.0 of the PWS.

2. Past Performance Evaluation Approach. The Past Performance evaluation will assess the past performance information collected and determine the quality of the offeror's performance, general trends, and usefulness of the information.

a. The Government will conduct a past performance evaluation based on the quality, relevancy, and recency of the Offeror’s past performance, as well as that of its major subcontractors, as it relates to the probability of successful accomplishment of the required effort. For purposes of this contract, experience is defined as recent if it was performed in the last two years. These requirements include all aspects of schedule and performance, including the Offeror’s record of: 1) understanding the collaborative nature of like projects and the extent that personnel assigned possessed enough substantive knowledge about the project to have asked effective questions, and articulate relevant interests; 2) adherence to contract schedules, including the administrative aspects of the project; 3) commitment to customer satisfaction; and 4) business-like concern for the interest of its customers.

b. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. A negative finding under any element may result in an overall limited or no confidence rating. Therefore, Offerors are reminded to include all relevant past efforts, including demonstrated corrective actions, in their quote.

c. An Offeror with no relevant performance history will receive a neutral performance confidence rating having no positive or negative significance. An Offeror with such a neutral rating may, however, be considered less favorably than an Offeror with a favorable performance history. Conversely, an Offeror with a neutral rating may be considered more favorably than an Offeror with a poor performance history.

d. Offerors are cautioned that in conducting the past performance evaluation, the Government may use data provided in the Offeror’s quote, and data obtained from other sources. Since the Government may not necessarily contact all sources provided by the Offerors, it is incumbent upon the Offeror to explain the relevance of the source information provided in the quote. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proving good past performance rests with the Offerors.

3. Price Evaluation Approach. The Government will evaluate offers for award purposes by adding the total of all CLIN/SLIN line items, including all options (the option year and individual task options within each performance period). The government will divide the final option year (Option year 4) by 2 to determine a price, in accordance with 52.217-8, and will add this amount to the overall proposed total value for a total estimated value. This will be used for evaluation purposes only and will not be added to the total awarded contract value. In accordance with FAR 16.601(c)(2) and 52.216-31, the fixed hourly rates proposed within the quote and accepted by the Government will be incorporated into the resulting contract as fixed hourly rates that include wages, overhead, general and administrative expenses, and profit for each category of labor. Quotes will be evaluated in accordance with FAR 15.404-1, where applicable, to evaluate whether the quote is fair, reasonable, and balanced. Price quotes will be compared to the Government Cost Estimate and competing quotes.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.
