While it is believed that borings accurately indicate subsurface conditions for boring locations on the date taken, the Government assumes no responsibility for actual conditions which may be encountered in execution of Contract. Should the Contractor rely, for any purpose, upon the accuracy or completeness of said borings, or log thereof, he does so at his own risk. The geotechnical report, including soil boring drilling

1.1 Soil Classification

The soil was visually classified in the field according to the "Unified Soil Classification System" and described utilizing ASTM D 2488 Standard Practice for Description and Identification of Soils (Visual-Manual Procedure). While it is believed that borings accurately indicate subsurface conditions for boring locations on the date taken, the Government assumes no responsibility for actual conditions which may be encountered in execution of Contract. Should the Contractor rely, for any purpose, upon the accuracy or completeness of soil borings, or boring logs thereof, he does so at his own risk. The geotechnical report, including soil boring drilling logs and data are provided with the design package.

All samples contained at the end of this SECTION were obtained on various dates as designated on the respective boring. Geotechnical analysis data is available for review at Norfolk District, 803 Front Street, Norfolk, VA 23510 (Attention: Jane Bolton, telephone 757-201-7123).

1.2 Sampling Method

Cone Penetration Testing (CPT) was completed at three locations proximate to the proposed structure in accordance with ASTM D 5778. Cone resistance, friction resistance and pore pressure, among other data sets, were recorded at approximate five centimeter intervals. CPT data is available for review in the Geotechnical report located in ATTACHMENT 1:

Geotechnical Report. Additionally, soil samples were collected at depths ranging from about three to five below the mudline at two locations using a vibracore sampler until the sampler could not be advanced due to encountering denser soils. The CPT rig was also used to direct push tube samples to recover soils for visual classification and laboratory testing at one location to a depth of about 30 feet.

1.3 Soil Consistency Determination

Estimated consistencies (med. stiff, soft, etc.) are from Terzaghi & Peck "Soil Mechanics in Engineering Practice".

1.4 Boring Elevations and Locations

All boring elevations and locations are approximated. Boring logs are shown at the end of this section.

1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Qualifications of Surveyor; G

Provide qualifications of the licensed surveyor(s) for hydrographic/bathymetric surveying prior to commencing any survey work.

Pre-Construction Survey; G The Pre-construction survey data shall be submitted within five

(5) business days after completion of the surveys in that area.

Data shall be submitted in the format specified herein.

Site Access Plan; G

SD-11 Closeout Submittals

Post Grading/Pre-Planting Survey; G

The Post Grading/Pre-Planting Survey shall be completed and submitted for Government review no later than 7 calendar days completion of a graded area to be planted.

Post-Construction Survey; G

The Post-Construction survey shall be completed and submitted for Government review no later than 30 calendar days after acceptance of final project.

1.3 WORK COVERED BY CONTRACT DOCUMENTS

1.3.1 Project Description

The purpose of this project is to protect the Colonial National Historical Parkway by stabilizing and rehabiliting segments of the York River banks and shoreline (shown in the contract drawings) that has severely eroded.

The work includes performing pre and post construction surveys of the project area, clearing and grubbing, the repositioning of existing stone, the placement of riprap stone to construct rock sills and revetment structures, the placement of geotextile fabric, excavation and filling earthwork, steep slope stabilization with vegetated wall geotextile bags and steel sheet pile, planting on the geotextile bag slopes, wetland fill material placement, wetland planting, and any incidental work related to the constuction of this project. The work includes the following structures and areas as shown on the plans:

1. New Rock Sill Section 1 Includes rock sill construction and wetland fill and planting.

2. Rock Sill Section 2 Rehabilitation

3. New Rock Sill Section 3 Includes rock sill construction and wetland fill and planting.

4. Rock Sill Section 4 Rehabilitation

5. New Rock Sill Section 5 Includes rock sill construction and wetland fill and planting.

6. Rock Sill Section 6 Rehabilitation

7. Existing Breakwater Rehabilitation Includes rock sill construction and wetland fill and planting.

8. New Breakwater Construction

1.3.2 Location

The work shall be located at the Colonial National Historical Park that is operated by the National Park Service, as indicated on the contract drawings.

1.4 EXISTING WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.

1.5 SPECIAL WORK REQUIREMENTS

1.5.1 Anadromous Fish Use Area

The following time-of-year restriction for protection of the Anadromous Fish Use Area will be adhered to for all instream work on the York River.

15 February through 15 June.

1.5.2 Use of Turbidity Curtains

Type II (VDOT SPEC) turbidity curtains shall be properly secured at all times during the placement of fill and rock material.

1.5.3 Personnel Restrictions

Personnel are limited to the immediate site areas and shall not enter buildings or facilities not involved in the work. All employees of the Contractor will be subject to all rules and regulations of the Facility which pertain to personnel. The Contractor's plans for restricting personnel access to the project site shall be submitted for approval as a part of the Safety Plan (Accident Prevention Plan).

1.5.4 Site Access Plan

The Contractor shall have access to the site via water and via Colonial National Historical Parkway though access via the parkway is restricted (see Paragraph 1.5.6 and 1.5.7). Prior to construction, the Contractor shall submit a Site Access Plan detailing planned transit routes of all equipment to the construction areas. The Site Access Plan must include at least one map showing the transit routes to the storage and staging areas for the installation of the structures. The plan must be approved by the Contracting Officer prior to construction activities.

1.5.5 Transportation Facilities

The Facility is served by an all weather surfaced road network. Road(s) within the Facility proposed to be used by the Contractor shall be subjected to prior approval of the Facility authorities and such roads, if used, shall be maintained throughout construction and shall be restored to as good condition as existed prior to their use. . All work using heavy equipment and material and all stone shall be delivered using water based barges to the project site. The contractor may construct haul roads along the shoreline to distribute equipment and materials along the construction area. Use of haul roads must be included in the Site Access Plan and shall be approved by the COR and NPS prior to construction.All costs for

SECTION 01 11 00 Page 4 maintenance, repair, removal and restoration shall be borne by the Contractor.

1.5.6 Use of Roads

The Contractor shall keep all roads clear of all obstructions and free of mud and other foreign materials resulting from operations. The Contractor's vehicles shall at no time follow a vehicle closer than 50 feet, and all vehicles shall pull off the road and come to a complete stop when meeting emergency vehicles and vehicles with flashing lights. If the parkway shoulder is too soft or has a shoulder drop off which makes it unsafe for a vehicle to pull off the road, the vehicle may pull to the side as far as possible without leaving the road as long as temporary traffic controls are safely implemented. Facility speed limits and traffic controls will be observed. The maximum weight limit for the parkway is 10 tons.

1.5.7 Road Restrictions

Facility roads shall be restricted to passenger vehicles only. The movement of all vehicles within the Facility shall be confined to the roads designated and shall comply with traffic regulations within the Facility. Other roads may be used only with the approval of the CO.

1.5.8 Cleated Vehicles

Cleated vehicles shall not be moved over surface roads.

1.6 LOCATION OF UNDERGROUND FACILITIES

Contractor is responsible for obtaining all digging permits, including associated locating and marking services, in accordance with facility and local requirements, at no additional cost to the Government.

1.6.1 Notification Prior to Excavation

Notify the Contracting Officer at least 15 days prior to starting excavation work.

1.7 LAYOUT OF WORK AND SURVEYS

1.7.1 General

The Contractor shall be responsible for the expense and layout of all work. The Contractor's work methods may require physical markings to be placed for easement control points. All range markers or that otherwise are required to accomplish the work, shall be placed in the field and marked by a licensed Professional Engineer or Surveyor currently licensed in the Commonwealth of Virginia. The licensed Professional Engineer or Surveyor shall have Topographic and Hydrographic Surveying Experience. All hydrographic surveying shall be in accordance with EM 1110-2-1003 and all topographic surveying shall be in accordance with EM 1110-1-1005 . The horizontal plane of reference for the surveys shall be the Virginia State Plane Coordinate System (South Zone), in U.S. Survey Feet, North American Datum of 1983 (NAD 83).

1.7.2 Qualifications of Surveyor

All surveys shall be performed by an independent survey company. All

SECTION 01 11 00 Page 5 topographic and hydrographic surveys shall be performed under the direction and supervision of a Professional Licensed Surveyor with a minimum of 5 years current experience in surveying beach profiles. Surveyors shall be Virginia licensed surveyors. The Contractor shall submit Surveying Procedures and Equipment for topographic surveys, hydrographic surveys and tidal monitoring, shall be submitted as specified in this section for review and approved by the Government Survey Point of Contact prior to the start of any type of surveying work.

1.7.3 Datums and Bench Marks

The plane of reference shall be Mean Low Water (MLW), National Tidal Datum Epoch (NTDE) of 1983-2001, as established by National Ocean Service (NOS), and identified on the drawings and referenced in these specifications. At the construction site, tidal values will be determined using tidal zoning values developed by NOS. Diagrams of Datums are also shown on the contract drawings.

It shall be the responsibility of the Contractor to obtain tide level measurements and predictions as required to conduct his work operations for the duration of the work.

1.7.4 Electronic Survey And Positioning Systems

All plant utilized for stone placement at the construction area(s) shall be equipped with electronic hardware and software capable of providing real time horizontal positioning of USCG DGPS NAV BEACON (+/- 1 to 3 meters) quality or better, on a computer display real time during material placement operations. Software package such as HYPACK or equivalent are capable of accomplishing these requirements. The system should have the capability displaying a shape file of leases and or any structure that the equipment needs to avoid. It should be able to capture the accurate tracking of the equipment and playback in 60 second intervals. The tracking positions must be recorded on a disk every 15 minutes and submitted to the contracting officer on a weekly basis. All electronic survey and plant positioning equipment, and the work accomplished with the use of the system must render the results in the same datum coordinate system as indicated on the drawing.

All work accomplished with the use of the systems shall be reviewed and certified as accurate by the Contracting Quality Control manager. This signed certification shall be submitted as part of the Daily report of Operations in accordance with the requirements of SECTION 01 45 00 CONTRACTOR QUALITY CONTROL to assure that all work being performed with the use of the equipment and system meets or exceeds the contract requirement.

1.7.5 Pre-Construction Survey

Conditions existing during the preparation of this contract may not be an accurate representation of the site area conditions existing at the commencement of work operations. Consequently, the Contractor shall perform a pre-construction survey of the entire project area to confirm site conditions.

The pre-construction condition surveys shall be completed and submitted for Government review not later than thirty (30) calendar days after the receipt by the Contractor of the notice to proceed.

The Pre-Construction Survey shall include the items detailed in the following paragraphs.

1.7.5.1 Existing ground and rock conditions: Bathymetric and Topographic Survey

Survey cross-sections shall be taken on parallel profile lines (ranges) spaced at a maximum of 100 feet intervals where rock revetments are to be constructed and spaced at a maximum of 25 feet intervals where rock sills and wetland fill areas are located. Survey lines shall be spaced at a maximum of 25 ft where steel sheetpile is to be placed as well. Survey lines shall extend at minimum 200 feet seaward from the existing shoreline (Mean High Water line) or 100 ft seaward from the placement location of offshore structures to 20 feet past the Construction Baseline shown on the drawings into the pavement of Colonial National Historical Parkway.

Elevations along the cross-sections shall be taken at a maximum of 10 foot intervals, with additional elevations taken at breaks in grade and as necessary to describe all hydrographic and topographic features. The Contractor shall ensure the pre-constuction survey accurately captures the location of all existing rock structures. The Contractor is responsible for ensuring the pre-construction surveys capture enough topography and bathymatry of the project site to for safe project access.

Furnish digital copies of field notes, computations, raw and edited survey data (in HYPACK and ASCII x, y, z format) and associated metadata files for all surveys conducted. All original field notes, computations, and all other records shall be stamped and signed by the independent professional engineer or surveyor as specified and furnished promptly to the Contracting Officer.

AutoCAD drawings and PDFs shall also be furnished which shall include planview drawings of the survey contours (MLW, MHW, and 2 ft increments), overlayed on the proposed rock and sheet pile alignments shown on the plans and plotted cross sections for each cross section survey taken shown on the plans. The COR may request additional cross sections. Additionally, the contractor may include proposed site access, stockpiling, and staging areas (if they are different than those shown on the project drawings) on the planviews for approval).

1.7.5.2 Existing pipeline conditions

The pre-constuction condition survey shall include the inverts and locations of all existing pipeline locations within the project area Limits of Disturbance as shown on the plans. These variables shall be submitted on an AutoCAD Drawing with the pipe locations clearly shown in plan view

1.7.5.3 Exising tree survey

Trees in the project area Limits of Disturbance (as shown on the plans) 18 inches or greater in diameter shall be flagged in the field. A different colored flagging shall be utilized for those trees to remain and those required for removal during construction. The COR and National Park Service (NPS) shall be notified prior to the pre construction tree survey as they may send a representative to participate in the survey. The trees necessary for removal shall be discussed and approved by the COR and NPS prior to construction.

1.7.6 Post-Construction Survey

The post construction survey shall be completed and submitted for Government review no later than thirty (30) calendar days after acceptance of final project and comply with the same requirements stated for the pre-construction survey.

1.7.7 Post Grading/Pre-Planting Survey

The Contractor shall conduct a post grading/pre-planting survey after grading and filling wetland areas to confirm that target elevations are met for planting. The Contractor shall be allowed to survey wetland areas as sections shown on the plans are finished. Entire wetland sections shall be completed prior to Post Grading/Pre-Planting Surveys, no partial sections shall be accepted.

The pre-planting survey shall consist of maximum 25-ft interval cross-sectional profiles and survey spot checks throughout the graded wetland area. All cross-sectional and spot check point elevations must meet the appropriate elevation requirements as specified on the contract drawings and in these specifications. The Contracting Officer shall direct the locations of the survey spot checks. The Contractor shall re-grade all areas which do not meet the contract specified elevations at no cost to the Government.No wetland planting shall occur until after acceptance of the Post Grading/Pre-Planting Survey of that section.

The Contractor shall conduct the Post Grading/Pre-Planting Survey, with accuracies equal to contract payment surveys as specified in the Project Classification Requirements as outlined in U.S. Army Corps of Engineers Hydrographic Survey Manual EM 1110-2-1003 and Topographic Survey Manual

EM 1110-1-1005 .

The Contractor shall furnish the Contracting Officer plan view maps and cross-sectional profile maps and data of the construction area(s) and a maximum 50-feet interval at the construction area(s) in a manner to depict the physical boundaries and contours of the sites. Cross-sectional profiles will depict pre and post survey tracks on each profile.

All survey data and mapping shall be compiled and certified by the independent professional engineer or surveyor as specified and submitted as a completed Survey. The horizontal plane of reference for the surveys shall be the Virginia State Plane Coordinate System (South Zone), in U.S.

Survey Feet, North American Datum of 1983 (NAD 83).

1.7.8 Placement Records and Survey Data

The Contractor shall also refer to Section 01 78 00 for direction of final As-Built drawings. All original field notes, computations, and other records for the purpose of the layout of surveys and determining material placed by the Contractor shall be recorded in duplicating field books, the original pages of which shall be stamped and signed by the licensed surveyor as specified and furnished promptly to the Contracting Officer at

The Contractor shall furnish the Contracting Officer the profile data compiled and certified by the licensed surveyor as specified for each respective survey on a computer disk. The survey data shall be recorded digitally on CD-ROM in ASCII x,y,z format. The data shall be submitted to the Government in the following files:

a. ASCII files compatible with the Interactive Survey Reduction Program (ISRP), 2.8 format using distance offset from the baseline (x) and elevation (z).

b. ASCII files having a descriptive header for each profile line followed by three columns: Easting (x), Northing (y) and Elevation (z).

c. Plotted cross section drawings in AutoCAD 2017 or later format and AutoCAD files for each cross section survey taken. Each drawn cross section shall show the station that it was taken from.

d. The Government reserves the right to change and revise requirements at the Preconstruction Conference to the survey data formats as described above.

OPERATIONS - Requirements for Transfer

1.2 SUBMITTALS

The Contractor shall make submittals for the following listed reports and certificates as required by the specifications. The Contracting Officer may request submittals in addition to those specified when deemed necessary to adequately describe the work. Units of weights and measures used on all submittals shall be the same as those used in the contract drawings. Each submittal shall be complete and in sufficient detail to allow ready determination of compliance with contract requirements. Prior to submittal, all items shall be checked and approved by the Contractor's Quality Control (CQC) representative and each item shall be stamped, signed, and dated by the CQC representative indicating action taken in accordance with SECTION 01 45 00. Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section

1.3 SPECIAL SCHEDULING REQUIREMENTS

a. The Parkway shall remain in operation during the entire construction period. The Contractor shall conduct his operations so as to cause the least possible interference with normal Parkway traffic.

b. Permission to interrupt any Activity roads, railroads, and/or utility service shall be requested in writing a minimum of 15 calendar days

1.4 SPECIAL WORK REQUIREMENTS

1.4.1 Notification

The work is to be performed along a segment of shoreline adjacent to York River at the Colonial National Historical Park. The contractor shall Notify U.S. Army Corps of Engineers, Norfolk District 10 days before the commencement of work. The Contractor shall perform the scheduled project construction and all other associated work in accordance with all requirements of the Environmental Permits, as indicated and as specified herein.

Work done by the Contractor must remain within the confines of the project easements. The contractor must ensure adequate safety of site conditions for areas adjacent to the project

The Contractor is advised that any deviations from the construction methods and procedures indicated and as specified herein that are not prior-approved in writing by the Contracting Officer shall be cause for the Contracting Officer issuing a stop work order. Any stop work orders issued for such cause will not be subject to time extensions or cost recovery by the Contractor. Any non-compliance with or violation of the laws or regulations governing the work operations for the project may result in criminal and civil penalties against the Contractor.

If the contractor does not complete all work prior to the time restriction stated in this contract, the government will not pay for remobilization cost

1.4.2 Coordination

The contractor is required to coordinate with the COR and National Park Service Project Manager throughout all milestones at project location.

1.4.3 Security and Public Safety of Work Areas

The work areas are accessible in a limited manner to the general boating public; however, the Contractor is informed that the Government will not undertake to exclude the public or restrict public access to the work areas during the work. The Contractor shall be solely responsible for protection of the public at all times for the duration of the contract and fully comply with the provisions of OSHA safe working practices and the Safety and Accident Prevention requirements of these specifications.

1.4.4 Noise Control and Abatement

The Contractor shall employ the use of properly installed and maintained mufflers, silencers, and manufacturer's recommended sound suppressors on all plant, machinery, and equipment used on this work. The use of sound signals such as whistles, horns, or bells shall not be used if two-way radio communication can accomplish the required function.

1.5 CONTRACTOR ACCESS AND USE OF PREMISES

1.5.1 Activity Regulations

1.5.1.1 Subcontractors and Personnel Contacts

Furnish a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.5.2 Working Hours

Regular working hours shall be from 7:00 a.m. to 6:00 p.m., Monday through Friday of each week.

1.5.3 Work Outside Regular Hours

Work outside regular working hours requires Contracting Officer approval.

Make application 2 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress

1.6 PHYSICAL DATA

1.6.1 Physical Conditions Information

The physical conditions indicated on the drawings and specified herein are the result of site investigations and surveys. The contractor should be aware that soil borings were taken at the site and should refer to Section 01 00 55 for more information. Information and data furnished to the Contractor or referred to below is furnished for the Contractor's information; however, it shall be expressly understood that the Government will not be responsible for any interpretation or conclusion drawn from this information or data by the Contractor.

1.6.2 Site Related Weather Conditions

The Contractor shall anticipate that severe weather conditions may occasionally interfere with the progress of work. Complete weather forecasts, records and reports may be obtained from the National Weather Service in Wakefield, Virginia, telephone (757) 899-4200, Menu selection service or operator assisted as applicable. The Contractor shall satisfy himself as to the hazards likely to arise from the weather conditions during the construction period. Allowance for claims of weather delays are solely based upon the Government Contracting Officer's discretion.

Basis for allowing any delay for weather related delay time shall be based upon FAR clauses 52.236-3, 52.236-4, and 52.249-10.

1.6.3 Time Extensions For Unusually Severe Weather

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default: (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.6.3.1 Schedule

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

1.6.4 Responsibility

The Contractor shall hold and save harmless the United States, its officers, and employees from all claims that may arise as a result of the Contractor's negligence in connection with the work performed under the contract, from noncompliance by the Contractor with the provisions of the contract drawings and specifications, or from the instruction of the Contracting Officer.

1.6.5 Condition of Construction Areas

The required construction areas specified on the plans are based on the condition of the site at the time of the most recent surveys as indicated.

The conditions shown by the surveys specified are subject to change due to the natural forces of rain, wind, waves, river velocities and flows which constantly erode the shoreline.

1.7 GENERAL INSPECTION REQUIREMENTS

The presence of the construction representative shall not relieve the Contractor of responsibility for the proper execution of the work in accordance with the specifications. The Contractor will be required:

a. To furnish, on the request of the Contracting Officer or any construction representative, the use of such boats, boatmen, laborers, and material forming a part of the ordinary and usual equipment and crew of the construction plant as may be reasonably necessary in inspecting and supervising the work areas.

b. To furnish, on the request of the Contracting Officer or any construction representative, suitable transportation to and from the various pieces of plant and the staging areas, and within the work area as may be reasonably necessary in inspecting and supervising the

Should the Contractor refuse, neglect, or delay compliance with these requirements, the specific facilities may be furnished and maintained by the Contracting Officer, and any resultant cost incurred by the government will be deducted from any amounts due or to become due the Contractor.

1.8 PLANT

All equipment and machinery and all supporting plant utilized to accomplish the work, shall be subject to inspection and approval by the Government. All plant employed on the work must be kept in good condition at all times.

1.9 EQUIPMENT OPERATORS

The Contractor shall submit an Equipment and Machinery Operator Authorization list of designated personnel qualified and authorized to operate machinery and equipment prior to starting work. The list shall be maintained at the job site in a current status at all times.

1.10 PUMPING OF BILGES

Contractors are warned that pumping oil or bilge water containing oil into navigable waters, or into areas which would permit the oil to flow into such waters, is prohibited by Section 13 of the River and Harbor Act of 1899, approved 3 March 1899 (30 Stat. 1152; 33 U.S.C. 407). Violation of this prohibition is subject to the penalties under the referenced Acts.

1.11 FUEL OIL TRANSFER OPERATIONS

In accordance with U.S. Coast Guard regulations CFR PART 156.120 , couplings used in fuel oil transfer operations on any vessel with a capacity of 250 or more barrels of oil shall be either a bolted or full-threaded connection; or a quick-connect coupling approved by the Commandant; or an automatic back-pressure shutoff nozzle used to fuel the vessel. An executed fuel oil transfer (Declaration) form signed by the tanker operator shall be submitted to the Contracting Officer for each refueling operation.

1.12 SIGNAL LIGHTS

The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Department of the Army and of the Coast Guard governing lights and day signals to be displayed by towing vessels with tows on which no signals can be displayed, vessels working on wrecks, dredges, and vessels engaged in laying cables or pipe or in submarine or bank protection operations, lights to be displayed on dredge pipe lines, and day signals to be displayed by vessels of more than 65-feet in length moored or anchored in a fairway or channel, and the passing by other vessels of floating plant working in navigable channels, as approved by the Secretary of the Army and the Commandant, U. S. Coast Guard.

1.13 BRIDGE-TO-BRIDGE RADIO COMMUNICATION

In order that radio communication may be made with passing vessels, all plants engaged in work under this contract shall be equipped with bridge-to-bridge radio telephone equipment in accordance with 33 USC CHAPTER 24 , as applicable. The radio telephone equipment shall operate on a single channel very high frequency (VHF), FM, on a frequency

SECTION 01 14 00 Page 6 of 156.65 megahertz with low power output having a communication range of approximately ten miles. The Federal Communications Commission has approved the frequency.

1.13.1 Radio

The Contractor shall provide the Government construction representative a portable radio capable of communicating with the plant for the duration of work under this contract. The Contractor shall maintain the radio as required.

1.14 HISTORICAL AND ARCHAEOLOGICAL FINDS

Federal legislation under the Archeological Resources Protection Act (ARPA) provides for the protection, preservation, and collection of scientific, prehistoric, historic, and archaeological data, including relics and specimens that might otherwise be lost as a result of any Federal construction project. Several areas that will be impacted during this project have been tested and found eligible or potentially eligible under the ARPA and portions of the site impacted by this project are contributing elements. The Contractor shall be provided with a map of the known archeological sites by the NPS prior to construction. The Contractor shall notify the NPS and COR two weeks prior to performing any work within these areas so that the NPS can provide a representative to be on site to monitor the construction operations.Should the Contractor, or any of the Contractor's employees, or parties operating or associated with the Contractor, in the performance of this contract discover evidence of possible scientific, prehistoric, historic, or archaeological data, the Contractor shall immediately cease work at that location, and notify the Contracting Officer, giving the location and nature of the findings. The Contractor shall forward written confirmation to the Contracting Officer as directed. The Contractor shall exercise care so as not to disturb or damage shipwrecks, artifacts or fossils uncovered during excavation, material placement operations, and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition. Any person who, without written permission, injures, destroys, excavates, appropriates, moves or removes any historic or prehistoric artifact, object of antiquity, or archaeological resource is subject to arrest and penalty of law. Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance or changes in the work, or both. If such delays or changes are ordered, an equitable adjustment will be made in accordance with the applicable clauses of the contract.
