The Government may require the delivery of the numbered line items identified in the Schedule as option items at the price stated in the Schedule. The Contracting Officer may unilaterally exercise the option by written notice to the
Contractor within 180 days after contract award. Performance of added line item tasks shall be at the price negotiated in the contract Schedule.
SPECIAL CLAUSE 3: KEY PERSONNEL
(a) The Contractor shall assign to this contract the following key personnel:

(b) During the first 120 days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting
Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 120-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.
Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting
Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. This clause will be modified to reflect any approved changes of key personnel.

SPECIAL CLAUSE 4: KEY TRADES
(a) The Contractor shall identify firms that will perform the following KEY TRADES under this contract. If Key Trades will be self-performed, note “self-performed” in the appropriate trade; otherwise provide the name(s) of assigned subcontractors.

(b) The assignments above are permanent for the contract duration. The Contractor shall make no substitutions of the above listed Key Trade assignments unless the substitution is approved or directed by the Contracting Officer. The
Contractor shall send requests for substitutions to the Contracting Officer a minimum of 15 calendar days prior to any substitution and provide the information required by paragraph (c) below.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete qualification statements for the proposed substitutes, and any additional information requested by the
Contracting Officer. Proposed substitutes shall have comparable qualifications to the firm being replaced. The
Contracting Officer will approve or deny substitution requests within 15 calendar days after receipt of all required information. This clause will be modified to reflect any approved changes.

(1) Subsurface or latent physical conditions at the site which differ materially from those indicated in this contract; or
(2) Unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inhering in work of the character provided for in the contract.
(b) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.
(c) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in paragraph (a) of this clause for giving written notice may be extended by the Contracting Officer.
(d) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract.

52.236-3 SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK (APR 1984)
(a) The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor also acknowledges that it has satisfied itself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.
(b) The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this contract.

Clarification of Weight Limits and Other Restrictions for the Colonial Parkway and its Bridges
Goal: The goal during the York River stabilization project is to keep commercial traffic off the
Parkway to the maximum extent practicable. The intent is to minimize disruption to visitors and commuters, to protect windshields from rock and other debris, and to minimize loading on the roadway and bridges.
Design-Build Requirements: Contractor shall investigate construction methods that limit commercial traffic on the Parkway to the maximum extent practicable. If a constructability review shows that certain operations require the use of the Parkway, the NPS will entertain waivers for commercial vehicles only to the extent necessary.
Preferred General Project Limits:
-- All heavy equipment and bulk materials for revetments, breakwaters, sills, sheet pile installation, steep slope stabilization, backfill, clearing and grubbing, hauling away, and so forth will be delivered by barge.
Revised Specific Project Limits:
-- Commercial vehicles must be pre-approved by NPS before using the Parkway. Requests should be submitted to the CO (or designated Park rep) in writing at least 5 business days in advance.
-- Commercial vehicles may only enter the Parkway from U.S. Route 17 (preferred), Penniman
Road (near the Cheatham Annex entrance), or Ballard Street (Yorktown).
-- Access to the Parkway west of Penniman Road is not authorized.
-- Access via the Fusiliers Road access ramp from Water Street (Yorktown) to the Parkway is strictly prohibited except for personnel vehicles (not to exceed 15 passengers). This road is not designed for commercial vehicle weights.
-- Weight limits are established based on Felgates Creek Bridge, which has the most restrictive limits of any of the bridges and culverts along the Parkway between Ballard Street and Penniman
Road:
-- Single rear axle, 20 tons.
-- Dual rear axle, 26 tons.
-- Tractor trailer, 32 tons.
-- Other axle configurations will be considered on a case-by-case basis.
-- Higher “one time/short term” limits will be considered on a case-by-case basis.
-- There is only one overpass between Ballard Street (Yorktown) and Penniman Road along the
Parkway. It is the Old Williamsburg Road (VA 1020) overpass northwest of the Route 17 access ramps. Clearances for this arched bridge are:
-- 15’ 3” northwest-bound (toward Williamsburg), at edge of road.
-- 15’ 1” southeast-bound (toward Yorktown), at edge of road.
-- Access along the Parkway is allowed during normal working hours defined as 7 AM to 5 PM, Monday thru Friday, excluding federal holidays.
-- Contractor may request approval from the CO to work outside these hours. Access to the
Parkway will be allowed during any additional approved workdays/hours. Work will not be allowed on July 4, Thanksgiving Day, Christmas Day, or New Year’s Day.
-- If the NPS approves access to the Parkway for any slow-moving specialty equipment, access will be not be allowed from 6-9 AM or 3-6 PM.
-- York County quiet hours must be observed from 9 PM to 7 AM daily.

QUESTION ANSWER
1.
Does the government already have a plan of action/ design plans completed for this work & this contract is merely executing these plans with creativity related to access for rock placement?
Or, will the government allow for other alternative structures as breakwater structures in place of rock?
The design build contractor shall review and verify the current design is a cost effective and constructable solution that meets the project requirements (see section 3.5 Technical Requirements) and, if deemed to be valid, progress the design to a level of detail sufficient for permitting, compliance, and construction. The NPS will be receptive to design changes that reduce cost and/or impacts to natural and cultural resources, while still meeting the compliance, design, and permitting requirements.
2.
If the government is willing to consider alternative strategies to stabilization other than rock, then I would recommend considering:
1) what amount of wave energy the government would accept going through these structures and what the basis of wave energy reduction is for these structures (ie, what documentation would be required to justify statements on wave energy reduction)
2) how adaptable rock and alternative structures are to sea level change
It would also be helpful to know if the Government has geotechnical data for the area to know how rock and other structures may ‘settle’ at construction with installation and over time.
Please see section 3.5 Technical Requirements of the scope of work for a list of resources that identify the performance standards that apply to the design. The NPS will be receptive to design changes, that can be clearly demonstrated as beneficial to the NPS, that meet these requirements. The project geotechnical information is provided with this solicitation.

Is there an engineering firm / engineer on your project that I can email questions?

My intention is to see if our Smart Anchor would be approved by you and your team / the engineer of record who designed / spec’d the project at 95% completion.
The design build contractor will be responsible for validating the design and products used meet the project requirements, to include compliance and permitting requirements, and retain the engineer of record. The NPS will not be retaining the initial design team as an Engineer of Record.

Has the Government discussed dredging the shallow areas along the shore line for barge access with any of the permitting
The NPS has not evaluated dredging as a means to improve access and

agencies. If yes, which agencies and what restrictions will be imposed upon the design builder.
constructability. This approach is discouraged due to perceived significant challenges with cost, time, and permitting / environmental impacts – unless it can be demonstrated to be a significant benefit to the project and there are no other viable access alternatives.

The Parkway (per the plan sheets general note 9.3) has a 10 ton limit. Is that a point load, axel load or total vehicle weight loading limit.
Gross vehicle weight, with standard limits of ten tons for single rear axle, and fifteen tons for dual rear axle. See Amendment 04 attachment for additional details.

Please confirm the Contract Price Schedule form shown in Section B – Bid Schedule on page 7 of 55 of the solicitation is not required to be filled out with our submittal due Oct 6th, 2021.
Correct. Do NOT submit any pricing information for Phase 1 proposal submissions. Pricing only occurs in Phase 2.

Are the up to 5 projects shown in Phase 1 technical Proposal Subfactor 1A, to be just those of the Design Builder or may they include projects performed by the Designer or specialty subcontractors

Will the Wetland Delineation previously performed for this project need to be re-delineated since it is several years old.
As noted in section 3.6 Permitting and Compliance of the scope of work: The project area has been previously delineated in 2011; however, the delineation does not appear to be covered under a current, valid confirmation. It is anticipated the previous delineation will need to be verified. For the purposes of bidding, assume responsibility for re-delineation.

Will the QCM need to be on site full time, or may he / she be part time only, with a Quality representative on site full time.

The scope of work indicates the design build contractor shall review and verify the current design is a cost effective and constructable solution that meets the project requirements (see section 3.5 Technical Requirements) and, if deemed to be valid, progress the design to a level

It is stated in the RFP that the Concept Plans are 90% complete, yet at the site visit it was stated as a Design Build contract the DB team is expected to review the designs to date and make revisions, including to design concept, they feel appropriate. This was especially true at the areas of gulling on the steep slopes where it was stated you were looking for ideas on how to fix the problem. Please take this into account when stating the desired design schedule. The 155 days for all design, permits and Gov’t reviews is not adequate.
Please note the days indicated in Scope of Work section 1.5 are “work days” and not calendar days. Contract documents take precedence on day allocations and are always in calendar days unless otherwise notated. Performance and Payment bonds will be due 10 days after contract award. The NPS will negotiate the project schedule with the contractor.
The NPS aspires to complete the work in this RFP in accordance with the schedule noted in the scope of work.

Section 4.8 Maintaining Existing Utilities, page 23 states that the location of existing utilities is the responsibility of the Contractor.
Please provide for information purposes, any available inventories of existing utilities within the project site.
There are no overhead utilities in the project area. There are stormwater drainage features (drop inlets, culverts, outfalls, etc) throughout the project area, and are thought to be identified on the drawings. There is an 11” utility pipe suspended under the Felgates Creek Bridge. Per FHWA bridge inspection photo included with Amendment 04, it appears it was inherent to the bridge design when the bridge was replaced in 1981. Neither the NPS nor the Navy have any knowledge of its purpose, active or abandoned status, or its location beyond the bridge, other than the run under the bridge is between the first two beams on the south side of the bridge. FHWA bridge inspection reports for the Indian Field Creek Bridge (next bridge to the east; no utilities underneath) and King Creek Bridge (next bridge to the west;
smaller communications conduit mounted to south face of bridge) do not show this line. NPS has no other off-hand knowledge of utilities in the project area, but it remains the responsibility of the contractor to confirm.

Per Attachment 1 Scope of Services Section 3.6, a Tidewater Joint

Our engineering analysis shows a potential problem for installing the Helical Anchors horizontally for the Sheet Pile seawall.
The drawings indicate horizontal helical tiebacks. Most of the borings indicate sandy soil conditions. With sand the pullout capacity increases with depth. By going horizontal the embedment depth will be excessive. So can you please check if the helical tiebacks can be installed at an angle to achieve an economical option. An angle of 30 degrees to the horizontal would be optimal. Please see if the EOR can approve this.
The design build contractor shall review and verify the current design is a cost effective and constructable solution that meets the project requirements (see section 3.5 Technical Requirements).
