On Sunday, Contractor's hours of operation shall be limited to daylight hours but not earlier than 9:00 AM and not later than 6:00 PM. Work hours must not vary unless otherwise approved by the Contracting Officer. No work or hauling shall take place on holidays without permission given by the Contracting Officer. Staging and access areas may have limited access beyond these hours of operation.

Refer also to paragraph TEMPORARY ACCESS AND STAGING in Section 01 50 00

TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS.

1.5 SCRAP MATERIAL

Materials specified to be removed and become the property of the Contractor are designated as scrap, and the Contractor, by signing this contract, hereby acknowledges that he/she has made due allowance for value, if any, of such scrap in the contract price.

1.6 UTILITIES

Immediately notify the Contracting Officer in writing if utilities not shown on the Drawings and not visible as to the date of this contract are encountered within the construction limits of the entire project, and such utilities will interfere with construction operations, to enable a determination by the Contracting Officer as to the necessity for removal or relocation. If such utilities are removed or relocated as directed by the Contracting Officer, an equitable adjustment in the contract price must be made pursuant to the Contract Clause CHANGES to cover the cost of any additional pertinent work or delay.

1.7 PLANNED UTILITY OUTAGES AND STREET CLOSURES

All utility outages and street closures to be of as short a duration as possible and to be scheduled as far in advance as possible with the Contracting Officer, in no case less than 7 days before the outage or closure. Obtain from the Contracting Officer in writing a statement or schedule giving the permissible times of outages or closures for particular installations and the maximum time allowed for each. Strictly observe such schedules and the Contractor will be held responsible for any violations.

1.8 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

SECTION 01 00 00 Page 3 October 2021

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule will reflect these anticipated adverse weather delays in all weather dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

(07) (07) (06) (03) (02) (01) (00) (00) (01) (02) (04) (06)

Upon execution of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Refer to ER 415-1-15 .

1.9 HAZARDOUS NOISE AREA

Provide adequate ear protection as may be required for Contractor's personnel at the job site.

1.10 BID ITEM OVERRUN

Throughout the contract (at a minimum, every two weeks), monitor placement or installation of unit price items (if any) with respect to the original estimated quantities shown in the contract. If placement or installation indicates a possible overrun with respect to the original estimated quantities shown in the contract, immediately provide written notification to the Contracting Officer with revised total estimated quantities.

1.11 NON CONTRACT WORK

Do not perform any work or erect any structure for third parties, landowners or otherwise, without prior approval of the Contracting Officer.

1.12 DAMAGE TO ACCESS ROADS AND STAGING AREAS

Preserve and protect all existing private or project access or right-of-way roads, off-site staging area (if applicable), and as bicycle and penetration pathways. At the completion of work and prior to the Contractor leaving the project, restore to pre-project conditions all such access roads, staging areas, and pathways. Repairs include replacement of base rock and/or surface treatment as required and as approved by the County of Sacramento. Refer also to paragraph PROTECTION OF TRAFFIC in Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS.

SECTION 01 00 00 Page 4 October 2021

1.12.1 Removal and Replacement of Bicycle and Pedestrian Pathways

Contractor shall remove and replace existing paved bicycle and pedestrian pathways within the work limits as shown on the Drawings after completion of levee improvements and after material hauling activity has ceased.

Replace bicycle and pedestrian pathways to meet the requirements of the Drawings, Section 32 11 23 AGGREGATE BASE COURSES, Section 32 12 16 HOT-MIX ASPHALT (HMA) FOR ROADS, and Sacramento County standards. Repairs include replacement of base rock and surface treatment as required and as approved by the County of Sacramento.

Contractor's preconstruction and post-construction surveys shall include all bicycle and pedestrian pathways used in the Contractor's operations outside the defined work limits in the Drawings. The Contracting Officer and County of Sacramento shall determine based on review of surveys if repair of bicycle and pedestrian pathways used by the Contractor outside the work limits are required. If repairs are deemed necessary, Contractor shall perform repairs as-directed at no additional cost to the Government to meet the standards of the Drawings, Section 32 11 23 AGGREGATE BASE COURSES, Section 32 12 16 HOT-MIX ASPHALT (HMA) FOR ROADS, and Sacramento County standards.

1.12.2 Documentation Regarding Potential Damage

1.12.2.1 Preconstruction Quantity Survey Plan

1.12.2.2 Preconstruction Access Road and Staging Area Survey

Complete and submit a Preconstruction Access Road and Staging Area Survey including digital video and digital photographs of all public, private, and project access or right-of-way roads before construction begins.

Submit the digital video and the digital photographs before the start of construction operations. The preconstruction access road survey should clearly identify all pavement markings to facilitate replacement of markings should replacement of pavement be required after construction.

1.12.2.3 Post-Construction Access Road and Staging Area Survey

After completion of construction of the project, submit a Post-Construction Access Road and Staging Area Survey including digital video and digital photographs of the same area where preconstruction digital video and digital photographs were taken.

1.12.3 Transient Population

The Contractor must assist the Government's public outreach program during that same period to post notifications as determined by the Government.

The City of Sacramento Police Department Impact Team will relocate the transient persons. Enforcement requests must be made to the Contracting Officer at the end of the notice period if the excluded phase work area is repopulated. The Contractor must not attempt to move members of the transient population remaining in or returning to work areas, which is the responsibility of local law enforcement or other authorized agencies or services.

SECTION 01 00 00 Page 5 October 2021

The Contractor must be responsible for the safety of the public within the limits of construction during the course of construction. In particular, the project site is a known location of transient persons. Prior to the commencement of construction activities, submit a Transient Population Safety Plan depicting proposed phasing, signage, fencing, and other protective measures to provide for the safety of the public and transient community. At a minimum the plan must include the following:

a. Work zones in which the public and transient population must be excluded during the various phases of construction.

b. Safety fencing locations.

c. Proposed signage to be placed, including frequency of signage.

d. Locations within the project limits that remain open to the public during periods of non-construction activity based on various phases of construction.

e. Identification of public access and path of travel during various phases of construction.

1.13 ENVIRONMENTAL LITIGATION

a. If the performance of all or any part of the work is suspended, delayed, or interrupted due to an order of a court of competent jurisdiction as a result of environmental litigation, as defined below, the Contracting Officer, at the request of the Contractor, is to determine whether the order is due in any part to the acts or omissions of the Contractor or a subcontractor at any tier not required by the terms of this contract. If it is determined that the order is not due in any part to acts or omissions of the Contractor or a subcontractor at any tier other than as required by the terms of this contract, such suspension, delay, or interruption is to be considered as if ordered by the Contracting Officer in the administration of this contract under the terms of the SUSPENSION OF WORK clause of this contract. The period of such suspension, delay or interruption is unreasonable, and an adjustment is to be made for any increase in the cost of performance of this contract (excluding profit) as provided in that clause, subject to all the provisions thereof.

b. The term "environmental litigations" as used herein, means a lawsuit alleging that the work will have an adverse effect on the environment or that the Government has not duly considered, either substantively or procedurally, the effect of the work on the environment.

1.14 WORK IN THE ACTIVE CHANNEL AND FLOODPLAIN

The proposed work is located within the floodplain of the Lower American River. The site is subject to seasonal flooding by elevated-flow events.

Some elevations shown in the Drawings including the finish grade of sections of the planting benches are below water levels typically exceeded during the summer months and will be constructed in the active channel.

Existing ground, subgrade, and finish grade elevations along the buried rock toe may also be below the instream water levels. The table below provides 95% non-exceedance monthly water surface elevation (stage) computed from hourly stage data recorded at the H-Street stream gage

SECTION 01 00 00 Page 6 October 2021 between July 1995 and July 2020. It is the Contractor's responsibility to determine schedule and control of water, and dewatering needs at the project site.
