About this file
This document is a federal contract clause (ES7034) that establishes requirements for rework and repair of nonconforming material, effective January 2012.
The clause defines rework as the reprocessing of nonconforming material to achieve complete conformance with drawings, specifications, and contract requirements, while repair involves reprocessing nonconforming material using approved written procedures to bring it to a usable condition without necessarily achieving complete conformance. Rework procedures and associated inspection procedures must be documented by the contractor and submitted to the Government Quality Assurance Representative (QAR) for review prior to implementation, subject to the QAR's disapproval. Repair procedures must be documented and submitted on a DD Form 1694 (Request for Deviation/Waiver) to the Contracting Officer for review and written approval before implementation. All submissions for repair or rework procedures must include a description of the cause of nonconformances and the preventive actions taken or planned. The rework or repair procedure must include reinspection provisions that take precedence over Technical Data Package requirements and provide government assurance that reworked or repaired items meet reprocessing requirements. The requirement applies throughout the supply chain as a flow-down requirement to contractors and their suppliers, vendors, and subcontractors.
