About this file

This document is a federal contract clause (ES7034) establishing requirements for rework and repair of nonconforming material, effective January 2012.

The clause defines rework as the reprocessing of nonconforming material to achieve complete conformance with drawings, specifications, and contract requirements, while repair is defined as reprocessing nonconforming material through approved written procedures to reduce but not eliminate nonconformance, bringing items into usable condition. Rework procedures and associated inspection procedures must be documented and submitted to the Government Quality Assurance Representative (QAR) for review prior to implementation, subject to the QAR's disapproval authority. Repair procedures must be documented on DD Form 1694 (Request for Deviation/Waiver) and submitted to the Contracting Officer for written approval before implementation. All submissions for rework or repair procedures must include a description of the cause of nonconformance and actions taken or planned to prevent recurrence. Both rework and repair procedures must include reinspection provisions that take precedence over Technical Data Package requirements and provide government assurance that items meet reprocessing requirements. The clause applies as a supply chain flow-down requirement to contractors and their suppliers, vendors, and subcontractors.
