JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

In accordance with FAR 6.302 or FAR 13.501(a), the proposed contractual action is pursuant to the statutory authority identified in paragraph 4. This template is required for actions over the Simplified Acquisition Threshold (unless the procurement is acquired as a limited source IAW FAR 8.405-6 or is an Exception to Fair Opportunity IAW FAR 16.505(b)(2)).

1. Agency and Contracting Activity (FAR 6.303-2(b)(1)).

U.S. Department of the Interior, Bureau of Reclamation, Interior Region 8: Lower Colorado Basin (LCB), Acquisition and Assistance Management Office.

2. Nature/Description of Action (FAR 6.303-2(b)(2)).

A Firm Fixed Price purchase order is anticipated to be awarded for this action. The anticipated period of performance for this requirement is 10/01/2025 through 04/30/2026 and will be using FY25 funding which has already been committed with PR 440011633.

3. Description of Supplies/Services (FAR 6.303-2(b)(3)).

The scope of the project is providing the retrofit of the current Basler ECS-2100 voltage regulators with current Basler DECS-2100 voltage regulators conversion kit. Parker Dam has 4- 30MW Francis style turbine hydrogenators equipped with Eaton/ Basler static excitation cabinets. The original cabinets were installed between 2005 and 2011 and require the voltage regulators on all four generator units be refurbished. The current regulators (Basler ECS-2100) is now obsolete and cannot be repaired or replaced nor is it supported anymore and is a known point of failure. Reclamation is looking to replace this obsoleted regulator with the current Basler Regulator DECS-2100 as well as the other associated components included in the Basler DECS-2100 digital exciter controller upgrade. Vendor shall provide a turnkey installation to include all labor, parts, equipment to install, commission, and train personnel on the four 30MW hydrogenating units at Parker Dam. The estimated cost for this requirement will be , with the period of performance being anticipated to be 10/01/2025 through 04/30/2026.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)).

A sources sought was posted on SAM.gov to all potential sources for 29 days in 2024 in which we received two responses Both responses were reviewed by a technical expert and only (Basler) was determined to be able to meet the government requirement.

Additionally, a Notice of Intent to Sole Source was posted for 15 days to SAM.gov with no responses received.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)).

The anticipated cost will be considered fair and reasonable based on cost analysis which will include the comparison of proposed prices for similar services and historical prices for the same or similar services. The agency has another similar contract award with the contractor for services at the Elephant Butte Dam, along with historical awards for the same services that can be used for comparison.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)).

For this new contract, market research included posting a Sources Sought for 30 days and a notice of intent to sole source for 15 days to SAM.gov.

9. Any Other Supporting Facts (FAR 6.303-2(b)(9)).

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11)).

Both a Sources Sought and NOI to Sole Source where posted on SAM.gov in order to provide any potential vendors the opportunity respond with a capability statement showing they could provide the service required for this action. In the future, if another requirement is needed, market research will be conducted at that time in order to determine if any new potential vendors would be able to provide additional competition for that requirement.

This requirement will have the Request for Proposal issued with the Notice of Intent to Sole Sources on Sam.gov for the required 30 days. Any responses received from this will be reviewed by a technical expert to determine if they would be able to meet or exceed the government requirement for this action.
