Ninety (90) days before the anniversary of the contract award date, the Government shall perform an assessment of each MACC Contractor’s performance based on their current and past performance on MACC task orders. For purposes of the performance, the following criteria is how each Contractor will be evaluated annually. The Government will evaluate each Contractor’s participation rate, reason(s) for non-participation, and overall work performance for TOs completed, or in progress. The Government reserves the right to implement performance evaluations into the Contractor Performance Assessment Reporting System (CPARS) for all TOs. A Contractor rated as Satisfactory* may remain in the competition pool. Failure to participate in good faith and/or a TO performance assessment rating of Marginal** or Unsatisfactory***, under the CPARS rating system, may result in the Contractor being off-ramped from the MACC. If a Contractor has failed to comply with the terms and conditions of the MACC and task order(s), the Government reserves the right to not issue future solicitations to that contractor and/or terminate their contract. This shall serve as the "Off-Ramping" process. The Off-Ramped contractor will be required to continue any active projects until completion, unless otherwise terminated.
RATING DEFINITIONS:
*Satisfactory:
To receive a Satisfactory (S) rating, Contractor must maintain 70% participation in all MACC FOPRs and maintain a Satisfactory Rating per TO.
Satisfactory (S) Rating: Performance meets contractual requirements. The contractual performance of the element, or sub-element, contains some minor problems for which corrective actions taken by the Contractor appear or were satisfactory. Additionally, to justify a Satisfactory rating, there should have been only minor problems, or major problems the Contractor recovered from without impact to the contract/order. A fundamental principle of assigning ratings is that Contractors will not be evaluated with a rating lower than Satisfactory solely for not performing beyond the requirements of the contract/order
** Marginal:
A Marginal (M) rating will be given if the Contractor has a participation rating of less than 70%, but more than
50%, of all MACC FOPRs, or a Marginal rating on any TO. Subsequently, the CO shall make a determination regarding the continuance of any Contractor receiving a Marginal (M) rating. The Contractor may provide written documentation that identifies extenuating circumstances or a performance improvement plan for consideration by the CO.
Marginal (M) Rating: Performance does not meet some contractual requirements. The contractual performance of the element, or sub-element, being evaluated reflects a serious problem for which the Contractor has not yet identified corrective actions. The Contractor’s proposed actions appear only marginally effective or were not fully implemented. A Marginal rating should be supported by referencing the management tool that notified the Contractor of the contractual deficiency (e.g., management, quality, safety, or environmental deficiency report or letter).
*** Unsatisfactory:
An Unsatisfactory (U) will be given if the Contractor has a participation rating of less than 50% in all MACC FOPRs, or an Unsatisfactory rating on any TO. The CO shall make a determination regarding the continuance of any Contractor receiving an UNSATISFACTORY (U) rating. The Contractor may provide written documentation that identifies extenuating circumstances, or a performance improvement plan, for consideration by the CO.
Unsatisfactory (U) Rating: Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element, or sub-element, contains a serious problem(s) for which the Contractor’s corrective actions appear or were ineffective. An Unsatisfactory rating should be supported by referencing the management tools used to notify the Contractor of the contractual deficiencies (e.g., management, quality, safety, or environmental deficiency reports, or letters).
11. PROGRESS OF WORK:
Once awarded a TO, the Contractor shall submit, for approval, all work schedules to the CO within ten (10) calendar days after start of work unless otherwise specified. The reports contemplated by the clause titled “Schedules for Construction Contracts” shall be accomplished on and in accordance with instructions pertaining to AF Form 3064, Contract Progress Schedule, and AF Form 3065, Contract Progress Report.
12. MATERIAL APPROVAL SUBMITTAL FORM:
(AF FAR SUP 5336.290): All material and articles requiring approval, as contemplated by the Materials and Workmanship Clause, shall be submitted by the Contractor. All wall covering, carpet and other fabric type submittals will show the full pattern of material as a minimum. All applicable submittals shall be grouped in color boards as installed, i.e. carpet, paneling, chair-rail, wall covering and ceiling tile. Contractor is responsible for identifying and locating required materials for submittals to include matching any existing materials.
