Summary of Attachment E2 - USACE Authorization

This document is a USACE (United States Army Corps of Engineers) authorization attachment related to the Cocoa Beach Golf Muck Capping Project, a construction administration and environmental remediation initiative involving Brevard County, Florida, the U.S. Army Corps of Engineers, and the Florida Department of Environmental Protection. The project encompasses construction oversight, design modification, and environmental permit coordination for multi-lift sand capping placement over approximately 160 acres of muck sediments in the Banana River Lagoon, with estimated volumes of 1,400,000 to 1,800,000 cubic yards. Scope of services includes daily documentation and contractor coordination, hydrodynamic and sediment transport modeling, field verification and quality assurance activities, and preparation of permit modification application packages. The RFQ solicitation has a proposal opening date of February 27, 2026 at 10:00 a.m., with a question deadline of February 19, 2026 at 5:00 p.m., and a Selection Committee meeting scheduled for March 9, 2026 at 9:30 a.m. The initial contract term is three years with options for two one-year renewals. Sealed proposals must be submitted in three hard copies and one electronic copy on USB flash drive to Brevard County Purchasing Services, with all prices remaining firm and valid for 90 days from the opening date.

Compensation is determined through negotiation and may be structured as fixed fees per milestone, hourly rates not to exceed specified maximums, or combinations thereof. The project is funded through the Brevard County Save Our Indian River Lagoon (SOIRL) Project Plan allocation of $21.35 million and State Appropriations of $12 million, representing the largest capital improvement project within the 10-year, $490 million SOIRL initiative. The selected contractor must maintain professional liability insurance of $2,000,000 per claim, general liability insurance of $1,000,000 per occurrence, workers' compensation coverage, and cyber liability insurance of not less than $5,000,000 per claim. The RFQ does not specify set-aside designations or organizational type restrictions. Geosyntec Consultants, Inc., located in Titusville, Florida, submitted the sole proposal received by the opening date. Brevard County reserves the right to reject any and all proposals, award to multiple vendors with or without primary/secondary designation, and to waive minor informalities.

General Conditions:

1. The time limit for completing the work authorized ends on March 6, 2030.

If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.

2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.

3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and State coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.

4. If you sell the property associated with this permit, you must obtain the signature and the mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.

5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions (Attachment 2).

6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.

Special Conditions:

1. Reporting Address: The Permittee shall submit all reports, notifications, documentation, and correspondence required by the general and special conditions of this permit to either (not both) of the following addresses:

6. Cultural Resources/Historic Properties:

a. No structure or work shall adversely affect, impact, or disturb properties listed in the National Register of Historic Places (NRHP), or those eligible for inclusion in the NRHP.

b. The applicant shall notify both the Florida Department of State, Division of Historical Resources, Compliance Review Section at (850)-245-6333 and the Corps, of the observations within the same business day (8 hours). Examples of submerged historical, archaeological or cultural resources include shipwrecks, shipwreck debris fields (such as steam engine parts, or wood planks and beams), anchors, ballast rock, concreted iron objects, concentrations of coal, prehistoric watercraft (such as log "dugouts"), and other evidence of human activity. The materials may be deeply buried in sediment, resting in shallow sediments or above them, or protruding into water. All work and ground disturbing activities within a 100-meter diameter of the unmarked human remains shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archaeologist within the same business day (8-hours). The Corps shall then notify the appropriate SHPO. Based on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend, or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume without written authorization from the SHPO and from the Corps.

7. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.

8. Manatee Conditions: The Permittee shall comply with the “Standard Manatee

Permittee: City of Cocoa Beach

Permit No: 0443265-001-EI

PROJECT LOCATION

The activities authorized by this permit and sovereignty submerged lands authorization are located within Banana River Aquatic Preserve, an Outstanding Florida Waters, a Class II water, Conditionally Restricted and Prohibited Shellfish Harvesting areas, at latitude 28° 18’ 57.24” and longitude -80° 38’ 42.72”, Cocoa Beach, Florida 32931, Section 09 & 16, Township 25 South, Range 37 East, Brevard County. The project location is adjacent to the Cocoa Beach Country Club.

The staging area of this project is at the City of Cocoa Beach Reclamation Facility, located at 1600 Minuteman Causeway, Cocoa Beach, FL 32931.

PROJECT DESCRIPTION

The permittee is authorized to perform a restoration project of a large relic borrow pit within the Banana River. The purpose of the project is to eliminate the exposed muck sediments which will result in an overall reduction of Total Nitrogen and Total Phosphorus in the Banana River. The project will entail restoration in the form of placing approximately 265,000 cubic yards (619,8588 square feet) of clean sand over existing muck sediments found within a 140.7-acre area of the Banana River. The clean sand cap placement will vary from 9 inches to 15 inches thick. The authorization also includes the creation of two habitat caps totaling 1.6 acres for oyster and mangrove habitat, upon which 75 black mangrove (Avicennia germinans) seedlings and 350 red mangrove (Rhizophora mangle) seedlings will be planted, totaling 2,700 square-feet (4,500 cubic yards) on the west side of the project area. Those activities include installing a total of 8 low-profile oyster habitat modules, all of which have a 75-foot length and a 10-foot width. Authorized activities are depicted on the attached exhibits.

The permit authorizes 140.7 acres of surface water impacts. Mangroves, wetland vegetation, or submerged grassbeds are not located within the project boundaries; therefore, this permit does not authorize impacts to these resources.
