About this file
This file contains two Department of the Army permits and a Florida Department of Environmental Protection (FDEP) Consolidated Environmental Resource Permit and Sovereignty Submerged Lands Authorization for the Cocoa Beach Golf Muck Capping Project in Cocoa Beach, Florida. The project involves placing approximately 265,000 cubic yards of clean sand fill over 140.7 acres of nearshore waters in the Banana River to cap existing muck deposits, and placing an additional 4,500 cubic yards of clean sand fill over 1.6 acres to create habitat caps for seagrass and shellfish restoration. The habitat caps will support planting of 75 black mangrove and 350 red mangrove seedlings, as well as installation of eight low-profile oyster habitat modules. The U.S. Army Corps of Engineers Jacksonville District issued Permit No. SAJ-2024-00084 on an unspecified date, authorizing work through March 6, 2030. The FDEP issued Permit No. 0443265-001-EI on January 28, 2025, with a construction phase expiration date of January 28, 2030. The project site is located adjacent to the Cocoa Beach Municipal Golf Course in Sections 10, 15, and 9, 16 of Township 25 South, Range 37 East, in the Banana River Aquatic Preserve, an Outstanding Florida Waters area.
The permits include comprehensive conditions addressing erosion and sediment control, water quality standards, turbidity monitoring with a zero-NTU exceedance limit outside construction areas, manatee protection, vessel strike avoidance measures, protection of protected species including marine turtles and marine mammals, and cultural resource protection. The City of Cocoa Beach is the permittee, with Applied Ecology, Inc. serving as the authorized agent. Pre-construction baseline water quality monitoring and quarterly monitoring for a minimum of one year post-construction are required, with reports submitted to FDEP and the Aquatic Preserves Manager. The habitat cap must be monitored quarterly for up to five years post-construction. All construction activities must occur during daylight hours using clean fill material free of debris and contaminants. The permittee must maintain a 25-foot distance from seagrass, establish erosion control measures along the support area perimeter, and remove all temporary best management practices and turbidity control devices upon project completion. No dredging for backfill is permitted, and impacts to mangroves, wetland vegetation, and submerged aquatic vegetation are prohibited.

General Conditions:
1. The time limit for completing the work authorized ends on March 6, 2030.
If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and State coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature and the mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions (Attachment 2).
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
Special Conditions:

Such activity shall not resume without written authorization from the SHPO and from the Corps.
7. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.

Consolidated Environmental Resource Permit and Sovereignty Submerged Lands Authorization
Permittee: City of Cocoa Beach
Permit No: 0443265-001-EI
PROJECT LOCATION
The activities authorized by this permit and sovereignty submerged lands authorization are located within Banana River Aquatic Preserve, an Outstanding Florida Waters, a Class II water, Conditionally Restricted and Prohibited Shellfish Harvesting areas, at latitude 28° 18’ 57.24” and longitude -80° 38’ 42.72”, Cocoa Beach, Florida 32931, Section 09 & 16, Township 25 South, Range 37 East, Brevard County. The project location is adjacent to the Cocoa Beach Country Club.
The staging area of this project is at the City of Cocoa Beach Reclamation Facility, located at 1600 Minuteman Causeway, Cocoa Beach, FL 32931.
PROJECT DESCRIPTION
The permittee is authorized to perform a restoration project of a large relic borrow pit within the Banana River. The purpose of the project is to eliminate the exposed muck sediments which will result in an overall reduction of Total Nitrogen and Total Phosphorus in the Banana River. The project will entail restoration in the form of placing approximately 265,000 cubic yards (619,8588 square feet) of clean sand over existing muck sediments found within a 140.7-acre area of the Banana River. The clean sand cap placement will vary from 9 inches to 15 inches thick. The authorization also includes the creation of two habitat caps totaling 1.6 acres for oyster and mangrove habitat, upon which 75 black mangrove (Avicennia germinans) seedlings and 350 red mangrove (Rhizophora mangle) seedlings will be planted, totaling 2,700 square-feet (4,500 cubic yards) on the west side of the project area. Those activities include installing a total of 8 low-profile oyster habitat modules, all of which have a 75-foot length and a 10-foot width. Authorized activities are depicted on the attached exhibits.
The permit authorizes 140.7 acres of surface water impacts. Mangroves, wetland vegetation, or submerged grassbeds are not located within the project boundaries; therefore, this permit does not authorize impacts to these resources.
