F. Punchlist/Final Inspections: A punch list inspection is a critical step in the project closeout process. It involves a detailed inspection of the completed work to identify any items that do not meet the contract specifications, standards, or quality requirements. The punch list is essentially a document that lists all the tasks, repairs, or adjustments that need to be completed before the project can be considered fully finished and accepted by the VA.

The contractor is be responsible for performing the following tasks, including but not limited to:

• Preparation of the Punch List:

o As the construction project nears completion and the project is deemed substantially complete, the contractor shall conduct a thorough inspection of the work performed along with the COR and A/E Team. This inspection should identify any items that are incomplete, defective, or not in compliance with the contract documents.

o The A/E and VA will document these items in a punch list, which is a detailed list of all the deficiencies that need to be addressed before the project can be considered complete. These lists will be provided to the contractor within (5) federal working days.

• Correction of Deficiencies:

o The contractor is responsible for correcting all the deficiencies listed on the punch list. This includes completing any unfinished work, repairing defective work, and ensuring that all work complies with the contract documents.

o Once the contractor believes that all punch list items have been addressed, they should request a final inspection from the CO and COR.

o The CO or the COR will conduct a final inspection to verify that all punch list items have been completed satisfactory.

• Final Acceptance:

o If the final inspection confirms that all punch list items have been addressed and the work meets the contract specifications; the CO will issue a notice of final acceptance.

o The contractor will then proceed with the final steps of contract closeout, including submission of final documentation and request for final payment.

It is important to note that the punch list process is governed by the terms and conditions of the contract, including any specific clauses related to inspections and acceptance. For example, FAR 52.246-12, "Inspection of Construction," outlines the government's rights to inspect and test the work to ensure compliance with contract requirements. By following this process, the contractor can ensure that all work is completed to the satisfaction of the government and that the project can be successfully closed out.

G. Hours of Work: Work hours are 7:00m – 3:30pm, Monday thru Friday. All work performed shall be coordinated and scheduled thru the COR. After hours work will be allowed for tasks the GC deems necessary; however, any work outside of work hours must be coordinated and approved through the COR and CO.

An electronic copy of the estimated schedule must be delivered to the Contracting Officer's Representative and the Contracting Officer within fourteen (14) calendar days of receiving the Notice to Proceed (NTP). The Contractor is responsible for maintaining this schedule and providing monthly updates via email to the COR and the CO as necessary.

The Contractor shall present a 3-Week Lookahead schedule at each weekly Construction Progress meeting. This schedule must include the actual construction work completed in the previous week and the planned construction activities for the upcoming three weeks, covering a total period of four weeks.

The separation of duties is crucial for maintaining high standards of workmanship and ensuring that all construction activities adhere to the specified requirements and regulations.

L. Construction Period Services Consultant: The VA has retained ‘DAV Energy’ and their corresponding subconsultants to provide Construction Period Services for this project and shall be responsible for construction support, review of construction contractor’s submittals (RFIs, shop drawings, test reports, change orders, etc.), and site visits during construction.

HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA):

Contractor shall take reasonable measures to ensure patient privacy and confidentiality. The contractor agrees to take all reasonable precautions to safeguard patient information from unauthorized access or modification, in both electronic and hard-copy formats. This includes not only electronic security measures such as “strong” user passwords on computer systems, but also physical barriers to prevent unauthorized use of computer work-stations; that hard copy patient files are in secured lockable areas, that files are in lockable cabinets, that the cabinets can in fact be locked, i.e., keys are available, and the locking mechanisms work properly. This precaution also includes the proper transfer of patient information via electronic means, such as faxing or system to system transmission.

That only the minimum necessary patient information is used to provide appropriate service to the correct patient.

That the undersigned understands that all parties are bound by the requirements of the “Health Insurance Portability and Accountability Act of 1996” which provide guidance on the protection of patient privacy and confidentiality. This Act mandates that all government agencies, and those bodies with whom they contract, must be in compliance with the directives of the Act.

b. To the extent known by the contractor/subcontractor, the contractor/subcontractor’s notice to VA shall identify the information involved, the circumstances surrounding the incident (including to whom, how, when, and where the VA information or assets were placed at risk or compromised), and any other information that the contractor/ subcontractor considers relevant.

c. (5) Ease of logical data access to the lost, stolen or improperly accessed data in light of the degree of protection for the data, e.g., unencrypted, plain text;

(6) Amount of time the data has been out of VA control;

(7) The likelihood that the sensitive personal information will or has been compromised (made accessible to and usable by unauthorized persons);

(8) Known misuses of data containing sensitive personal information, if any;
