Summary of Bid Guaranty Certification and Request for Task Order Proposal Documents

This file consists of a Bid Guaranty Certification letter template and multiple Request for Task Order Proposal (RFTOP) documents issued by the District of Columbia Department of General Services (DGS), Contracts and Procurement Division, located at 2000 14th Street NW, 8th Floor, Washington, DC 20009. The documents pertain to several school-based capital improvement projects, including door replacement at Bunker Hill Elementary School, a welcome center at Ketcham Elementary School, miscellaneous work at Bruce Monroe Elementary School, and HVAC system replacement at Tyler Elementary School's cafeteria. The RFTOPs are issued under existing Indefinite Delivery/Indefinite Quantity (IDIQ) contracts and require offerors to submit complete bid forms, lists of key personnel (including Field Superintendent and Project Manager with qualifications and experience details), identification of potential subcontractors and suppliers, project management plans with preliminary schedules, bid bonds in the specified form, and subcontracting plans. All proposals should address the complete scope of work, including furnishing all necessary supervision, labor, materials, and equipment for project completion. The District intends to award a single task order to the responsive and responsible offeror with the lowest lump sum bid deemed most advantageous to the District.

All contractors must comply with Davis-Bacon wage determination requirements, the Living Wage Act, and the Service Contract Act in effect at the time of task order execution. Contractors are required to provide payment and performance bonds prior to commencing work in accordance with the underlying IDIQ contract provisions. Offerors submitting alternate bid security in the form of a cashier's check or irrevocable letter of credit must submit a notarized certification acknowledging that failure to post required payment and performance bonds will result in the Department drawing upon the alternate bid security as liquidated damages, contract termination, and a two-year prohibition on using alternate bid security for future proposals. Additional requirements include compliance with mandatory subcontracting plans, residency hiring requirements (with a 51% District resident hiring threshold), First Source Employment Agreements, tax certifications for those registered to conduct business in the District, and the Apprenticeship Act. Award is based solely on the lowest lump sum price as detailed in the Bid Form (Attachment B).

Certification Letter for Cashier’s Check or Irrevocable Letter of Credit

Offerors who submit a cashier’s check or an irrevocable letter of credit (“Alternate Bid Security”) in lieu of a bid bond must also submit this certification, properly notarized, with their proposal.

By executing this document, Offeror acknowledges that, if awarded this contract, Offeror shall be required to post promptly a payment and performance bond equal to the full value of the contract. In the event Offeror fails to post such payment and performance bond, the Offeror understands and agrees that; (i) the Department shall draw upon the Alternate Bid Security as liquidated damages; (ii) the award and or contract shall be terminated; (iii) for a period of two (2) years thereafter, the Department will not accept from such Offeror Alternate Bid Security in lieu of a bid bond; and (iv) the Offeror hereby waives the right to protest the termination of any such award or contract. The Offeror further acknowledges and agrees that the damages the Department would experience in the event such award or contract are terminated due to the Offeror’s failure to post a payment and performance bond are difficult to determine and that the value of the Alternate Bid Security represents a reasonable estimate of the damages the Department would incur.
