About this file
This is a Clean Air and Water Certificate for a Food Service Management Company (FSMC) contract with a Local Educational Agency (LEA). The certificate must be completed for all new and renewal contract years when the contract value exceeds $100,000, or when a facility has been subject to a conviction under the Clean Air Act or Federal Water Pollution Control Act and is listed by the EPA. Both the FSMC and LEA are required to execute the certificate as a condition of contract award. The document outlines the regulatory framework governing environmental compliance for the contracted services.
The FSMC agrees to comply with all requirements of Section 114 of the Clean Air Act and Section 308 of the Federal Water Pollution Control Act, including inspection, monitoring, reporting, and information provision requirements. The contractor certifies that no portion of work will be performed at any facility listed on the EPA's List of Violating Facilities at the time of contract award unless the EPA subsequently removes the facility from the list. The FSMC commits to using best efforts to comply with applicable clean air and clean water standards at all performance locations and to incorporate equivalent compliance obligations into any nonexempt subcontracts. The certificate defines key terms including "Clean Air Standards," "Clean Water Standards," "Compliance," and "facility," establishing the scope of environmental regulatory obligations throughout the contract period.
