About this file
This document is an Immediate Jeopardy (IJ) Template used for regulatory compliance assessment and enforcement purposes.
The template is structured around three mandatory components that must all be satisfied to establish an Immediate Jeopardy determination. The first component requires documentation of noncompliance, specifically identifying which federal health, safety, administration, fiscal, and/or quality regulations have been violated. Users must document the specific actions, errors, or lack of action constituting the noncompliance, along with the extent of violations (such as number of affected cases). The second component requires evidence that a serious adverse outcome has either occurred or is reasonably likely to occur as a direct result of the identified noncompliance, including serious injury, serious harm, serious impairment, or death. The third component requires demonstration that the entity must take immediate corrective action to address the noncompliance and prevent or mitigate serious adverse outcomes. All three components connected by "AND" operators must be affirmatively established for an Immediate Jeopardy finding. The template directs users to employ separate IJ templates for each distinct federal regulation under consideration and to provide detailed narrative explanations in designated spaces for each component determination.

Attachment I - Immediate Jeopardy (IJ) Template
IJ Component Yes/No Preliminary fact analysis which demonstrates whether key component exists.
Noncompliance: Has the entity failed to meet one or more federal health, safety, Administration, fiscal and/or quality regulations?
If yes, in the blank space, identify the Federal Regulation and briefly summarize the issues that lead to the determination that the entity is in noncompliance with the identified requirement. This includes the action(s), error(s), or lack of action, and the extent of the noncompliance (for example, number of cases). Use one IJ template for each Federal regulation being considered at IJ level.
