About this file
This document is a Maryland Living Wage Requirements Affidavit of Agreement form, effective July 2024, related to the State of Maryland's procurement for organic landscaping services at the Annapolis Maryland State House. The affidavit establishes compliance requirements for contractors bidding on state contracts subject to Maryland's Living Wage Law under Title 18 of the State Finance and Procurement Article. Contractors must either certify that their contract is exempt from living wage requirements based on specified criteria—including nonprofit status, public service company designation, or contract value thresholds relative to employee count—or affirm their commitment to comply with living wage payment obligations. The form requires contractors to submit the completed affidavit with their bid or proposal.
For contracts subject to living wage requirements, contractors must commit to paying covered employees the applicable living wage rate established by the Commissioner of Labor and Industry for hours spent on state contract activities and ensure subcontractor compliance with the same requirements. Contractors may also affirm they have no covered employees if employees will spend less than half their work week on the contract, are 17 years of age or younger, or will work fewer than 13 consecutive weeks on the state contract. The Commissioner reserves the right to request payroll records and supporting documentation to verify all affirmations at any time.
