About this file

This is an Environmental Resource Permit and Sovereignty Submerged Lands Authorization issued by the Florida Department of Environmental Protection (FDEP) on January 28, 2025, for the City of Cocoa Beach's Cocoa Beach Muck Capping Project located in the Banana River Aquatic Preserve. The permit authorizes the restoration of a large relic borrow pit within the Banana River through placement of approximately 265,000 cubic yards of clean sand over existing muck sediments within a 140.7-acre area, with sand cap thickness varying from 9 to 15 inches. The project also includes creation of two habitat caps totaling 1.6 acres for oyster and mangrove habitat, featuring installation of 8 low-profile oyster habitat modules and planting of 75 black mangrove seedlings and 350 red mangrove seedlings across 2,700 square feet. The permit expires January 28, 2030, and authorizes a total of 140.7 acres of surface water impacts. The City of Cocoa Beach, Authorized Agent Applied Ecology, Inc., is responsible for implementation, with staging at the City of Cocoa Beach Reclamation Facility at 1600 Minuteman Causeway. Specific conditions require baseline monitoring prior to construction, implementation of best management practices for erosion control, turbidity monitoring with zero NTU exceedances above background levels, manatee protection protocols, and comprehensive post-construction monitoring including water quality and sediment analysis quarterly for one year pre-construction and minimum one year post-construction.

The project is funded through the Brevard County Save Our Indian River Lagoon (SOIRL) Project Plan ($21.35 million) and State Appropriations ($12 million), representing the largest capital improvement project within the 10-year, $490 million SOIRL initiative. The permit requires coordination with the U.S. Army Corps of Engineers for separate federal authorization under Section 10 of the Rivers and Harbor Act and Section 404 of the Clean Water Act, and constitutes water quality certification and coastal zone management consistency findings. The permittee must submit construction commencement notices within 48 hours of start, as-built certifications within 30 days of completion, and quarterly monitoring reports detailing water quality parameters including total nitrogen, total phosphorus, dissolved oxygen, pH, and salinity. The permit establishes special conditions for manatee protection, listed species protection, habitat cap success metrics (minimum 33 percent mangrove survival and 10 adult oysters per square meter), and adaptive management requirements. The City of Cocoa Beach must maintain professional liability insurance of $2,000,000 per claim and comply with all Florida Administrative Code rules and chapters incorporated by reference.

Written authorization that requires formal execution by the Board of Trustees of the Internal Improvement Trust Fund shall not be considered received until it has been fully executed.

11. The permittee shall hold and save the Agency harmless from any and all damages, claims, or liabilities that may arise by reason of the construction, alteration, operation, maintenance, removal, abandonment or use of any project authorized by the permit.

12. The permittee shall notify the Agency in writing:

Any delineation of the extent of a wetland or other surface water submitted as part of the permit application, including plans or other supporting documentation, shall not be considered binding unless a specific condition of this permit or a formal determination under rule 62-330.201, F.A.C., provides otherwise.

16. The permittee shall provide routine maintenance of all components of the stormwater management system to remove trapped sediments and debris. Removed materials shall be disposed of in a landfill or other uplands in a manner that does not require a permit under chapter 62-330, F.A.C., or cause violations of state water quality standards.
