About this file

This is a self-certification form for the Indian Health Service Buy Indian Act Indian Economic Enterprise Representation.

The form is used in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations to certify that an offeror meets the definition of an "Indian Economic Enterprise" under 25 U.S.C. 47 and HHSAR 326.601. The enterprise must maintain eligibility status at three critical points: when submitting an offer, at the time of contract award, and throughout the full contract performance period. If at any point the contractor no longer meets eligibility requirements, immediate written notification to the Contracting Officer is mandatory. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. In addition to self-certification, successful offerors must be registered with the System of Award Management (SAM).

The offeror provides a representation stating whether it does or does not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership." Required information includes the name of the Federally Recognized Tribal Entity, the 51% owner of the Indian Economic Enterprise firm, the business name, DUNS number, and a certifying signature with printed name. False or misleading information is subject to penalties under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
