About this file

This is a Technical Specifications document for the construction of a new 10,750 square foot GLS Administration Building and a new 1,900 square foot attached maintenance garage in Massena, New York. The project must comply with the Guiding Principles for Sustainable Federal Buildings and GSA Building Guidelines. The specifications encompass comprehensive divisions covering general requirements, existing conditions, concrete, masonry, metals, wood, thermal and moisture protection, openings, finishes, specialties, equipment, furnishings, fire suppression, plumbing, HVAC, electrical systems, communications, electronic safety and security, earthwork, exterior improvements, and utilities. Key administrative requirements include submittal procedures through web-based project software and electronic document services, preconstruction and progress meetings, construction progress schedules, quality assurance and testing by independent agencies, and special inspections for steel and concrete construction per ICC and AWS standards. The specifications mandate 50% minimum construction waste recycling, VOC content restrictions on interior products and coatings per EPA and SCAQMD standards, temporary facilities including fencing, security, sanitary facilities, and weather protection, and a comprehensive closeout process with operation and maintenance manuals and materials transparency documentation. Commissioning is required for the building envelope, plumbing systems, HVAC systems, electrical systems including uninterruptible power systems, and electronic safety and security systems. The contractor must provide equipment-specific testing tools and calibrated measuring instruments, with dataloggers and independent monitoring equipment supplied by the Commissioning Authority.

SUBSTITUTION PROCEDURES

PART 2 PRODUCTS - NOT USED

PART 3 EXECUTION

2.1 GENERAL REQUIREMENTS

A. With the exception of the fire protection system, whenever a material, article, or piece of equipment is identified on the plans or in the Specifications by reference to manufacturers' or vendor's names, trade names, catalog numbers, or makes, it is identified to establish a standard of quality, performance, and/or basis of design. Such references shall be read as if followed by the words 'or equal'. Equivalent offerings are acceptable and will be approved by the government as long as they meet the standards, salient characteristics, and performance requirements listed within the contract documents.

B. A substitution request for products, assemblies, materials, and equipment constitutes a representation that the submitter:

1. Has investigated proposed product and determined that it meets or exceeds the quality level of the basis of design product, equipment, assembly, or system.

2. Agrees to provide a warranty for the substitution that is equal to or greater than the warranty of the specified Basis of Design product.

3. Agrees to coordinate installation and make changes to other work that may be required for the work to be complete, with no additional cost to the Government.

4. Waives claims for additional costs or time extension that may subsequently become apparent due to the substitution.

5. Agrees to bear all costs associated with independent testing or evaluation required by the Government to prove the proposed substitution meets the specified salient characteristics.

C. Document each request with complete data substantiating compliance of proposed substitution with Contract Documents. Burden of proof is on proposer.

D. Content: Include information necessary for tracking the status of each Substitution Request, and information necessary to provide an actionable response.

E. Limit each request to a single proposed substitution item.

If a substitution request is rejected by the Government, the Contractor shall promptly provide the originally specified Basis of Design product at no additional cost to the Government and without impacting the project schedule, unless the Contracting Officer's Representative (COR) grants written approval to submit a secondary substitution request based on valid, documented extenuating circumstances.

F. Substitution requests must be submitted a minimum of forty-five (45) days prior to the date the material or equipment must be ordered to maintain the project schedule. The Government requires a minimum of ten (10) business days to review substitution requests. Any project delays resulting from late submissions or the time required to evaluate an 'or equal' product are the sole responsibility of the Contractor.

Only the Contracting Officer (CO) or the designated Contracting Officer's Representative (COR) holds the authority to approve substitution requests. Approval will be granted in writing.

G. Substitution requests must be submitted separately from standard product data and shop drawing submittals and must be prominently marked as a 'SUBSTITUTION REQUEST' on the transmittal.
