About this file

This document is a Debarment, Suspension, Ineligibility and Voluntary Exclusion Certification form required by the City of Long Beach for vendors and contractors who may receive federal grant funds. The form certifies compliance with Executive Order 12549 and Title 2 CFR Part 180 Subpart C. Prospective bidders, proposers, and contractors must complete and sign the certification confirming that neither their business entity nor any principals—including owners, directors, partners, officers, managers, or persons with substantial influence over covered transactions—are currently under suspension, debarment, voluntary exclusion, or determination of ineligibility by any federal department or agency. The certification also requires vendors to disclose any suspensions, debarments, voluntary exclusions, or ineligibility declarations that occurred within three years prior to the bid submission, any pending debarment proceedings, any indictments or convictions related to fraud or official misconduct within three years, or any terminations of public transactions for cause or default within three years preceding the agreement.

Vendors must notify the City in writing within 21 days of any reorganization, management turnover, or change in principals' status. The City of Long Beach performs searches on the System for Award Management (www.sam.gov) to verify that awarded consultants and contractors are not debarred or suspended. Prospective vendors are instructed to conduct their own search on this website prior to submission. Any exceptions to the certification must be documented with an attachment indicating the applicable party, initiating agency, and dates of action; exceptions do not necessarily result in denial of award but will be considered in determining bidder responsibility. Providing false information may result in criminal prosecution or administrative sanctions. For questions regarding form completion, vendors should contact the Purchasing Division in the City of Long Beach Business Relations Bureau at 562-570-6200.

Acceptance of Certification

1. This bid/agreement/proposal or like document has the potential to be a recipient of Federal funds.

In order to be in compliance with Code of Federal Regulations, the City requires this completed form. By signing and submitting this document, the prospective bidder/proposer is providing the certification and acknowledgement as follows:

2. The terms “covered transaction,” “debarred,” “suspended,” “ineligible,” “lower tier covered transaction,” “participant,” “person,” “primary covered transaction,” “principal,” “proposal,” and “voluntarily excluded,” as used in this clause, have the meanings set out in the Definitions and Coverage sections of rules implementing Executive Order 12549.

3. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective recipient of Federal assistance funds knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

4. The potential recipient of Federal assistance funds agrees by submitting this bid/agreement/proposal or like document that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.
