About this file

This is a Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, issued by the Internal Revenue Service in August 2016. It is a template form used to document tax exemption claims for foreign contractors receiving federal procurement payments under Section 5000C.

The form requires identification of the foreign contracting party, including legal name, country of incorporation, permanent residence address, mailing address, U.S. taxpayer identification number if applicable, and contract reference number. Part II allows contractors to claim relief from Section 5000C tax pursuant to an international agreement, such as a qualified income tax treaty. Part III provides exemptions based on international procurement agreements or because goods and services are produced or performed in the United States, requiring disclosure of total contract price, nonexempt amounts, and the contract ratio. The contractor must specify exempt and nonexempt amounts by contract line item if applicable. Part IV requires explanation of the basis for claimed exemptions, including identification of relevant countries where goods are manufactured or services provided and applicable international procurement agreements. Part V contains certification language requiring the foreign person or authorized representative to sign under penalties of perjury, certifying identity, that they are not acting as an agent or nominee, agreement to pay any tax and penalties owed, understanding of Section 5000C procedural obligations, and that no transactions were undertaken with the principal purpose of avoiding Section 5000C taxes. The form is submitted to the acquiring agency, not the IRS.
