About this file
Form W-14 is an Internal Revenue Service certificate used by foreign contracting parties receiving federal procurement payments. This form, issued by the Department of the Treasury in August 2016 (OMB No. 1545-2263), is submitted to the acquiring agency—not the IRS—to document tax exemption status or relief entitlements.
The form consists of five parts: Part I requires identification information including the foreign contracting party's name, country of incorporation, permanent residence address, U.S. taxpayer identification number if applicable, and the acquiring agency's details. Part II addresses exemptions based on international agreements under Internal Revenue Code section 5000C, requiring the filer to identify the specific agreement and provision claimed. Part III covers exemptions based on international procurement agreements or goods/services produced or performed in the United States, requiring disclosure of the total contract price, nonexempt amounts, and the contract ratio. Part IV provides space for detailed explanations regarding the basis for exemption claims, including the countries where goods are manufactured or services performed and allocation methods between exempt and nonexempt contract amounts. Part V contains certification language requiring the foreign person's signature under penalties of perjury, affirming identity, non-agency status, tax payment obligations, understanding of procedural requirements, and absence of tax avoidance schemes. The filer must indicate capacity to act and provide the signature date.
