About this file
This is a Solicitation Terms and Conditions attachment for an Invitation for Bids (IFB No. 027-003) issued by Prince George's Community College (PGCC) in Maryland for printing and distribution services of the College's noncredit class schedules. The IFB seeks qualified bidders to print and deliver the Spring, Summer, and Fall issues of the College's Schedule of Classes in accordance with specified requirements. Bids must remain irrevocable for 120 days following the bid due date, and the College reserves the right to accept or reject any or all bids in whole or in part, make one or multiple awards, or make no award at all. The College may increase or decrease quantities of materials and services as needed. PGCC issues payments on a net 30-day basis for approved invoices, with payment calculated in arrears and late payment interest determined according to Maryland law.
Contractors must maintain comprehensive insurance coverage including General Liability with a $3,000,000 aggregate limit, Products/Completed Operations coverage of $1,000,000, Auto Liability of $1,000,000, Excess/Umbrella Liability of $2,000,000, and Workers' Compensation at statutory minimums, with all policies issued by insurers rated A-VII or better by A.M. Best's. Certificates of Insurance naming PGCC and the Prince George's College Board of Trustees as additional insureds must be filed within 30 days prior to award. The selected contractor will be solely responsible for all services and must identify any subcontractors, with PGCC strongly encouraging the use of local minority business enterprises (MBEs). Contractors must comply with Maryland Public Ethics Law, avoid conflicts of interest, and confirm they are not in arrears on any obligations to the College. All written bid materials become PGCC property and may be appended to formal contract documentation.

If in doubt, develop and submit applicable questions in writing to the contact at the Issuing Office. A Bidder’s misinterpretation of requirements shall not relieve the Bidder of the responsibility to address accurately the requirements of the IFB or to perform the Contract, if awarded.
B. PGCC will enter into a contractual agreement with the selected Contractor(s) only. The selected Contractor(s) shall be solely responsible for all services as required by this IFB. Subcontractors, if any, will be the responsibility of the Contractor(s) and the role of subcontractors must be clearly identified in the Bid. C. The College reserves the right to increase or decrease the quantities of any materials, equipment, supplies or services.
3. CANCELLATION OF THE REQUEST FOR BIDS
PGCC may cancel this IFB, in whole or in part, at any time.
4. INCURRED EXPENSES
PGCC shall not be responsible for any expenses that Bidders may incur in preparing and submitting Bids or in making oral presentations of their Bids, if required.
5. PAYMENT
The College issues payments on a net 30-day basis for PGCC approved invoices.
Payment provisions shall be in arrears, with late payment and interest calculated as provided by Maryland law. For purposes of determining whether a prompt-payment discount, if applicable, may be taken by PGCC, the starting date of such reckoning period shall be the later of the date of a properly executed invoice or the date of completion of service and/or delivery of product.
6. CONFIDENTIALITY
A. PGCC’s Information During the Procurement Process:
1. The selected Contractor may have access to, may obtain, or be given confidential information, including without limitation information concerning the College’s business strategies, political and legislative affairs, students, faculty, employees, vendors, contractors, customer lists, finances, properties, methods of operation, computer and telecommunication systems, and software and documentation.

2. Bidders are advised that, upon request for this information from a third party, the Procurement Officer is required to make an independent determination as to whether the information may or may not be disclosed to the requesting party. That decision will take into consideration the Bidder’s position regarding its Bid. A blanket statement by a Bidder that its entire Bid is confidential or proprietary will not be upheld.
