About this file

This is an attachment to a Request for Proposals (RFP 200000001437) issued by the Maryland Department of Transportation (MDOT) establishing drug and alcohol testing requirements for contractor employees performing safety-sensitive functions. The contractor must establish a comprehensive drug and alcohol testing program that includes five types of testing: pre-employment, random, reasonable suspicion, post-accident, and return-to-duty/follow-up testing. Any employee who tests positive shall be immediately suspended and/or dismissed, and no employee may return to work without approval from the Contract Administrator. These requirements are mandated under the Omnibus Transportation Testing Act signed into law on October 28, 1991, and the subsequent regulations published by the Secretary of Transportation.

The contractor is responsible for all costs associated with drug and alcohol testing and will not be reimbursed by MDOT for these expenses. Pre-employment testing costs shall be included in the mobilization line item, while all other testing costs shall be incorporated into the "Bridge Operation, In Season" line item. No specific pricing amounts, award dates, contract terms, or renewal options are detailed in this attachment, as it functions as a contractual requirement specification rather than a pricing or timeline document.

ATTACHMENT A-IV

DRUG AND ALCOHOL TESTING

The Omnibus Transportation Testing Act was signed into law on October 28, 1991. The Secretary of Transportation subsequently published Regulations for alcohol and controlled substance testing of persons in the transportation industry who perform safety sensitive functions as described by the Act.

Since MDOT considers this as a safety sensitive function, the Contractor shall establish a drug and alcohol program for his/her employees that includes the following types of drug and alcohol testing:

1.Pre-Employment
2.Random
3.Reasonable Suspicion
4.Post-Accident
5.Return to Duty/Follow-Up

Any employee who tests positive shall be immediately suspended and/or dismissed. No employee will be allowed to return to work without the approval of the Contract Administrator.

The contractor will not be reimbursed for any drug or alcohol testing. Pre-Employment testing shall be considered included in the item for Mobilization. All other testing shall be considered included in the item: “Bridge Operation, In Season”.
