Authorization & Certification Form for City of Long Beach Proposals

This is an authorization and certification attachment form for the City of Long Beach used in Request for Proposals (RFP) processes. The document establishes signatory requirements and compliance certifications that proposers must complete to submit a valid bid. Signature requirements vary by business entity type: individuals operating as sole proprietors require one owner signature; partnerships require signatures from general partners; corporations require two officer signatures or one officer/authorized person signature with certified corporate resolution; and limited liability companies require one member or manager signature. Proposers must certify they have read and understand all RFP terms and conditions, agree to comply with the City of Long Beach Vendor Code of Conduct, submit firm and fixed proposals valid for 90 days from the submission deadline, and have uploaded all required documentation correctly to the Long Beach Buys system. The proposal must be genuine and not collusive, with no conflicts of interest in selection, award, or administration.

The form includes comprehensive federal debarment and suspension certifications required because proposers may receive federal grant funds through their business relationship with the City. Proposers must certify under penalty of perjury that they and their principals are not currently suspended, debarred, or ineligible by any federal department or agency, have not been suspended or debarred within three years preceding the proposal, do not have proposed debarment proceedings pending, have not been indicted or convicted of fraud or official misconduct within three years, and have not had public transactions terminated for cause or default within three years. The form requires written notice within 21 days if reorganization, management turnover, or changes in principals' status occur. Proposers unable to certify to any statement must attach an explanation. The document also includes a section for proposers to document exceptions to terms and conditions, though the City notes such exceptions are uncommon and not encouraged, with the City retaining the right to accept or reject any exceptions and to withdraw the RFP if contract negotiations cannot be concluded successfully.

EXCEPTIONS TO TERMS AND CONDITIONS (IF APPLICABLE)

Exceptions to terms and conditions are uncommon, and Proposers are not encouraged to take exception to terms and conditions. However, in the event there are terms that should be reviewed as part of potential negotiation of a final contract, they should be listed here. The City of Long Beach has no obligation to accept any exceptions to terms and conditions. Any award is contingent upon the successful negotiation of final contract terms. If contract negotiations cannot be concluded successfully, the City reserves the right to negotiate a contract with another
