Any information (classified or unclassified) pertaining to this contract shall not be released for public dissemination except as provided by the National Industrial Security Program Operating Manual (NISPOM) or unless it has been approved for public release by appropriate U.S. Government authority. 13. SECURITY GUIDANCE
The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract; and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

| text: Re: 10e., 10j., 10k., 11a.: The contractor will work on-site at HHS/ASPR, O'Neill Open Storage Secret area (OSS) and require access into the HHS/ONS SCIF to review, discuss and receive national security classified information up to the Top Secret/SCI level to perform their contract obligations. |
1. Contractor shall abide by the instructions and procedures outlined in the Health & Human Services Security Classification Guide, October 16, 2015. Classification guide pertaining to the security guidance is provided under separate cover. 2. Classified information shall only be disclosed to individuals who have an official need to know for the performance of the contract and who have a security clearance at least equal to or higher than the classification of the information involved. 3. Classified information provided pursuant to this contract shall be marked by recipient with government's equivalent security classification and IAW Information Security Oversight Office (ISOO), Marking Classified National Security Information, dated December 2010, Revision 4, January 2018. 4. Incidents shall be reported promptly and fully in accordance with National Regulations to the relevant ASPR cognizant Program Security Representative (PSR) or STAFF/OP Div Classification Security Officer (CSO) responsible for supporting this contract when it is known or there is a reason to suspect that CLASSIFIED information provided in pursuant of this contract has been lost or disclosed to unauthorized persons The ASPR PSR/CSO will be responsible for reporting all incidents to the Office of National Security (ONS). 5. Former categories of Official Use Only (FOUO) and Sensitive But Classified (SBU) information will be handled as Controlled Unclassified Information (CUI). The contractor shall abide by ISOO policy regarding CUI information and the handling of this type of information. A document explaining this concept is also provided for under separate cover. 6. Any information owned by HHS will not be disclosed to outside Federal Agencies without the consent of HHS. 7. Providing classified information to another contractor or subcontractor is strictly forbidden unless written consent is obtained from the ASPR Director of Security Team of ASPR or with the ONS. 8. The Contractor does not have classified information retention authority. All classified information and CUI material provided or generated under this contract will continue to be protected in the event of termination of the contract in accordance with national regulations. 9. Assigned contract personnel will comply with agency’s security training requirements and Security Executive Directive Agent (SEAD) 3 reporting requirements. Assigned personnel must complete initial and annual refresher training on the basic responsibilities to protect collateral and or SCI information, and complete derivative classification training as required by ONS, and as disseminated by ASPR PSR/CSO. 10. Contract employees will comply with ISOO guidance on marking classified products and will report yearly totals of newly created derivative products to ASPR PSR/CSO for subsequent reporting ONS. 11. Contract personnel will comply with EO 13526 guidance on classifying, safeguarding, and following the government agency's guidance for routing material for declassifying. 12. Contract personnel will comply with EO 12333 on U.S. Intelligence activities and EO 12968 when there is a need for individuals to have access to classified information.
The contract security official is required to notify ONS Personnel Security Division when a contractor’s eligibility for a security clearance has been removed or when company is in receipt of adverse information on personnel assigned to this contract. The contract security official is responsible for initiating contractor’s re-investigation as mandated by national security guidelines. The contract security official is responsible for notifying ONS Personnel Security Division when contractors are no longer assigned with the company and will submit annual visit authorization requests (VARs) of assigned personnel on this contract to ONS Personnel Security Division at: PersonnelSecurity@hhs.gov.
The contractor will remain within strict compliance of the inter-agency agreement between the Department of Defense and the Department of Health and Human Services in abiding by the directives in the National Industrial Security Program Operations Manual (NISPOM).
