About this file
This document is a Darfur Contracting Act Certification form issued by the State of California Department of General Services Procurement Division (Form DGS PD 1, Rev. 12/19). The certification applies to companies that have conducted business activities or operations outside the United States within the previous three years and seek to bid on or submit proposals for State of California contracts. Companies without international business activities within the three-year period are exempt from this requirement. The form provides two certification options for eligible companies to demonstrate compliance with Public Contract Code Sections 10475-10481.
Option #1 requires companies to certify under penalty of perjury that they are not a scrutinized company as defined in Public Contract Code Section 10476 and that the signing official is duly authorized to legally bind the prospective proposer or bidder. Option #2 applies to scrutinized companies that have obtained written permission from the Department of General Services to submit a bid or proposal pursuant to Public Contract Code Section 10477(b), which permits the DGS Director to approve such companies on a case-by-case basis if it is in the best interests of the state. Companies selecting Option #2 must include a copy of the written DGS permission with their bid or proposal. Both options require the company or vendor name, Federal ID number, authorized signature, printed name and title of the signing official, and date.
