About this file
This document is a Commercially Useful Function (CUF) Evaluation and Determination Worksheet used by state and local agencies to assess whether certified Small Businesses (SB) and Disabled Veteran Business Enterprises (DVBE) meet CUF compliance requirements prior to contract award. The worksheet must be completed for each certified SB and/or DVBE identified on the Bidder Declaration, whether serving as a prime contractor or subcontractor. The evaluation applies to any portion of a contract where these entities will perform work or provide goods and services as described in the scope of work.
The worksheet evaluates five core CUF compliance criteria: whether the supplier is responsible for executing a distinct element of work; whether the supplier actually performs, manages, or supervises the work rather than merely serving as a pass-through entity; whether the work is normal for the supplier's business services and functions; whether the supplier takes responsibility for negotiating price, determining quality and quantity, ordering, making payment, and installation (if applicable) for any goods or materials involved; and whether the supplier is not subcontracting a greater portion of work than is normal by industry standards. The evaluator must provide supporting documentation for each assessment and indicate yes or no responses for all five criteria. CUF compliance is determined only when all five questions receive affirmative responses or "N/A" designation; any single "no" response results in non-compliance determination. The note emphasizes that SB and DVBE certification alone does not constitute CUF compliance and that evaluation must occur for each specific contract prior to award.
