About this file

This document is an Addendum to FAR 52.212-1 and evaluation procedures for a Request for Quote (RFQ) solicitation HTC71126QE130 for commercial products and services. Quotes must be submitted electronically by 6:00 AM Central Time on April 27, 2026, in three separate volumes: Business Proposal (Attachment 4), Technical Proposal (Attachment 5), and Price Proposal (Attachment 3). Quoters must maintain an active System for Award Management (SAM) registration prior to submission, during performance, and through final payment. The price quote must remain firm for 90 calendar days from the receipt date, and the Government intends to award a single purchase order based on lowest evaluated price among proposals with acceptable business and technical factors.

Evaluation will proceed through a structured process: Business Volumes receive Acceptable/Unacceptable ratings; proposals with acceptable business ratings are sorted by Total Evaluated Price (TEP) using the D2S2 Pricing Matrix; the lowest-priced proposal is evaluated for technical capability; if technically acceptable and pricing is determined fair and reasonable through FAR 12.201-1 procedures, a responsibility determination is conducted per FAR 9.104-1; if these factors are met, award is made without further consideration of other quotes. If the lowest-priced offeror is found unacceptable technically or non-responsible, evaluation continues with the next lowest-priced proposal. The Government reserves the right to make no award, reject any or all offers, and may request additional information or revised quotes from selected or all offerors at the Contracting Officer's discretion, ensuring equitable treatment. Formal communications and clarification requests must be submitted in writing via email to the identified Contract Specialist and Contracting Officer no later than 10 calendar days before the quote due date.

FAR 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(DEVIATION) (FEB 2026)

FAR 52.212-2 is tailored as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

A. FACTOR 1: BUSINESS PROPOSAL

The Government will evaluate all items listed on the Business Proposal Worksheet (Attachment 4) on an

Acceptable/Unacceptable basis as defined below. To be rated Acceptable, the proposal must include all documents and information as required by FAR 52.212-1 of the solicitation and associated Addendum.

Additionally, the Offeror must have a current registration in the System for Award Management

(www.sam.gov) at the time of proposal submission.

Rating Definition

Acceptable Business volume meets the minimum requirements of the solicitation.

Unacceptable Business volume does not meet the minimum requirements of the

B. FACTOR 2: TECHNICAL

The Government will evaluate all items listed on the Technical Capability Worksheet (Attachment 5) on an Acceptable/Unacceptable basis as defined below. Proposals with an “Unacceptable” technical capability proposal rating will not be considered for award.

The Technical Capability Worksheet (Attachment 4) includes questions that require detailed narrative responses. Answers that simply restate the requirements outlined in the Government’s Performance

Work Statement (PWS) or use generic phrases such as “will comply” or “standard techniques will be employed” will be deemed Unacceptable.

Rating Definition

Acceptable Technical volume meets the minimum requirements of the solicitation.

Unacceptable Technical volume does not meet the minimum requirements of the

C. FACTOR 3: PRICE

The Government will evaluate the price listed on the Pricing Matrix (Attachment 3) on a Fair and

Reasonable/Not Fair and Reasonable basis as defined below. Proposals with a “Not Fair and

Reasonable” price proposal rating will not be considered for award.

Per FAR 12.201-1, Simplified Procedures, the contracting officer has broad discretion in fashioning suitable evaluation procedures. The procedures prescribed in FAR parts 14 and 15 are not mandatory.

At the contracting officer’s discretion, one or more, but not necessarily all, of the evaluation procedures in part 14 or 15 may be used.

The Government will evaluate the monthly rates for the base period and all option periods, including the six-month extension, in addition to the Total Evaluated Price (TEP), in making a fair and reasonable determination. Pricing for the six-month extension of services period will be based on half (1/2) the proposed price of the final option period. Offerors shall not submit a price for the optional six-month extension of services since the pricing spreadsheet will automatically populate the total. Evaluation of options will not obligate the Government to exercise the option(s).

The total cost for each Contract Line Item Number (CLIN) is calculated by multiplying the monthly rate by the number of months.

The TEP is a summation of the total cost for each CLIN.

(c) A written notice of award or acceptance of an offer, electronically delivered or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Paragraph (d) is added as follows:

(d) Basis for purchase order award - This acquisition is being conducted under FAR Part 12, Acquisition of Commercial Items of the Federal Acquisition Regulation (FAR). Quotes will be evaluated using the factors identified in FAR 52.212-2, Evaluation – Commercial items and this addendum. Noncompliance may be grounds to eliminate the quote from consideration for purchase order award. Award will be made on the basis of lowest evaluated price of the quote and whose business and technical factors are rated

“Acceptable.” The evaluation process shall proceed as follows:

The Government will review each Business Volume (Attachment 4) and assign a rating of "Acceptable" or "Unacceptable." Proposals with an "Acceptable" Business Volume will then be sorted from lowest to highest Total Evaluated Price (TEP) using the D2S2 Pricing Matrix (Attachment 3). The proposal with the lowest TEP will be evaluated for Technical Capability and assigned a rating of "Acceptable" or

"Unacceptable." If the proposal with the lowest TEP is rated "Unacceptable" for its Technical Volume, the next lowest TEP proposal will be evaluated.

The lowest-priced proposal with an "Acceptable" Technical Volume will undergo a price evaluation to determine whether the proposed price is fair and reasonable, in accordance with FAR12.201-1, Simplified

Procedures.

If the lowest-priced proposal is determined to have fair and reasonable pricing, the Government will conduct a responsibility determination in accordance with FAR 9.104-1. If the offeror is deemed responsible, the evaluation process will conclude, as this proposal represents the best value to the

Government. The award will be made to that offeror without further consideration of other quotes.

If the lowest-priced offeror’s price is not deemed fair and reasonable or if the offeror is found non-responsible, the next lowest-priced proposal will be evaluated. This process will continue until a proposal is identified as having an "Acceptable" Technical Volume, fair and reasonable pricing, and the offeror is deemed responsible—or until all quotes have been evaluated.

The Government reserves the right to make no award if the submitted quotes do not meet quality standards or if funding is unavailable for the requirement. The Government intends to evaluate quotes and award a single Firm Fixed Price Contract without requesting or accepting revised quotes. Therefore, offerors are advised to submit their initial quote with the most favorable terms and best performance potential.

Contracting Officer Discretion:

The Contracting Officer may request additional information or revised quotes at any time during the evaluation process. Such inquiries may be directed to all, none, or selected offerors, as necessary.

However, the Contracting Officer will ensure that all offerors are treated fairly and impartially, in accordance with FAR 1.102-2(c)(3).
