DETERMINATION AND FINDINGS

LIQUIDATED DAMAGES

Project Title: Install Lift Station Generators (French Cr, Moose Lake, Glacier) Number: FTQW 23-1400

All of the factors contained in FAR Subpart 11.5 were considered in determining whether it is appropriate to include Liquidated damages in the above-mentioned solicitation and subsequent contract.

FINDINGS

Delay of the completion of the project is expected to increase the cost to maintain the project office by requiring additional time and labor from Civil Engineering, Contracting, as well as Legal Assistance from the Staff Judge Advocate.

The below chart provides details on the effort anticipated to be incurred by the government should this project be delayed. Pursuant to FAR 11.502(b) and AFI 65-503, the estimated cost to maintain the project office, for which the Liquidated Damages Clause is being applied, would be as follows:
