About this file
This document is a Brand Name Justification for a Firm-Fixed-Price Blanket Purchase Agreement (BPA) to procure Cisco and Poly video teleconferencing (VTC) equipment on behalf of the Department of Homeland Security (DHS) U.S. Immigration and Customs Enforcement (ICE) Office of the Chief Information Officer (OCIO).
The BPA will provide a turn-key solution for ICE's multimedia needs, including the design and installation of four different sizes of VTC rooms to enable real-time remote meetings. Only Cisco and Poly manufacture the required products, so this justifies a brand name procurement not subject to full and open competition. The individual BPA calls shall not exceed $7.5 million. ICE intends to post the requirement and seek authorized resellers or channel partners to maximize competition where possible, but the ICE IT infrastructure is currently limited to supporting only Cisco and Poly VTC equipment. The justification certifies the requirement meets the government's minimum needs and the data supporting the use of other than full and open competition is accurate.

OFFICE OF ACQUISITION MANAGEMENT
ICE Acquisition Manual 3006.301-90
BRAND NAME JUSTIFICATION: SIMPLIFIED PROCEDURES FOR CERTAIN
COMMERCIAL ITEMS EXCEEDING SAT
J&A-24-0057
In accordance with the procedures of FAR Subpart 13.5, using the statutory authority of 41 USC 1901, and consistent with the content requirements of FAR 6.303-2, this justification is based on the following facts and rationale:
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS) U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), proposes to award a single award Blanket Purchase Agreement (BPA) on behalf of the Office of the Chief Information Officer (OCIO), Infrastructure Project Services Branch (IPSB) on a basis of other than full and open competition.
2. Nature and/or description of the action being approved.
(a) Type of action: Firm-Fixed-Price (FFP) BPA
(b) Amount the current Brand Name Justification is justifying:
The individual BPA calls shall not exceed $7.5 million in accordance with FAR Subsection
13.500 (a).
Brief Description: ICE/OAQ intends to procure brand name Cisco and Poly Video Teleconference (VTC) products that will provide a turn-key solution for ICE’s multimedia needs.
The only companies that manufacture the products required are listed below.
Cisco Systems, Inc.
300 East Tasman Dr.
San Jose, CA 95134
Poly Worldwide Headquarters 345 Encinal Street Santa Cruz, California 95060
3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).
This Brand Name Justification will only cover a portion of this acquisition which requires brand name Cisco Room and Poly Studio Series endpoints. ICE has a repetitive requirement for the acquisition and installation of video teleconferencing equipment. The contractor is required to provide the design and installation of four (4) different size (small, medium, large, and extra-large) rooms to meet ICE’s VTC needs. ICE utilizes VTC to conduct real-time face-to-face meetings as an alternative to in-person meetings. This allows for detention facilities, and immigration courts to hold meetings without having to travel or transport detainees. The equipment must provide integrated secure multi-platformed video conferencing hardware and software applications to extend ICE’s ability to effectively communicate from both centralized and remote end-user locations. The equipment acquired must be compatible and capable of registering with ICE IT infrastructure.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.
To remove or overcome barriers to competition, ICE/OAQ will work with the Program Office to perform additional market research and consider other VTC products/solutions for future needs.
Consideration of other products requires in depth testing, vetting and approval prior to obtaining authority to operate within the ICE IT infrastructure. ICE will need to commit to changing the hybrid infrastructure that currently only supports Cisco and Poly VTC equipment.
The infrastructure of the ICE/OCIO/Video Operations Services (VOS) system is not likely to change soon. However, OAQ will be seeking authorized resellers or channel partners of Cisco and Poly VTC products to maximize competition.
12. DHS intends to post the requirement pursuant to FAR 13.501(a)(1)(iv) and 5.102(a)(6).
13. Technical/Requirements Personnel Certification.
I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
14. Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is
Head of Contracting Activity Date
Note: The Head of Contracting Activity (HCA) is the final approving official when the action is equal to or exceeds $15M but is less than $75M.
