52.212-2 EVALUATION--COMMERCIAL ITEMS (NOV 2021)

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

ADDENDUM TO FAR 52.212-2:

Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price.

By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation. The evaluation criteria are detailed below:

Factor 1 – Price. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the low quote for a higher quality item.

Factor 2 – Technical. The purpose of the technical factor is to assess whether the vendor’s quoted item meets all of the provided information from the Performance Work Statement Attachment. Each vendor’s quote will be evaluated against technical requirements and will be assigned a rating of “acceptable” or “unacceptable.” Technical submission must be completed using a secondary document. The Technical information shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Proposals shall provide convincing rationale addressing how the technical portion of the offer meets solicitation requirements. Offerors shall assume the Government has no prior knowledge of the offeror’s experience. The Government will base its evaluation on the information presented in the offer.

Rating Description:

“Acceptable” - Quote clearly meets the minimum requirements of the solicitation.

“Unacceptable” - Quote does not clearly meet the minimum requirements of the solicitation.

The quote will be determined technically acceptable if it meets the requirements set out in the Attachment 1 - Performance Work Statement.
