Rhode Island Department of Health (RIDOH) regulates the Newport Potable Water infrastructure under Permit #1000016 as a Class 2 distribution waterworks. Fort Adams is a separately licensed system (PWS 1900046). In 2019 Naval Station Newport provided RIDOH with a Corrosion Control Evaluation of the Water Supply and Distribution System. The Navy is currently managing a follow-on environmental study related to water system lead service investigations and inventory.

The sewage system is operated under Industrial User Permit NPT-0016 issued by the City Of Newport. This permit includes requirements for sampling, pretreatment (e.g. amalgam separator, Oil Water Separators [OWS], food services grease removal, grease interceptors, grease recovery devices and lime traps) and accidental/slug control associated with facilities assets that are not intended for transfer.

Many of the assets identified for transfer are confined spaces.

The following facilities were determined NOT ELIGIBLE for the National Register (with the year determination was made):

315 CP (1995), 62 MEL (2008), 31 MEL (2008), 158 CHI (2020), 170 CHI (2020), 338 CP (2020), 361 CP (2020), 74 CC (1998), 68 NH (2020), 399 CP (2020). Architectural Survey Update completed in 2017 covered years 1946-1968.

1.R. There are multiple locations across Naval Station Newport where water and wastewater infrastructure is contained within or adjacent to environmental restoration sites undergoing investigation and/or remediation for contaminants. TextField1: B. Naval Station Newport (formerly Naval Education & Training Center) is a National Priorities List (NPL) site for various areas of contamination or interest (AOCs/AOIs) or sites. These AOCs/AOIs/sites are being studied and/or cleaned up under the Navy's Environmental Restoration Program in accordance with the Comprehensive Environmental Response Compensation and Liabilities Act (CERCLA). In some instances, the project site(s) traverse the AOCs/AOIs/sites. Site conditions are described in the Administrative Record for Naval Station Newport at:

https://administrative-records.navfac.navy.mil/?J46XTU3VG4WHG7LKJ

Personnel that disturb or contact either soils or groundwater in an AOC/AOI/Site must complete 40 hours of training and be HAZWOPER certified in accordance with OSHA's 29 CFR 1910.120 Hazardous Waste Operations and Emergency (HAZWOPER) regulations.

CERCLA LUCs are in place at the following sites:

Site 1 (McAllister Landfill) Site 7 (Tank Farm 1) Site 8 NUWC Pond area) Site 9 (OFFTA ) Site 10 (Tank Farm 2) Site 11 (Tank Farm 3) Site 12 (Tank Farm 4) Site 13 (Tank Farm 5) Site 19 and Site 4 (Derecktor Shipyard and the old Coddington Cove Rubble fill area) Site 23 (Coddington Point)

The above sites prohibit disturbance of soil and prohibit ground water use. These areas are all depicted on the maps provided.

See Enclosure (1) local instruction 5090.15D Land Use Restrictions for Environmental Restoration Program Sites and Other Contaminated Properties for a full list of contaminated sites that do not have formal LUCs being addressed under CERCLA, TSCA and RIDEM regulations.

Local instruction 5090.15 has not yet been updated to include the following new sites:

Site 24 (Defense Fuel Support Point), Site 25 (Coddington Cove Fire Fighting Training Areas, Site 26 (Bldg. 48 MEL Fire Station, Site 27 (Building 55 CHI Fire Station), Potential new sites identified in the Preliminary Assessment Per- and Polyfluoroalkyl Substances (PFAS) NAVSTA Newport, Rhode Island of 23 March 2018; and Potential new sites identified in the Preliminary Assessment (PA) Basewide Evaluation Munitions Response Program (MRP) of May 2022 for Naval Station Newport RI.

Limited, if any, intrusive activities or groundwater use are expected in conjunction with the condition assessment associated with the proposed action. Any intrusive activities must be approved by and coordinated with the Environmental Restoration Program Manager and PWD Newport Environmental Office and all work coordinated in accordance with Enclosure (1) and applicable HAZWOPER requirements as indicated above. All work must adhere to Naval Station Newport's Soil Management Plan which requires the top 2 feet of soils to be replaced with clean fill due to elevated levels of arsenic. CERCLA sites that have an approved arsenic background investigation as part of the site cleanup do not follow Naval Station Newport's Soil Management Plan.

E. Transfer of USTs must comply with 250-RICR-140-25-1.18 in order for RIDEM concurrence for the transfer.

Sewage Lift Station and Pumphouse 75 (UST 125) are inside the NUWC fenceline at Stillwater Basin and require badge to activate gate for access.

F. Since the sum of ASTs is greater than 500 gallons cumulative, new owner must register tanks with RIDEM and comply with 50-RICR-140-25-2 .

There are other above ground storage containers throughout the water and wastewater asset inventory, however those containers do not meet the definition of a tank (>55g) and are therefore, not included in this inventory.

Sewage Lift Station and Pumphouse 75 (AST 75A DT) are inside the NUWC fenceline at Stillwater Basin and require badge to activate gate for access.

CULTURAL RESOURCES

The following facilities require evaluation to determine if they are eligible for the National Register are as follows:

48 CC, 448 FA, 694 MID, 820 MEL, and 987 MEL.

A survey must be performed to determine eligibility and submitted to the State Historic Preservation Officer (SHPO) for their concurrence. The change of ownership of a property eligible for the National Register from federal to private is considered an adverse effect because of the Historic Preservation Act requirements for federal agencies.

The following buildings with the year they were built require HABS for cultural significance and submitted to the SHPO for their concurrence as follows:

694 MID (1972); and 987 MEL (1970).

ARCHAEOLOGICAL RESOURCES

Archaeological sites cannot be disturbed.

There are relatively few known archaeological resources within NAVSTA Newport property, although the lower Narragansett Bay area does have a rich archaeological record. The relative scarcity of archaeological resources within the NAVSTA Newport property is generally attributable to the intensive landscape alteration that has occurred with expansion of naval facilities since the late nineteenth century. The 2014-2018 Integrated Cultural Resources Management Plan shows 3 sensitive and 5 recorded archaeological areas. The sensitive areas are H-2 CHI, H-4 CP and H-5 CC. The recorded areas are RI 2492 FA, RI 2462 MEL, RI 2519 MID, RI 0942.1 MID, and RI 2520 MEL. The plan also shows 2 recorded sites near but not on Navy property that are RI 0942.2 MEL and RI 0942.3 MEL. See enclosure (4) map which shows archaeological/historical sites.

P. Intrusive activities adjacent to 694 or 820 MEL may require additional coordination with the PWD Environmental office.

Q. Additional Information:

Regardless of permit transfer status, regulatory compliance roles and responsibilities between the Navy and subsequent new owner of water and wastewater infrastructure will be defined upon transfer and will likely include sampling or maintenance or other activities at facilities or other locations not owned by the other party.

Confined Spaces:

Confined space entry requires Gas Free Certificate from a Marine Chemist (or other authorized safety professional)
