Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Text3: Alternative generator manufacturers would require service providers located approximately two to three hours from the hatchery. During emergency conditions, particularly severe weather or regional power outages, these travel distances would significantly delay repairs and restoration of backup power. Extended outages could result in loss of water supply to fish production units, leading to substantial mortality of federally managed fish stocks, interruption of production schedules, and failure to meet stocking commitments supporting Great Lakes fisheries restoration.
Text2: Market research was conducted to identify manufacturers of industrial standby generators and the availability of factory-authorized service providers capable of supporting equipment at the Allegheny National Fish Hatchery. The research determined that Caterpillar (CAT) is the only manufacturer with a certified service provider located within the local area. Certified service providers for other major generator manufacturers are located approximately two to three hours from the hatchery, resulting in significantly longer emergency response times.

The proximity of a local CAT-certified service provider is a critical operational requirement, not a matter of convenience. The hatchery relies entirely on electrically powered groundwater wells to provide continuous water flow to production raceways and tanks supporting Lake Trout reared for the Great Lakes restoration program.

During a commercial power outage, the standby generator must operate reliably to maintain uninterrupted water delivery. If the generator experiences a mechanical or electrical failure, immediate access to factory-certified technicians is essential to diagnose and restore the unit to service. Delays of several hours while technicians travel from distant locations could result in prolonged interruptions to the water supply, leading to declining dissolved oxygen levels, degraded water quality, and potentially catastrophic fish mortality.

The brand-specific requirement is based solely on the demonstrated need for immediate access to a local factory-certified service provider, whose proximity is essential to ensure rapid repair and restoration of backup power during utility outages.
