About this file

This document is a letter from the Greater Hartford Flood Commission to the Materials Innovation and Recycling Authority (MIRA) regarding emergency action planning compliance for the Hartford Flood Protection System, dated May 10, 2022. The City of Hartford is requesting MIRA's cooperation and assistance in developing an updated Flood Control Levee System Emergency Action Plan (EAP) that complies with current United States Army Corps of Engineers (USACE) guidance and Connecticut Department of Energy and Environmental Protection (DEEP) Dam Safety Division requirements. The letter identifies 14 major levee penetration categories at the MIRA facility ranging from 8-inch steel oil lines to 48-inch intake and discharge pipes, along with numerous ancillary structures and utilities. MIRA is obligated under federal regulations (33 CFR 208.10, 44 CFR 65.10) and state law to maintain operation and maintenance manuals, inspection protocols, and emergency preparedness plans for infrastructure directly impacting the flood control system. The document references inspection records and photographs from 2021 conducted by Fuss & O'Neill Inc., detailing conditions of specific penetrations and identified deficiencies requiring remediation.

The letter emphasizes critical concerns regarding MIRA's planned facility decommissioning in 2022 and the associated transition of infrastructure maintenance responsibilities. Required actions include conducting quarterly visual inspections and gate valve operations, annual inspections of all structures, and periodic 5-year CCTV or physical inspections documented per USACE EM 1110-2-2902 standards. MIRA must develop an Emergency Preparedness Plan addressing operational protocols during flood events, including procedures to isolate levee penetrations. The City requires continued 24/7 Department of Public Works access to operate and maintain levee systems and closure structures. Decommissioning activities require removal of all non-essential site features within the levee right-of-way, proper abandonment of inactive penetrations, vegetation maintenance per USACE standards, and coordination with USACE Levee Safety and Connecticut DEEP Dam Safety divisions for permitting. No specific contract amounts, due dates, or award information are provided in this correspondence; it serves as a regulatory notice and request for cooperation rather than a formal solicitation.

RE: Hartford Flood Protection System- Emergency Action Planning Materials Innovation and Recycling Authority Site (MIRA)– Hartford, CT

Dear Mr. Shepard:

The City is requesting the assistance of MIRA and other entities which impact the flood protection system in complying with Federal requirements as it relates to their facilities. In addition, the City of Hartford intends to develop an updated Flood Control Levee System Emergency Action Plan (EAP) that complies with the latest guidance from the United States Army Corps of Engineers (USACE) and the State of Connecticut DEEP Dam Safety Division.

1. Federal and State Regulatory Framework- Emergency Action Plan

The City of Hartford has a regulatory obligation to the United States Army Corps of Engineers (USACE) including compliance with the Code of Federal Regulations for Local flood protection works; maintenance and operations of structures and facilities (33 CFR 208.10) ; State of Connecticut Department of Energy and Environmental Protection (DEEP) with respect to State of Connecticut Dam Safety statutes; and Federal Emergency Management Agency (FEMA) with respect to federal regulation 44 CFR 65.10. Owners of levee penetrations are similarly obligated to inspect and maintain penetrations to ensure ongoing integrity.

A critical element of this regulatory framework in the system’s operability is implementation of an Emergency Action Plan (EAP) for the flood protection system. The EAP is an important plan that identifies key actions that need to be taken to prepare, maintain and react to flood situations.

A well-developed EAP requires a commitment from entities such as MIRA regarding responsibilities for operation, maintenance, and emergency preparedness planning for the portions of infrastructure that directly impact the flood control system. These responsibilities include operation and maintenance requirements, inspections, reporting, and emergency preparedness planning and activities.

2. Penetrations Under Floodwall and Levee

One of the most important concerns for the MIRA facility is the presence of numerous pipe and conduit penetrations under the floodwall. These penetrations provide a connection from various plant components directly to the Connecticut River. Levee penetrations, both active and

Hartford Flood Protection System- Emergency Action Planning Materials Innovation and Recycling Authority (MIRA)– Hartford, CT May 10, 2022 abandoned, pose significant risk for levee failure. The City is concerned about the condition and status of the numerous penetrations within the MIRA facility.

Failure of a penetration could lead directly to floodwater entering the protected area or could destabilize the floodwall leading to a breach of the flood protection system. All known penetrations, as well other penetrations that may not be documented, need to be identified, evaluated, and monitored through periodic inspections by the penetration owner. USACE regulations require recurring inspections ranging from quarterly visual inspections to CCTV inspections at 5-year intervals. Additional guidance on the federal requirement is summarized in Appendix A.

The owners of levee penetrations and encroachments are responsible to develop and maintain the appropriate operation and maintenance manuals, communication and reporting protocols, inspection programs, and action plans for their facilities within the levee easement and which are appurtenant to levee penetrations.

A review of the levee right of way in the vicinity of the MIRA site has identified the penetrations noted below, which includes both active and abandoned penetrations (further inspection detail on the penetrations is included in Appendix C):

1. Sta. ± 80+40M to ± 84+00M – Three (3) – 8” Steel Oil Lines

2. Sta. +/-84+21M - 12” Cast Iron Roof Drain outfall and valve chamber with gate valve and flap valve at outlet

3. Sta.84+35M +/- – Screen House #1 inlet pipe – size unknown

4. Sta. 85+21M to 85+39M – Abandoned pre-existing intake /discharge tunnels (Two 7’x8’ vertically stacked conduits built in the 1920’s) – with concrete bulkheads / plugs, gates removed and at least partially filled with sand (between the bulkheads at the ends). Actual scope of work and the condition of the penetration is unknown.

5. Sta. +/- 85+39M to +/- 87+23M – Discharge conduit associated with screen house #2 – bulkhead with sand fill. The conduit is located on the riverside and running parallel to the flood wall.

6. Sta. +/-85+27M - 1” compressed air (3” sleeve), 1.5” water service (4” sleeve) and 6” service water (10” sleeve) pipes (levee plan sheet #64) Note: sleeves run through the concrete wall elements.

7. Sta. 85+69M – 8” oil line & 4” steam line pipes encased in concrete box & footing with insulation. Note: These pipes appear to have been encountered during the Closure Structure Renovation Project and were properly abandoned. The only concern is that location of the two penetrations differs from the levee record drawings. Need to verify that no additional lines were installed since the original levee construction.

8. Sta. 86+77.5M - 48” steel intake pipe

9. Sta. 86+80M – Ash pit outfall 10” CIP and valve chamber with gate valve & flap gate at outfall

10. Sta. 87+36M - 48” steel pipe to screen house (levee plan sheet #65)

11. Sta. 87+40M - 14” pipe – use unknown

12. Sta. 87+39M – 48” intake pipe

13. Sta. 87+85M - 48” discharge pipe

Materials Innovation and Recycling Authority (MIRA)– Hartford, CT May 10, 2022

13. Sta. 89+10M - Ash pit outfall – 12” CIP below floodwall and valve chamber with gate valve & flap gate at outlet (levee plan sheet #68B)

14. Sta. 90+75M - Ash pit outfall (levee plan sheet #67)

3. Other Levee Safety Concerns

In addition to concerns with the penetrations listed above, the City has also previously notified MIRA about activities within the Levee right of way/Floodwall easement which continue to need MIRA’s attention and action. Please see list below:

1. Encroachments within the City’s floodwall easement and the facility’s equipment which is attached to the concrete floodwall.

2. Various structures located on the riverside embankment as well as overhead crossings of the levee which are located within the floodwall easement and/or may impact embankment stability.

3. Ongoing vegetation control on the Riverside embankments

4. Need for an Emergency Preparedness Plan (EPP) based the operation and maintenance manual and protocols for their facilities which impact the Levee System. Operations located outside of the levee right of way/easement might be required if a levee pentation must be isolated in the event of a failure of the penetration. The EPP must address MIRA’s operations and emergency responses during flood events, including the protocol to isolate levee penetrations during a flood event. The City intends to incorporate all third party EPP’s into the federally approved Operation and Maintenance Manual for the System.

4. Decommissioning of MIRA Facility

The decommissioning of MIRA Trash to Energy Facility in 2022 is a major concern. The City is particularly interested in the future responsibilities for maintaining and operating MIRA’s infrastructure in accordance with the regulatory requirements as well as the impacts on the City’s operation and maintenance activities associated with the System. The Hartford Department of Public Works (DPW) needs 24/7 access to operate & maintain the levee, floodwalls and closure structures including flood fighting activities.

The City is particularly interested in how the responsibilities for maintaining and operating MIRA’s infrastructure will be transitioned. As part of the discussions with MIRA about EAP planning, identifying whether MIRA or a successor entity will assume these responsibilities will be a key element. A more specific listing of concerns relating to the decommissioning and beyond are Included in Appendix B.

5. Initial Request for MIRA Involvement and Assistance

In order to initiate this process, we are requesting that MIRA cooperate with the City in its effort to produce a viable Emergency Action Plan. Specifically, the City requests that MIRA take the following actions to assist in this process:

Appendix B

City of Hartford (Connecticut River Right Bank Flood Reduction System) special concerns and recommendations re: Decommissioning of MIRA Trash to Energy Facility

1. An Emergency Action Plan (EAP) must be developed by the City with MIRA’s assistance associated with their facility.

2. An Emergency Preparedness Plan (EPP) must be developed by MIRA which outlines their responsibilities for operation and emergency preparedness planning for the portions of infrastructure that directly impact the flood control system.

3. DPW must have 24/7 access to the MIRA site to operate & maintain the levee, floodwalls and closure structures including flood fighting activities per 33 CFR 208.10 and the federally approved Operation & Maintenance Manual for the Levee System.

4. Currently, MIRA conducts the grass cutting and other vegetation maintenance within the

System. This effort must continue after the operations are shutdown.

5. All vehicles, dumpsters, debris and stored material must be removed from the levee right of way / easement.

6. All site features, utilities, pipelines, levee penetrations, encroachments, etc. which are no longer necessary for the operation of the facility which are located within the levee right of way are to properly removed / abandoned. Greater Hartford Flood Commission, USACE Levee Safety and CT DEEP Dam Safety permits are to be obtained. Work and restoration of the levee ROW is to meet all federal, state and local requirements.

a. Features located to the landside of the levee / floodwall that need to be removed or abandoned.

1) Storage tanks located within the levee ROW.

2) Stairs, railings, fence lines, etc.

3) Utilities / pipelines are to be properly abandoned. Various pipelines appear to have been capped but not grout filled. The pipes are to be removed within the levee right of way / easement.

4) Various elements related to flood control were installed within the existing trash to energy building in the past. These elements are to be properly abandoned.

MIRA will remain responsible to properly operate and maintain these elements until they are properly abandoned. Additional information on the recent visual inspection completed by DPW is found in Appendix C.

5) All levee penetrations with access structures such as manholes are to be repaired and proper covers to be installed until the levee penetrations are properly abandoned.

6) Provision are to be undertaken to properly maintain the abandoned trash to energy building until the structure is razed. This is critical to ensure a safe work environment for DPW flood control, personnel and contractors working on the

System in the vicinity of MIRA’s infrastructure and buildings.

b. Features located on, overhead and beneath the levee and floodwall that need to be removed or abandoned.

1) All levee penetrations including third party penetrations which are currently inactive or become inactive when operations cease are to be properly abandoned including the large diameter intake piping, discharge piping, petroleum pipelines, etc.

2) Existing abandoned levee penetrations are to be properly abandoned to the satisfaction of the USACE. (i.e. dual conduit – concrete plug and wooden bulkhead with sand fill)

3) Any levee penetration which is to remain must be properly maintained and inspected per the federal requirements. All valves and gates are to be maintained and exercised to insure they function properly. Routine and periodic levee penetration inspections are required to comply with the USACE requirements.

4) Stairs and platforms are to be removed

5) Conveyors and other overhead pipelines/ features are to be removed.

6) All utilities, conduits, supports, lighting, etc. which are mounted on the concrete floodwall must be properly removed from the floodwall to the satisfaction of the federal, state and local requirements

c. Features located on the riverside of the levee / floodwall that must be removed or properly abandoned

1) Elements located on the riverside of the levee include but are not limited to the following: breakwater, former screen houses, chlorine house, coal tower, transfer house, overhead conveyor, handrails, fencing, discharge outfalls, etc. (Note:

structure identification is based on original levee plans. The use and infrastructure identified on the original System plans may have changed since the original construction). Any element that impacts the operation and maintenance of the levee system currently or in the future must be removed. Concerns about the impacts of the deteriorating infrastructure on the worker safety as well as the levee system

2) All equipment, structures, piping, walkway, handrails, etc. features located on the riverside of the levee / floodwall should be removed and the area restored to the

GHFC, USACE Levee Safety and CT DEEP Dam Safety requirements including:

• Intake / Discharge structures

• Utility lines & pipelines

• Screen houses

• Coal tower

• Conveyor system

• N/F Chlorine house

7. Provisions are to be undertaken to properly maintain the abandon structures on both sides of the levee/floodwall until the structures are razed / abandoned to ensure a safe condition for individuals working in the area.

8. All vegetation must be maintained, and woody growth removed per USACE EP 110-2-

18. Significant woody growth has become established on the riverside of the levee rip rap revetment / floodwall that needs to be removed.

9. Closure Structure #4 is to remain operable regardless of whether MIRA or its successors have a continued need to access facilities on the river side of the floodwall. Access to the riverside is still required to allow for maintenance and repair work on the riverside components or the floodwall itself. Although Closure 4 must remain operable, it may be left in the closed position (panels installed).

10. All site drainage connections to the levee toe / collector system should be evaluated for possible abandonment. Potential connections include piping the former HELCO yard sump.
