About this file

This is a Contractor Affirmation form issued by the Colorado Division of Labor for use by contractors participating in the Department Program for public contracts for services under Colorado Revised Statutes 8-17.5-101 and 8-17.5-102. The form requires contractors to affirm compliance with federal employment eligibility verification requirements within twenty days of hiring any employee to perform work under a public contract for services. Contractors must provide a notarized written copy of the completed affirmation to the contracting state agency or political subdivision, documenting that they have examined the legal work status of newly hired employees, retained file copies of documents required by 8 U.S.C. Section 1324a, and have not altered or falsified employee identification documents. The form designates specific fields for employee information including name, date of birth, and date of hire, as well as contractor details such as business name, contract number, and contractor representative signature.

Contractors must maintain the completed affirmation and supporting employment eligibility documents for the duration of each employee's employment under the public contract. The form must be notarized and includes fields for the notary's official signature and commission expiration date. The affirmation may be substituted with another substantially similar form provided it contains all legally required elements and information. This affirmation requirement applies to all contractors bidding on or performing services under state and local public contracts in Colorado and serves as a compliance mechanism for the state's employment verification program.
