Summary: 52.212-2 Evaluation Criteria for Commercial Products and Services

This document is an evaluation clause (FAR 52.212-2, November 2021) that establishes the Government's award methodology and scoring criteria for a commercial products and services solicitation. The Government will employ Lowest Price Technically Acceptable (LPTA) procedures, awarding the contract to the responsible offeror offering the most advantageous combination of price and other factors, with price designated as more important than technical merit. The evaluation process first establishes a competitive range based on pricing, then evaluates offers sequentially from lowest to highest price for technical acceptability until an acceptable offer is identified.

The evaluation employs two primary factors: Factor 1 (Price) requires calculation of Total Evaluated Price (TEP) by multiplying quantities by unit prices for each Contract Line Item Number (CLIN), followed by price reasonableness and price realism analysis using comparative analysis or commercial price lists to verify alignment with Government estimates and industry standards; Factor 2 (Technical) requires offerors to submit itemized quotes and Capabilities Statements evaluated against the Performance Work Statement (PWS) in Attachment 1, receiving either "Acceptable" (clearly meets minimum requirements) or "Unacceptable" (does not clearly meet minimum requirements) ratings. Minimum technical requirements include contractor understanding and capability to provide preventive maintenance for all chillers, perform maintenance and repairs per industry standards (ASME, NFPA, ASTM), deliver comprehensive Annual PM Reports within five business days, conduct Spectrographic Oil Analysis and Eddy Current Testing per schedule, provide a certified crew with required qualifications, adhere to safety and environmental regulations (OSHA, AFMAN 91-203) with full HAZMAT management, and professionally manage on-site activities including security protocol compliance.

52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)

Evaluation Criteria

The Government will utilize lowest price technically acceptable (LPTA) procedures. The Government will award a contract resulting from this solicitation to the responsible offeror conforming to the solicitation that will be most advantageous to the Government, price and other factors considered. The price is more important than technical. The Government will first establish a competitive range based on price and then evaluate the lowest offer within that range for technical acceptability. If the lowest offer is not technically acceptable, the Government will proceed to evaluate the next lowest offer, and so on, until a technically acceptable offer is identified.

The following three factors shall be used to evaluate offerors:

Factor 1: Price

An offeror’s Total Evaluated Price (TEP) will be determined by multiplying the quantities identified by the proposed unit price for each Contract Line Item Number (CLIN) to confirm the extended amount for each. The Government will first conduct a review of the overall quoted pricing and place the offerors in order from lowest to highest based on price. The government will conduct both price reasonableness and price realism to establish a competitive range. Generally, adequate price competition will satisfy the criteria of price reasonableness;

other methods include, but are not limited to, historical prices paid and comparison to the Independent Government Cost Estimate. In addition, the Government will conduct a price realism analysis to ensure that the proposed price is realistic for the work to be performed, reflects a clear understanding of the requirements, and is consistent with the offeror's technical proposal.

This analysis will include one of the following:

Comparative Analysis: Comparing proposed prices with the Government estimate, historical prices, or prices submitted by other offerors.

Commercial Price Lists or Industry Catalogs: Using commercial price lists or industry catalogs to verify that proposed prices are in line with industry standards for similar goods or services.

Factor 2: Technical

Technical proposals shall include the Offeror’s itemized quote and Capabilities Statement that will be evaluated using Attachment 1, Performance Work Statement (PWS). Each quote will receive an acceptable or unacceptable rating indicating whether the quote is technically acceptable.

Technical Acceptable / Unacceptable Ratings Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

At a minimum, the quote must meet all specifications listed in Attachment 1, PWS.
