52.212-2 Evaluation-Commercial Products and Commercial Services. 2021-11 Addendum to 52.212-2, Evaluation - Commercial Products and Commercial Services (Nov 2021) FAR provision 52.212-2, is hereby tailored as follows:

Basis for Award.

(1) An award will be made to the Lowest Price quote, where the price is found by adding the total price for all options to the total price for the basic requirement, after determining:

(i) The quotes conforms to all instruction requirements listed within 52.212-1

(ii) The price is realistic and there is no indication of unbalanced option pricing

(iii) The quote is technically acceptable

(iv) The quoter has acceptable past performance

(v) The quote takes no exception to any of the terms and conditions in the solicitation. By submitting a quote with no exceptions, a quoter is confirming it possesses all and any necessary facilities, equipment, skills and capacity to successfully provide all services required under this solicitation.

(vi) The quoter is responsible; the government reserves the right to use any outside sources available to verify matters pertaining to the quoter's responsibility, prior to making an award decision, IAW procedures outlined within the FAR and its applicable supplements; IAW FAR 9.103, quoters who are determined nonresponsible will not be selected for award.

(vii) The government intends to evaluate quotes and award a purchase order without entering into discussions.

Method for Award.

The following method will be used to review and evaluate quotes, only to the extent necessary.

(1) The review and evaluation of quotes will first determine if each one conforms and is fully responsive to the solicitation; each quote will either be determined as responsive, or nonresponsive and removed from evaluation. Only responsive quotes will be evaluated, responsive quotes will be evaluated in order from the lowest to the highest price to find the lowest priced, realistic, quote which contains no unbalanced option pricing. To award, the quote will need to be determined technically acceptable; have acceptable past performance; and take no exception to any of the terms and conditions in the solicitation. If that quoter is also found to be responsible, the Government will conclude the evaluations of quotes and make an award to that quote. This process may continue through to higher priced quotes, as necessary, until an award can be made.

(2) Quotes, to the extent necessary, will be reviewed to ensure:

(i) The quote conforms and is fully responsive to all instruction requirements listed within 52.212-1.

(ii) The quote takes no exception to any of the terms and conditions in the solicitation.

(iii) A quote that fails to comply with these requirements, will be determined unresponsive and immediately removed from consideration for award.

(3) Factor 1: Technical.

Each factor and subfactor will be considered acceptable or unacceptable as defined below:

Acceptable: Quote meets the minimum requirements of the solicitation.

Unacceptable: Quote does not meet the minimum requirements of the solicitation

(i) The technical section, this factor will be acceptable if:

(A) The quote includes documentation of proposed services, in sufficient detail for the Government to determine that quoted services can meet the technical requirements of the SOW, including appendices, and state certification criteria for water testing and the safeguarding of water samples

(B) sufficient detail to evaluate and substantiate the validity of its claims.

(4) Factor 2: Solicitation and Price.

(i) The quoter's price will be determined by adding the total price for all options to the total price for the basic requirement. The total price of the quote for the base period, all possible option periods to be exercised under FAR clause 52.217-9 and any possible extension under FAR clause 52.217-8 for up to six (6) months will be evaluated.

(ii) Price Realism. The Government may determine that a quote is unacceptable if the total price appears unrealistically low when compared against the government estimate and/or, at minimum, the next lowest quote.

(iii) Options. The Government will evaluate for options, by calculating the percentage of change from year to year, to determine if any use of 52.217-8 and 52.217-9 will be in the government's best interest. The Government may determine that a quote is unacceptable if the option prices appear to be significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(iv) The solicitation and price section of the quote will be reviewed to ensure the quoter

(A) Completed Contractor Information

(B) Completed all blanks for unit and total prices for Base and Option Years.

(b) Options. Paragraph is deleted and will be evaluated as listed in paragraph (a) and 52.217-5.
