About this file
This document is a Federal Acquisition Regulation (FAR) 52.212-2 Evaluation Criteria for Commercial Items, outlining the government's approach to awarding a firm fixed-price purchase order. The solicitation establishes two primary evaluation factors: Price and Technical Capability. For pricing, vendors must submit all-inclusive, detailed pricing that includes material costs, shipping, equipment, transportation, fuel, incidentals, and taxes. Technical capability will be assessed through a vendor's ability to provide a narrative describing how they will accomplish tasks in the Performance Work Statement, including an inventory of vehicles, equipment, and tools.
The government intends to award the contract without discussions, requiring vendors to submit their best technical and price terms initially. Vendors will be rated on an adjectival scale (Acceptable, Marginal, Unacceptable) based on their quote's completeness and conformance to technical specifications. The solicitation is 100% set aside for small businesses in the NAICS code 238190, with a $19M size standard. Vendors must quote the entire requirement, and the government will analyze past performance information from systems like CPARS, FAPIIS, and SPRS to determine contractor responsibility.

FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS
(a) The Government intends to award one firm fixed priced purchase order to the responsible offeror whose quote conforming to the RFQ requirements represents the best value, price and non-price factors considered.
All responses will be subjected to an initial screening for completeness and conformance with RFQ instructions before being evaluated. A response that is incomplete will not be considered for award. The following factors shall be used to evaluate offers (Factors other than price when combined are approximately equal when compared to price):
FACTOR 1 – Price
- Submitted pricing must be all inclusive; a breakdown is required to include, but not limited to: Material costs, FOB destination shipping, equipment costs, transportation with fuel, incidentals and subcontracting if applicable.
- Proposed prices shall be evaluated for completeness, and reasonableness for the scope of work to be accomplished. The Government may determine that an offer is unacceptable if the prices are significantly unbalanced.
- Please include applicable taxes with your quote.
FACTOR 2 - Technical capability to provide services to meet the government requirement.
- For each Contract line-item (CLIN) vendor shall provide a technical narrative or description of how the offeror will accomplish all tasks identified in Attachment 1- Performance Work Statement.
- Offeror shall include inventory of vehicles, equipment and tools that will be utilized to complete the requirement.
- Offerors must attempt to quote the requirement in its entirety, offers for partial portions of the requirement will be considered unacceptable.
Based upon the Government’s evaluation of offeror provided information, one of the following adjectival ratings will be assigned.
Adjectival Rating Description Acceptable Offeror quoted all requested items and all items conform to required technical specifications.
Marginal Offeror quoted some but not all requested items and/or not all items conform to required specs.
Unacceptable Offeror did not quote conforming items, quote is not awardable
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c) The Government intends to award without discussions. Offerors shall ensure their initial proposal contains its best terms from a technical and price standpoint. However, the Contracting Officer reserves the right to hold discussions if necessary.
(d) The Government will analyze and consider past performance information obtained from:
- Contractor Performance Assessment Reporting System (CPARS)
- Federal Awardee Performance and Integrity Information System (FAPIIS)
- Supplier Performance Risk System (SPRS)
- Other Publicly Available Information
