About this file

This file is a representation and certification document containing two Federal Acquisition Regulation (FAR) provisions regarding covered telecommunications equipment and services compliance.

FAR 52.204-26 requires offerors to represent whether they will provide covered telecommunications equipment or services as part of their offered products or services. Offerors must review the System for Award Management (SAM) exclusion list and certify their status under penalty of perjury. FAR 52.204-24 establishes prohibitions under Section 889(a) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits federal agencies from procuring equipment, systems, or services that use covered telecommunications equipment as a substantial or essential component or as critical technology. The regulation applies to procurement decisions made on or after August 13, 2019, and to contract extensions or renewals on or after August 13, 2020. Offerors must represent whether they will provide such equipment or services and whether they currently use covered telecommunications equipment or services in their operations. If an offeror answers affirmatively to either representation, detailed disclosure is required, including the entity that produced the equipment, specific product descriptions with brand and model numbers, CAGE codes, and explanations of proposed use and permissibility under the prohibition. The document applies to this solicitation for packing, containerization, and drayage services for Fort Gordon soldier relocations, requiring all offerors to complete these representations and certifications as part of their proposals due July 9, 2026.
