STATEMENT OF CLARIFICATION
PPNM ROCK STABILIZATION
STATEMENT OF CLARIFICATION
BY THE BUREAU OF LAND MANAGEMENT
In order to ensure constructability of the project (e.g. drilling operations), the Government will accept limitation exceedances of the values listed in the Noise & Acoustics Management – 01 57 19.12 specification.
The intent of Noise & Acoustics Management – 01 57 19.12 specification is to protect the public from damaging and distracting noise and acoustics during construction. The Government will accept exceedance of limits listed in 01 57 19.12 Part 3.1.B.1 if no publicly accessible areas receive levels of dB(A) over 70 dB(A). The Government will not require a time duration of impact noise restriction as listed in 01 57 19.19 Part 3.1.B.1. If publicly accessible areas are to receive over 70 dB(A), then the areas
(e.g. boardwalk, viewing platforms, walking trails) will need to be closed from the public by the
Government for the duration of the construction activity causing the limitation exceedance. The
Contractor shall operate in a manner to adhere to 01 57 19.12 Part 3.1.A. The Government will accept sound level exceedance in 01 57 19.12 Part 3.1.C as long as the publicly accessible areas are below 70 dB(A) and Contractor personnel safety controls are per OSHA standards.
Seasonal construction restrictions from February 1 to June 30 apply for this project for nesting owls at the Turtle Rock construction areas only. Seasonal restrictions from April 15 to July 15 apply for this project for migratory birds. Migratory bird restrictions will be mitigated by the Government by mowing all construction areas to prevent migratory bird nesting from establishing. If migratory bird nests are established and identified, however not anticipated for this project, the seasonal restriction shall apply to this project.
